Consumer Complaint: My mortgage company is refusing to pay my property taxes out of my escrow account for tax year XXXX. In XX/XX/XXXX PHH Mortgage contacted the XXXX County Oregon Tax Assessor to get my property tax information as usual. At the beginning of XX/XX/XXXX, I received a tax notice from the county showing my taxes had not been paid. Per the instructions on my mortgage statement, I immediately mailed the notice to the mortgage company tax department on XXXX XXXX and it was delivered by USPS Priority Mail on XXXX XXXX. I began calling customer service on XX/XX/XXXX asking them to pay the taxes immediately. I called again on XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, and again today XX/XX/XXXX. On XX/XX/XXXX I filed a complaint with the Oregon Department of Consumer & Business Services. On XX/XX/XXXX PHH sent me a letter saying they would provide a written response to that complaint by XX/XX/XXXX or notify me if a 15-day extension is necessary ( they have done neither as of XX/XX/XXXX ). On XX/XX/XXXX PHH sent me an email stating that they had paid my property taxes for XXXX. On XX/XX/XXXX the PHH website showed they had paid no XXXX taxes but had already paid XXXX property taxes and debited my escrow account. On XX/XX/XXXX I confirmed by email to XXXX County Tax Assessors that they had not received any tax payments yet for my home. Today on XX/XX/XXXX I tried calling 4 different numbers for PHH mortgage and all of them say there are no customer service representatives available and then disconnect. I tried emailing the account that emailed me saying the taxes had been paid and received an auto-response that they would try to reply within 10 days. The Escalations Manager at PHH who worked on this is named XXXX and her direct line is supposedly XXXX ext XXXX.

Issue: Trouble during payment process

Subissue:

Consumer Complaint: We suffered a housefire in XX/XX/XXXX. Since this time, our mortgage company has been very difficult to work with, specifically in the last six months. Although we have turned in paid receipts for months, they do not release funds. Every time you call the company you have to speak to a new person and get a different answer as to why you have not got funding yet. To date, they have over {$20000.00} that they are holding and will not release. They sent a check on XX/XX/XXXX but this check had our ex-contractor 's name on the payee line, which they had been informed of several time that he was no longer our contractor. Upon asking for an updated check, the company informed us they would issue a stop payment and get us a new check within 10 days. It has now been 15 days and they have not even processed yet. This is a severe hardship for our family and has caused months of unneeded stress. They can clearly see through inspections and receipts that the money has been spent to fix the home.

Issue: Closing on a mortgage

Subissue:

Consumer Complaint: Date : XX/XX/XXXX From : XXXX XXXX. XXXX XXXX XXXX XXXX XXXX # XXXX XXXX, MD XXXX Email : XXXX FHA Case # XXXX Attention : CFPB Regarding : OCWEN/PHH MORTGAGE Property Address : XXXX XXXX XXXX XXXX, XXXX XXXX, MD XXXX To Whom It May Concern : I am the homeowner of the above address property, which is scheduled to be sold on XX/XX/XXXX. I am requesting that PHH Mortgage be investigated for a lack of communication regarding a subordinate mortgage amount of {$130000.00}. I am a XXXXyear old widow and recently lost my XXXX job due to the Covid-19 pandemic. In XXXX, my husband succumbed to XXXX. I had retired to become his XXXX. When he passed, I was left with a home mortgage with OCWEN that I couldnt afford to pay and was behind in the monthly payments. In XXXX, I was granted a loan modification by OCWEN now PHH and I was able to hold onto the property, although like many homeowners, the value of the property was underwater after the housing crash in XXXX. In XX/XX/XXXX, I placed the home up for sale after investing considerable funds to update the home. In XX/XX/XXXX, I received an offer to purchase the home and I accepted the offer, with an agreement to close on the sale on XX/XX/XXXX. As part of the title research, XXXX XXXX discovered a Subordinate Mortgage to HUD recorded in XXXX County of which I was not aware of its existence. I have been informed by PHH that, as part of my loan modification, a Subordinate Mortgage was created because the original loan was an FHA loan. On XX/XX/XXXX XXXX XXXX provided me with a copy of the recorded Subordinate Mortgage and I was stunned and dismayed. The document appears to have my signature and yet I have no memory of this lien nor any record/ correspondence from HUD/XXXX regarding this lien. I have never received any notification of this debt from my mortgage company, PPH ( formerly OCWEN ). There is no reference to a Subordinate Mortgage on my monthly statements. I have been informed by PHH that their company was not responsible for transmitting any information regarding the Subordinate Mortgage. On XX/XX/XXXX I received correspondence from XXXX confirming the Partial Claim due is : {$130000.00}. The scheduled sale of my home will not provide the funds to cover this newly discovered Subordinate Mortgage. In fact, I have been informed that I will be expected to BRING funds to the closing of the sale. As a XXXX-year old widow, I am relying on the sale of the family home to keep me stable. Having lost my XXXX job last week due to the COVID-19 pandemic, I can not pay the monthly mortgage, and it seems, I can not afford the cost of selling the property either. I realize there are many Americans who are facing this current financial crisis. I feel I am getting crushed again, by the loss of home equity in XXXX ; by the loss of my husband in XXXX ; and now with this previously undisclosed Subordinate Mortgage. I desperately sought HUD forgiveness of this Subordinate Mortgage in order to proceed with the sale of my home on the rescheduled date of XX/XX/XXXX and received a response that HUD does not forgive the debt under any circumstances. I would greatly appreciate the assistance of CFPB at the earliest opportunity, as my time is running out. I have spent every day since I became informed of this issue, trying to get information from PHH and from HUD/XXXX. I feel OCWEN/PHH did not comply with responsible mortgage practice by not informing me of the Subordinate Mortgage until the imminent sale of the property. This is not right. Thank you, XXXX XXXX XXXX XXXX XXXX

Issue: Struggling to pay mortgage

Subissue:

Consumer Complaint: Since XX/XX/XXXX I have been discussing a payment plan with my Mortgage company. By phone I was informed of a plan that would be arranged for me from XXXX to XXXX. They told me to pay from XXXX to XXXX XXXX {$680.00}. Then in XX/XX/XXXX to pay {$1300.00}. Then in XX/XX/XXXX I would start to pay {$750.00} a month. I paid {$700.00} a moth instead of the {$68000.00}. This went on until XXXX XXXX. In XX/XX/XXXX is when they set me a letter about the forbearance that the amount of {$700.00} was to avoid " Foreclosure ''!!! I thought it was towards my mortgage. Now my mortgage is of course backed up for months!!!!. So now again I've asked for a Payment Plan in order to be able to pay my mortgage. They've had me in review since XX/XX/XXXX to see if I qualify for a payment plan. Now its XX/XX/XXXX and they inform me I do NOT qualify for a payment plan, and now I owe {$11000.00}. I have called every single month to get some answers to no avail. I have offered to pay my mortgage, I even sent a check in XX/XX/XXXX for mortgage payment and they returned it. Now they want me to pay the full amount of {$11000.00}. So my question is, why do you think I was asking for a payment plan? I'm totally confused and angry. I have documentation of Request for Mortgage Assistance & their response, I also have my statements.
