Issue: Closing on a mortgage

Subissue:

Consumer Complaint: I am a home owner. I had Ocwen mortgage which is now PHH. I was sad to see Mr XXXX go since he knew the horrors of Ocwen. After twelve years of XXXX with Ocwen dealing with botch escrow accounts putting lender place insurance on my home 106 times and never giving me credit for it after it was discovered but taking it out of my loan then saying I was behind, robo calling, on and on I finally being XXXX cant fight any more and I let the home go to foreclosure. I have complained to you before about them. During the redemption period we had our realtor negoitiate a short sale. We have a buyer and Owen approved it. There relationship manager worked on this for 4 months. We have a buyer and a approval by Ocwen. theclosing was delyed because we were waiting for paper and lien removal from IRS. Then by that time PHH took over Ocwen. We were ready to close and they would not honor the short sale stating they dont allow them during the redemption period. They are much worse then Ocwen. There is no reason given. Of course you can never talk to the same person twice. XXXX XXXX is unreachable as are all the higher ups. Our relationship manager XXXX XXXX worked four months on this he is not sure if he is even working there. There is no reason to deny the shortsale we have a buyer. They will not have access to the driveway if this does not go thru as we own that and bought it separately and it does not go with house. In addition XXXX XXXX is part owner because they are removing dioxins from river. Why are these type of companies still in business. I know that they hire lots of former government officials in these areas and top executives go to the government as well from these companies. Yet millions of homeowners lost there homes and no one is doing anything. They dont want these horrible companies to go down. They just want them to get fined to death so they can keep there agencies afloat. Its a crime. Please help us. This is not right we have no where to turn.

Issue: Struggling to pay mortgage

Subissue:

Consumer Complaint: My mortgage was sold/transferred to PHH Mortgage from Ocwen. I had just been approved for a repayment plan from Ocwen on XX/XX/XXXX and made a {$1200.00} down payment to begin the plan. I made my first payment of, {$1300.00} in XX/XX/XXXX and then my loan was transferred to PHH Mortgage. My loan was sold and without my knowledge my approved payment plan from my previous mortgage company Ocwen was cancelled. When I attempted to make payments online with PHH, it never showed any payments I made this year ( XXXX ) totaling over {$2500.00} to my previous mortgage company. The PHH online system also never listed my approved repayment plan that began XX/XX/XXXX, with a monthly payment of {$1300.00}. This payment plan wasnt scheduled to be completed until XX/XX/XXXX. On XX/XX/XXXX, I applied for mortgage assistance with my current mortgage company PHH, I received a letter from PHH stating my application was not complete and I had until XX/XX/XXXX to submit the missing documents needed to complete my application. I found out today online via XXXX that my house is scheduled for foreclosure auction on XX/XX/XXXX. I have not received anything from the lender PHH or their attorney regarding a foreclosure sale. This was done while a request for mortgage assistance application was open. I looked today online at the activity on my account with PHH and found out my mortgage assistance application was closed by PHH employee XXXX XXXX on XX/XX/XXXX. I never asked for my mortgage assistance application to be closed especially since I had until XX/XX/XXXX to complete it. I never received a denial for mortgage assistance from PHH. What PHH Mortgage is doing to me is Not legal and Im requesting the foreclosure sale being stopped and/or cancelled immediately. I have attached documents as proof to support everything that I have listed on my complaint.

Consumer Complaint: Starting on XX/XX/2015, OCWEN Loan Servicing stopped sending my monthly statements. When I called to ask why I was informed that because of my bankruptcy discharge they were no longer mailing it. I have not declared bankruptcy. I called their main number and after dozens of frustrating calls, I finally spoke with one of their reps. and she promised that she would help me with my concern as sure enough I received a phone call about two weeks later. She was very apologetic about what had taken place and I even received a letter from Ocwen stating that this had been their mistake. My statements began to be mailed to me again and I thought this was behind me. Well, Ocwen no longer services my account. It's now PHH mortgage services XXXX XXXX XXXX XXXX XXXX, NJ XXXX and guess what, we are right back where we were again. I called PHH on2 maybe 3 separate occasions and the last time I spoke with what has to be one of the most rude persons I have ever spoken to, said ( paraphrasing ) get a lawyer and take us to court. I don't know what else to do. Can you help me? Thank you. XXXX XXXX XXXX

Consumer Complaint: My husband and I fell behind with our mortgage - we were approved for a TPP - at the second month the mortgage transferred from Ocwen to PHH mortgage - we completed the 3 month TPP and then PHH refused to accept payment, they accelerated even though I notified them that the final mod did not arrive - I've spent hours on the phone - was told they mailed it on XX/XX/XXXX - again it did not arrive and I phoned them on XX/XX/XXXX and again on the XXXX - I then sent a QWR which I was anticipating an answer -they signed for on XX/XX/XXXX. They again, would not accept a payment - Our TPP period was XXXX XXXX and XXXX - The distress of the transfer and the inability of PHH mortgage has caused so much stress. We were 2 months behind when we applied for the modification - and after 3 months of this TPP and how our funds were applied -we are now due for 6 months of payments ( XXXX - XXXX ). This mishandling of our mortgage has forced the acceleration to the foreclosure status. As the fear that the final mod detail would not be provided and with PHH refusing payment to keep the TPP in place -I 've spent hours on the phone with PHH and each call resulted in contradictions of information - which causes much confusion to us. Finally, on XX/XX/XXXX, the TPP was sent via email from PHH Mortgage. We were shocked to see the terms associated with the modification. We have 6 years left on our mortgage with no balloon. The final modification showed that the term would be extended to XXXX years and result in a XXXX Balloon at the end - HOW IS THIS FAIR? I specifically asked Ocwen when the TPP was offered how this modification would work -I was reassured that there would be no long term extension and without the ability to see the full details, I needed to have faith and complete the 3 month TPP. With the threat of foreclosure with XXXX being the next payment due according to the modification ( which PHH refused ) -I borrowed money from a family member for the past due payments - XXXX. I overnighted the funds to PHH who signed for the delivery on XX/XX/2019. To date - a full week later, PHH has not acknowledged receipt of the funds, has not applied funds to our account. My last call to PHH was on Thursday, XX/XX/XXXX - and I was told to " give them time '' I was reassured that they escalated this - and yet, no answers have been provided. I then get an email yesterday that states that they have yet to receive the certified check? I also have escrow issues - where I asked to

Consumer Complaint: My loan was originated on XX/XX/XXXX for XXXX at 11 % interest through XXXX XXXX ( i think ) it has been almost 20 years. It was a second mortgage on a house we paid XXXX for in XXXX. This was to build an addition to the house which we did. Ocwen has owned the loan for years. Here is where the problem lies. This was a straight equity mortgage with 11 %. Nothing fancy just a straight 20 year loan. My first payment was in XXXX of XXXX. Here we are at almost 20 years later and my loan has only gone down by XXXX according to ocwen which is now phh. I never paid much attention to the balance till now I just paid it. My last payment shows they charged it all to interest nothing went on principle. I am being ripped off and after researching ocwen and how they have been doing to other people, like not crediting payments correctly etc. I feel that I fall into that category. I have paid on this loan for 20 years and have nothing to show for it on the balance sheet. This needs to be corrected and fixed immediately. Also i don't understand ltv but they have it really high at 76 %. That is also incorrectly miscalculated.

Consumer Complaint: I was affected by the National Disaster in XX/XX/XXXX, I was employed in a Federally Declared National Disaster Area due to the CA Wildfires. I had contacted Ocwen, the loan servicer at the time and requested disaster assistance, such as a modification. After several requests I was told to apply in XX/XX/XXXX. I applied, but never received a response, possibly because my mortgage was transferred on XX/XX/XXXX and the new servicer said my file was not yet updated. I dont understand why my loan was transferred at the same time that I was given a package to apply for disaster relief and a modification. I have requested to be considered several times, but the new servicer has no record of my previous requests. So much time has gone by and I have not received any response, any assistance and I have now been referred to an attorney for foreclosure proceedings. I requested assistance several times, prior to being in foreclosure, as a result of the disaster. I was in the process of applying and referred to an agent, at the same time that my loan was transferred. This has caused me to lose contact and the servicer to lose track of my assistance request. In a previous complaint, Ocwen incorrectly thought I was requesting assistance because of damage to the home, but I was requesting assistance bc I was employed in the Fire Area, which was not accessible and heavily affected.

Consumer Complaint: For many years, I have had 2 mtgs. on XXXX, KY properties, and I live there and in XXXX.Since inception, mtg. pmts. have been debited from XXXX XXXX. In XX/XX/XXXX, XXXX had insufficient monies, so I asked PHH, the servicer, on a one time basis, to debit XXXX. In XX/XX/XXXX, rather than debit XXXX, PHH debited XXXX in error, & payments were returned. In late XX/XX/XXXX, I returned to XXXX, and opened a letter from XXXX XXXX at PHH dated XX/XX/20, saying she was my case manager, and to call her, which I did. However, each time, a recording said the extension was not available, and I was transferred to a call center in XXXX. I asked to be connected to her extension, and they tried often, without success, due to problems with their phone system. Finally, I got her email address, and only then, did she call me. I advised of the PHH error with XXXX, and that I wanted her to debit XXXX to bring my loans current, and to restore auto debits. She said she would have to research, and get back to me.She called and left VMs for me, but each time I called her, I got XXXX, and they could not transfer me to her! On XXXX, I called her again, got XXXX, & was advised that my loans were sent to foreclosure. This is outrageous and pure incompetence by PHH! I am in XXXX, where I bought a house to retire, and mailed a cashiers check to her today for the XXXXXX/XX/XXXXpmts., again asking her to restore XXXX auto debits.

Consumer Complaint: I asked Ocwen for a modification to bring my mortgage current after dealing with health issue. I made 3 trial payments in XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX as per the agreement. In XX/XX/XXXX they informed me that they were finalizing the modification document. Again in mid-XX/XX/XXXX i was told the same thing and I told them I needed the agreement to read and sign before I could make my new payments. I finally received the agreement on XX/XX/XXXX. The agreement said my new balance was {$72000.00} and a balloon payment of {$56000.00}. By then they said they would not accept my payments. They then informed me that PHH Mortgage services were the new servicer beginning XX/XX/XXXX. PHH informed Iowa XXXX XXXX that I was not eligible to do anything but short sale or foreclosure.
