Consumer Complaint: 17 years ago I initiated a conventional mortgage with Libor interest rate. The Collector PHH Mortgage Services XXXX XXXX XXXX XXXX, Pa. XXXX XXXX Phone XXXX XXXX XXXX. Date of loan origination was XX/XX/2008 and the initial payment was XXXX. Now my payment is based on 8.2 % when the Libor is 5.44 %. My contention is that I have paid my loan for the 17 years without a late payment and they using the american rate of interest instead of the Libor. I am requesting they return my loan to the Libor rate instead of SOFR rate and refunding the resulting overcharges for the entire time of the increases.

Consumer Complaint: during the trial period they had me on I was told on several occasions. I was in good standing the representative XXXX XXXX they assigned me confirmed with me in XXXX XXXX XXXX that I was in good standing and did not need to send any more money, she also advised that she needed to send an email their cashier department to have the funds I had sent released and applied according. I took it upon myself to send in additional money to ensure all the transactions were good. Soon after this I received a certified letter from PHH advising I had short paid the modifications and yes that confused me being that I called each month during the trial and was told each time I was in good standing. To my surprise now I have to reapply for another trial period. Also they have sent me a copy of the last money order I sent them with a signature on the back of it which is not mine. per the letter / copy they sent me states this copy is legal tender I have taken the copy to a bank and to the XXXX office where I purchased it and was told/advised they could not do anything with the photocopy of the XXXX XXXX. i have called PHH on several occasions in attempt to get this solved. I am being taken full advantage of YES I do believe so.

Consumer Complaint: had 2 loans with wells fargo in XXXX, they had me make payments XXXX XXXX - then they said they never received the payments. they started foreclosure on my home and I secured a lawyer. eventually they said they would refinance with another company and I could start making payments again. which I did for several years and then wanted to refinance my loan and paid a appraisal fee just to find out some other company real time solutions has a interest or deed on my home so i couldn't refinance. Real time solutions wouldnt work with me to finance it all into one loan. they wanted me to pay a new balance which was like XXXX loan started at XXXX so now real time solutions bought my 2 nd mortgage for pennies on the dollar and is just waiting till I build enough value in home to take over my home

The amount totaling over {$35000.00} was awarded in XX/XX/XXXX, and paid to my mortgage company, PHH. They have yet to apply it to my mortgage balance. They have not processed any of the payment to my account, and are now trying to say that I am in arrears, & they are going to start foreclosure proceedings. I have called PHH relentlessly since XX/XX/XXXX trying to resolve this issue with them to no avail. As of today, XX/XX/XXXX, PHH Mortgage Company refuses to apply the XXXX award money to my account. So, essentially PHH Mortgage Company has stolen those federal/state funds from me and the federal/state government. And now they are trying to steal my home.

Consumer Complaint: We had a foreclosure sale dated XX/XX/XXXX. We filed a motion to extend the sale date and there was a Home ( XXXX XXXX XXXX ) meeting on XX/XX/XXXX and the judge agreed to extend the sale date to XX/XX/XXXX. On XX/XX/XXXX the judge signed the order to extend the sale date for 30 more days, and it was furnished to all parties thereafter. On XX/XX/XXXX a copy of the original short sale request was submitted a second time along with the judges order to extend the sale date. The bank later sent a letter to all parties advising us, that they had insufficient time to perform their review and therefore did not provide us with the short sale approval letter. The bank has been doing this for several years, whenever we sent documents that they requested they would wait until those documents expired and then send a new request. By doing this, we keep losing prospective buyers for the properties. This is so wrong. We are at the point where they are planning to foreclose on the property. Please advise.
