Consumer Complaint: I divorced in XXXX. My ex husband was to retain the house and refinance by XX/XX/XXXX. Our original loan was with XXXX XXXX XXXX. He did not comply and did not refinance the house and remove my name from the note and mortgage. On XX/XX/XXXX he obtained a loan modification ( unbeknownst to me ) from American Home Mortgage Servicing Inc . Someone forged my name. I was never contacted by this company in regards to the loan. On XX/XX/XXXX XXXX XXXX XXXX XXXX assigned its Mortgage to XXXX XXXX XXXX. On XX/XX/XXXX my ex husband obtained a second loan modification with Homeward Residential Inc. Again someone forged my name. I was never contacted once by this company either. I have sought legal help several times before finding our about the forgeries to have my name removed from the note. On XX/XX/XXXX XXXX ex was found in contempt of court and order to refinance but fell gravely ill with XXXX and died in XXXX. On XX/XX/XXXX my attorney sent a letter to the mortgage company detailing what occurred and requested that my name be removed from the note. He did not receive a response. Because of this, I have never been able to purchase a home. Ive been told I may qualify in XXXX.

Consumer Complaint: I have had been sending half payments every two weeks {$320.00} and {$400.00} for about five months XXXX XX/XX/XXXX, XXXX XXXX called and told us not to send anymore partial payment. From now on to send full payment and that she would be sending back the {$320.00} dollars .Never got the {$320.00} back .So I called in to make full payment .They said, this account was not taking payments and was locked .Soon after that I got a letter from a lawyer, that there going to foreclose on my hose. They said I would a mod. loan in thirty days, and a case manager would, never called. I called that day, they said he was not able to talk .They put another appointment for XX/XX/XXXX to talk to me. I think their just killing time, days. To make me fall farther behind on my mortgage. I called them, where is the money, I have sent, they said that the money was set on another account because it was not a full payment, now they say that I need to send them {$4400.00} before XX/XX/2020 and that would put me back on track. Then I could make my regular payment.

Consumer Complaint: XXXX Mortgage has started to thereaten me with foreclosure of my home. They falsely claim that my mortgage payments have not been made, even though I have validated proof that those payments have been made through automatic withdrawals from my bank account. In my discussions with them over the past several months, they note that their records show payments received in the proper amount in the proper time. Lately, I've received letter noting a reversal of funds applied to my mortgage and a request for {$15000.00} payment. Along with the delinquency letter, it shows that my payments that I made starting in XX/XX/2019, were being reversed. To date, no one has been able to explain what " reversed '' means to me, and I continue to receive threatening foreclosure letters. The " so-called '' reversals are not credited to my bank account from which they were dispersed. I've never been late, nor have I ever paid less than the agreed upon amount.

Consumer Complaint: I am current up to the month of XX/XX/XXXX. I will pay XX/XX/XXXX in the next 10 days. I have late fees that are being added and credit report states very late but increasing payment to get it taken care of but the mortgage balance continues to increase. I will not live long enough to pay this note off. I am not paying XXXX cent on principal. They send someone to evaluate property every 3 months and its a fee, the fees and add ones are out of control. I am not allowed to pay extra on the principal. PHH is a scam and are continually taking advantage of the people that cant afford to fight them. They were busted in the XXXX and they had to pay is {$500.00}. Why wasnt the terms to undo the over charges adjusted and fixed. Why wasnt their errors repaid in full and not just a small amount to several cases. Why was GMAC MORTGAGE allowed to just rename to Ocwen and then when they were busted they changed the name to PHH. Why isnt the Federal Government closing them down and holding these servicing companies accountable? I read an article that the mortgage companies make more on over charges, unreasonable fees that its worth it to them to commit these acts and just pay a fine when they are found out and busted. I would like to see a outside audit company audit several accounts tax and see their computer programs are rigged. Please investigate and stop them for the turmoil and stress they are costing the mid to low class who just want to own a home for their family.. They refuse to take my ex-husband off the loan and have the divorce degree and a quit claim deed.

Second I sent a money gram well over my regular payment to make up two payment with more money not credit to account in XX/XX/XXXX they say they do not have it. XXXX XXXX said they do no response from them. Third I have sent this company XXXX in check free bill payment electronic and money not credit to account and no they want to take legal action. This is not right and can not talk to anyone but received letter from their attorney a week ago. They can return all my money in question and i will send an overnight cashier check if that is better but it's not fair i have to pay twice for money they already have need help. Consumer Complaint: XXXX XXXX, XXXX I was injured on the job and had XXXX on XX/XX/XXXX. I was out of work and my employer stop paying me for reporting the job related injury. I contacted PHH to mitigate and requested a loan modification in XXXX. I contacted HUD because PHH failed to mail application. I sent loan modification packet back with all information requested in the packet. 3 weeks later I recieved notice that the underwriter want my tax doc before modification would be process per PHH letter sent on XX/XX/XXXX. Tax docs sent and recieved before deadline of XX/XX/XXXX. Then I was informed by letter that the process was not complete but per there letter it should have been. Now PHH has refused to process or even assist during me during this process. I call can't get through case manager unavailable when u call to correspond. Scheduled call backs are not kept as promise. I requested for all communication to be sent by mail or email as that is my primary contact. Please be advised that I worked with a Housing Counselor in XXXX Of XXXX and PHH never responded to that request to modify the loan. This is now my third attempt to modify to keep my home as PHH is doing everything to make me homeless. Consumer Complaint: On XX/XX/2020 I called PHH mortgage company to discuss relief for monthly mortgage payments. I was immediately place in some kind of shady scam forbearance plan without my consent. I later learned that PHH forbearance plan and the Cares act forbearance plan are nothing alike. PHH mortgage company refuse to offer a forbearance plan in accordance with the Cares Act which offer 180 monthly mortgage payment relief and an additional 180 day relief if necessary. I want to exercise my rights to the benefits offered to me by the Cares Act.
