Consumer Complaint: My Loan # with PHH Mortgage is XXXX, I was approved for a Forbearance plan last year XX/XX/XXXX by PHH Mortgage, I was given 12 months in the Forbearance and after that the servicing company denied to give me any more extension on the same after XXXX of XXXX, I spoke with the investor of my mortgage which is XXXX XXXX to further investigate the matter as I have no job due to covid crisis, I was told by XXXX XXXX that I will be able to apply for another 6 months of Forbarence through my servicer which is PHH Mortgage as I have only completed 12 months and the forbarence plan can be given 18 months in total, I again called PHH Mortgage to request extension on my forbarence plan, but I was told that I am not eligible for any more extension on Forbarence Plan. I request you to look in to this and help me save my home.

Consumer Complaint: On XX/XX/XXXX, an application for a loan modification was submitted to XXXX and to the servicers law firm via email, with all requested supporting documentation attached. On XX/XX/XXXX, a letter was sent to my lawyer through my servicers lawyer saying that I needed to provide my most recent Tax Returns. On XXXX XXXX, I submitted those XXXX tax returns through my lawyers office who emailed them to XXXX and their counsel. A delivery receipt was obtained. My lawyer received an email from the servicers lawyer on XX/XX/XXXX, saying that they could not access what had been sent to another staff person at their firm and noted that the servicers notes indicated that the XXXX Tax Returns were still marked as missing. My lawyer responded promptly to the servicers firm, attaching the XXXX Tax Returns again and explaining that they had been submitted to the servicer well before the deadline, on XX/XX/XXXX. Today I received a letter from my servicer dated XX/XX/XXXX saying that the review of my loan modification application had been closed because they had not received the requested missing documentation. My lawyer disputed this with the law firm, and they told him since my tax returns were e-filed, the digital pin and verification signatures at the back of the returns were not acceptable. No one ever told me this. They just treated me like I didn't send them anything.

Consumer Complaint: I have been the victim of predatory lending. The original loan purchase was {$460000.00}. The loan was restructured in 2009 with two balloon payments. Now, after paying faithfully, no missed payments or refinanced payments, and 17 years later, my loan balance is {$500000.00}. The loan has been sold several times, all to lenders with predatory lending practices : XXXX, XXXX XXXX XXXX, Ocwen Loan and now PHH Mortgage. The interest rate was an adjustable rate and is at 5.25 %. I can't even refinance the loan as my monthly payment will go up due to these treacherous balloon payment. I'm asking that the lender forgive the balloon payments ( {$210000.00} ). My mortgage balance should rightfully be {$280000.00}. I was a single mother and could not fight this issue as I was trying to keep a roof over their head. I hope you can help me. I have every document from the inception of the loan. I just need help

Issue: Struggling to pay mortgage

Consumer Complaint: I fell behind after being misinformed when applying for my loan. I was misadvised that I'd be able to apply for a refinance shortly after receiving the loan so that my payment could be lowered which was not the case. Due to this misinformation, I took on more than I could afford to pay and once I fell behind it became a struggle to bring the loan current. I was also unemployed in 2018 which caused a further strain on my finances so I have been struggling for years at this point. I am now in the process of applying for a short sale and I have submitted the application documents but I need PHH to allow me at least 60 days to meet all of the requirements. I have a willing and able buyer ready to make an offer on the property. Can someone please help me reach out to PHH for assistance? I want to settle the loan so that I don't have to deal with the ramifications of a foreclosure auction on my credit since I have been working for the past 3 years to rebuild my finances and creditworthiness. I am raising a family and if the house gets foreclosed on that would devastate my family. Please help!

Consumer Complaint: I've always paid on time to my mortgage company who was XXXX XXXX. When C-19 hit, my income was reduced and I was struggling to make payments. On XX/XX/XXXX, XXXX from XXXX suggested that I go onto their forebearance plan and she explained that my account would not be reported to the credit bureaus and that I would resume making my monthly payments at the end of the time specified with no penalties, additional interest or late fees, but the principle amount unpaid during this time, would still be required and would be added to the back end of the mortgage, ( extend my original payment scheduled ). They then extended it for a 180 days on XX/XX/XXXX ( message below ) I was to start payments again on XX/XX/XXXX. In XXXX or XXXX, the loan was sold to PHH Mortgage. They reached out to confirm that the 1st payment would be on XX/XX/XXXX and I was given a new account number. A gentleman phoned me yesterday to confirm the beginning of the payment schedule again since it's in 1 month and then asked if I was going to pay all $ XXXX that was owed else it will go into foreclosure. I told him that I didn't understand what he was referring to and he said that I was responsible to pay everything at once unless I was not interested in keeping the property. He said that XXXX was incorrect. I don't understand. This is not what I was told by XXXX. If I wasn't able to pay my $ XXXX monthly morrtgage, how am I supposed to pay a $ XXXX fee all at once now? I don't have this kind of money and I don't want to lose my house.

Consumer Complaint: We received back information from CFPB today and the PHH mortgage attorney XXXX XXXX. Closed case # XXXX. Mr XXXX to be blunt is completely inaccurate in his response. XXXX sent us a letter of transferring our service to Ocwen dated XX/XX/XXXX. There is no wording on the letter about modification in XXXX as we did not apply for modification with XXXX in XXXX we applied with Ocwen who has lost the file. Funny Ocwen has a track record of losing files. We were not denied a modification in XXXX it was XXXX. Why would we be contacting XXXX XXXX looking for the original copy of the XXXX as this is what Ms XXXX and Mr XXXX said for us to produce. Please review the recordings of the phone calls I had with them.We would appreciate the attorney representing PHH Ocwen to be fair and honest. Regards, XXXX XXXX

Consumer Complaint: On XX/XX/XXXX I set out to catch and show PHH Mortgage Services in the fraud they committed to me when they staged a default to my home loan starting in XX/XX/XXXX and then illegally foreclosed on me and sold my home at auction later that following year in XX/XX/XXXX, simply by requesting the statements they have on file for me and my mortgage there at PHH from XX/XX/XXXX - current so that I can show not only have they committed fraud by trying to cover up the fraud they committed on me from XX/XX/XXXX - current ( covering up fraud is an act of fraud in itself ), but would have actually done so by having PHH submitting this fraud cover up straight through to the CFPB as I submitted this request through the complaint process and would have them no choice but respond and send back any statements sent back, sent through the CFPB portal as well. What I got back in response to my request ( attachment 1 ) is all together appalling, disgusting, and downright discriminatory towards me that they would try and make only me have to settle for these statements when no one else at all would put up with these statements they are trying to pass off as legitimate. Not only do these statements break numerous RESPA violations, as well as show on record PHH breaking Federal Law more than once and in more than one way ( dual tracking is breaking Federal Law, charging me the amount of escrow in the {$19000.00} overdraft PHH did to my checking account in XX/XX/XXXX is braking Federal Law ), but their own response also proves what I have been saying and submitting complaints to the CFPB all along, that PHH Mortgage Services messed up so bad when putting me into their fraud scheme that shows a revenue stream that they, as well as multiple entities, are participating in when they stage defaults and illegally foreclose and sell homeowners homes at auction, that the only way they could cover it up is by setting these hackers on me ( something I have sent numerous complaints to the CFPB on ) in effort to hinder my communication so that I am unable to get word out and expose their fraud. PHH Mortgage Services has violated my civil rights by preventing me from seeking and obtaining legal litigation against them for the fraud they did to me by having these hackers continuously remote in and intercept any communication through emails or other communicative methods I send out so that I can never get my day in court or justice for what they have done to me. If that werent enough. These hackers have actually came into my main XXXX email account I receive estatements on, set the time back to a certain date/time in the past, and then sent through statements they wanted to pull off as being the originals that were initially sent. The problem is, I already anticipated them doing this and planned well in advance by saving original statements and emails that I received from when I received the original statements, snapshots of how it initially looked to use as proof if anything at some point was changed, and numerous source docs, notices, etc. all to show as proof as to what originally happened to my mortgage account in case they try to cover up their fraud at any point, which they did, and try and pull off a set of statements that contradicts anything but the truth. The kicker is, I didnt even need to do all that. Looking over these statements, this has got to be the sloppiest, most unbelievable, full of errors, way of covering up fraud ever and yet, they not only didnt cover it up to begin with ( Look at XX/XX/XXXX statement to see still is record of {$19000.00} overdraft PHH colluded with my bank, XXXX XXXX XXXX, to overdraft my account by $ XXXX that was then used as basis to strip my equity ), they missed some what they should have tried to cover up altogether ( misapplied trial period payments on XXXX, XXXX, XX/XX/XXXX statements ). PHH has added statements that were not there to begin with or were not sent to me initially since these months were missing with reason ( XXXX XXXX for instance when I was supposed to be off the books and out the door with auctioning of my house taking place a month prior but luckily pulled off the unthinkable where PHH was made to pull back and rescind the sale putting my mortgage back where rightfully belongs, in my hands ) as well has some months without details on statements ( RESPA violation ), followed by others that do, and then back to non detailed ones. These fraudulent statements that they have added after the fact, are so easy to pick out from the originals, its an absolute insult they would try and pass off these as original and even make me accept what no one in their right mind would. You dont even need to look at the actual statements! Just go to emails they sent the statements in to find the ones that no longer say were sent by PHH and look for when switched to say are now coming from XXXX XXXX, a company they supposedly tried to say I was transferred to during their big transfer of mortgage accounts that took place in XXXX XXXX ( snapshot of each included to see the difference ). Truth be told, I was never part of any transfer and PHH literally broke all RESPA transfer rules when they basically tossed me off to XXXX in late XXXX, well passed their date of big transfer of mortgage accounts. No matter what though, whether you believe their set of statements or what I have that are the actual originals to what happened to my account during this time that not only shows the fraud done to me but exposes their whole scheme as well as the method they are using to fool homeowners into accepting the default to their home loan as their own fault when it was all staged to begin with, there is something their statements dont have and can not hide from or even explain. The actual notices of sales I had to go through that shows the dates my house was put up to be sold at auction in XX/XX/XXXX, XXXX XXXX, and XXXX XXXX. All of these are attached and before I move forward, I want these officially documented and sent through the CFPB as proof that PHH is fraudulent and anything they put forth and send through to the CFPB on my account in the form of statements, notices, or any other source documents is fraudulent as well. Their statements dont show the truth because if they did they would account for the 3 auctions listed on the 3 attached notices of sales for my house that are attached. Simple as that.

Consumer Complaint: Payments mysteriously disappear after funds are cleared. Inaccurate accounting, misappropriation of funds. Unjustified foreclosure proceedings, the list is endless, if it has a legal definition PHH will break it. but currently I cant even find out who if anyone holds a mortgage on my property or who is my servicer. PHH is actually three companies, PHH Mortgage, XXXX XXXX and XXXX XXXX Mortgage. XXXX claimed that they transferred my loan to XXXX XXXX, but there was never any documentation filed with the county. Whenever I ATTEMPT to contact XXXX XXXX, PHH answers. They say they can not help me because they are a separate company from XXXX XXXX. Why is PHH answering XXXX XXXX phones if they are a different company? PHH has been a complete nightmare for the entire time Ive been with them since 2003, They have done everything possible to steal my house. Please do something about PHH Mortgage and its fraudulent shell companies. I dont expect you to actually help me because no one does but if you could possibly save someone else from this XXXX show the world might be a little better place. XXXX XXXX
