My 2nd loan with 21st mortgage statements have a statement balance of {$28000.00} When the loan pay off was requested they added an additional {$7100.00} of accrued interest. This is unfair because I expected my payoff to be close to the statement balance. My statements have never shown any accrued interest accumulating.

The mortgage has been transferred from servicer to servicer. Customer Service always states the request is being processed when I call but the mortgage assistance request is never finalized. My request has been in processing with several Relationship Managers as well. I don't want another property foreclosure sale date set for my home. I want to keep my home. My employment has been affected by Covid - 19 also. PHH is difficult to work with and customer service is difficult. Please assist me with the finalization of my mortgage assistance request.

Consumer Complaint: We have been approved by a new mortgage company at a lower interest rate. PHH Mortgage will not honor our request submitted by both us, XXXX XXXX XXXX, and XXXX XXXX, on XX/XX/2020. After multiple, daily phone calls and speaking with multiple representatives, it is clear that this company is stalling vs. just letting us out of this high interest mortgage. The final straw is their stipulation for a calculation of payoff quote, they must have an internal appraisal completed. We opened our home to their hired appraiser XX/XX/2020, but after multiple calls and queries, they say, " we can't find her photos. '' The first couple of calls reported " She sent photos in black and white '' Also, we have been unable to get into our established online account to see documentation and payments, etc ... We have been shut out since we made first payoff request. Finally, each monthly payment we make is 99 % interest, so far we've made 3 payments AFTER the initial payoff request. Consumer Complaint: The issue is that over the life of my loan I had XXXX loan modification ( XX/XX/XXXX & XX/XX/XXXX ) that included principal reductions and adjustments in interest rates. The modifications became a subordinate note added as a property lien. When I sold the home XX/XX/XXXX, the payoff of the principal amount and the lien seem odd. So I contacted PHH Mortgage service to ask about the amounts and shared that a principal reduction was apart of my modification. I was told that there was not a principal reduction or principal forgiveness applied. The interest rates were adjusted but there was no reduction in the principal. As a result, I have over paid since the principal reduction amounts were a part of the subordinate note that I paid when selling the home. I then reached out to HUD, XXXX XXXX XXXX XXXX and PHH Loan servicing to explain what happened and requested a refund as resolution of the over payment. HUD and XXXX explained that XXXX XXXX XXXX are my source for a refund. My original loan amount is {$220000.00} XX/XX/XXXX principal pay off amount - {$140000.00} and the subordinate note - {$57000.00}. which would equate to me only paying {$13000.00} on the principal since XX/XX/XXXX, That didn't make sense. But would confirm since the principal reductions was not applied. I reached out to PHH loan servicing again in XX/XX/XXXX. I have followed up several times. I sent a letter of on XX/XX/XXXX. I received a letter from the research department acknowledging my letter. But now it is the end of XXXX. I called them again and ws told no letter shows received and that I have to start this process all over again. They will not escalate the issue. Even tho I shared my documentations that was sent in XX/XX/XXXX. I resent the information XX/XX/XXXX. I contacted HUD and was encourage to file a complaint with CFPB.

I make this affidavit of my free will and based on my personal knowledge of the facts herein stated. 2. The plaintiff can not prevail because can not show that as the date of filing of the complaint XX/XX/XXXX, it had the necessary standing to sue. Plaintiff Ocwen claims to act as a servicer for the owner of the instruments XXXXXXXX XXXX. However, records show that XXXX XXXX is the owner and XXXX XXXX XXXX services mortgage, letter dated XX/XX/XXXX, And Ocwen acting as a collector agency. Attached as exhibits A and A1, respectively 3. Plaintiff is relying on an assignment # 1 of mortgage, MEARS designate a XXXX XXXX to assign a XXXX XXXX assignment of mortgage, recorded on XX/XX/XXXX. Assignment manufactured at the office of XXXX XXXX and signed by XXXX XXXX. XXXX, at XXXX XXXX At XXXX. [ T ] he unexplained, undated endorsement to the Tirth party iscircumstantial evidence that Plaintiff may have not possessed the note at the time the suit was filed This assignment of mortgage is not accurate reflection of the transfer of note and mortgage to the plaintiff, especially when XXXX XXXX is stating in writing that XXXX XXXX XXXX is the servicer of the loan, see exhibit A. So, Plaintiff Ocwen who is relying on documents that may not be genuine and accurate. Please see letter from XXXX XXXX XXXX, dated XX/XX/XXXX, showing again evidence that XXXX XXXX XXXX is the provider of the loans documentation. Attached as exhibit B, dated XX/XX/XXXX, and assignment as exhibit C. 4. As a fact XXXX XXXX XXXX took over XXXX on XX/XX/XXXX. How MEARS as nominee for XXXX XXXX assignment # 2 of mortgage to Ocwen Loan Services on XX/XX/XXXX, and assignment was not recorded until XX/XX/XXXX, almost a year after filing of the complaint. Again, this assignment is null and invalid because MERS had already divested itself of any interest nominal and or pecuniary. Attached assignment as exhibit D. 5. Perhaps, a more coherent assignment, it should have been an assignment from XXXX to XXXX XXXX XXXX, since XXXX was taking over in XXXX, by XXXX XXXX XXXX. 6. As stated before XXXX XXXX XXXX took over XXXX on XX/XX/XXXX. How can XXXX XXXX XXXX continue signing assignments as the corrective assignment # 3 of mortgage to Ocwen Loan Homes and recorded on XX/XX/XXXX. Attached as exhibit E. 7. On XX/XX/XXXX, Certificate of Title sold to XXXX XXXX XXXX XXXX XXXX XXXX XXXX, for {$180000.00} and Certificate of sale vacated on XX/XX/XXXX and title and awarded to defendant XXXX XXXX XXXX. Perhaps, based on my personal understanding, this is an ethical issue ; since, XXXX XXXX already got paid zillions of dollars from XXXX XXXX XXXX for all those fraudulent loans given from XXXX and assignments manufacture by XXXX XXXX law firm, why XXXX XXXX expose itself to buy it. Attached as exhibit F and G, respectively. 8. Again another assignment # 4 Corporate Assignment, recorded on XX/XX/XXXX, where OCWEN assigns it to XXXX XXXX XXXX XXXX XXXX, XXXX XXXX. On my personal knowledge a Corporate Assignment perhaps is a maneuver by the plaintiff law firm to back out of an incorrect filing claim, where the wrong party in this case OCWEN who was named as the plaintiff as the outset of the action. Attached as exhibit H. 9. Again a complementary Assignment # 5 recorded on XX/XX/XXXX, where XXXX XXXX assigns it to XXXX XXXX XXXX as a trustee for RMAC, seeking foreclosure action and filed on XX/XX/XXXX. Now, XXXX XXXX XXXX substituted the wrong plaintiff OCWEN. Attached as exhibit I. 10. Certainly, any plaintiff in this case can not rely on a canceled note and mortgage to seek foreclosure of the property because the documents have been canceled, dated XX/XX/XXXX and the note attached to the complaint was never transferred to XXXX XXXX XXXX or MEERS. So, collateral rights over the property have terminated and the assignments void ad initio. On XX/XX/XXXX, received an email from the PHH Covid19 assistance team to furnish requested information, we replied to them on XX/XX/XXXX. We hold the complaint to file in the court till PHH Covid19 reply ( email sent to them on XX/XX/XXXX as reply to PHH email sent to us on XX/XX/XXXX ).
