Consumer Complaint: I was behind with my mortgage payments and applied for a modification. XXXX/PHH Mortgage XXXX offered a modification plan with a trial period. I never received the modification offer, but I made each of the 3 trial payments as scheduled. When I asked a acct specialist about the details of the modification, they responded by telling me I should have recieved it after I completed the trial payments, which I had not. The acct specialist also relayed to me that my other option was to get on a payment plan, which would require {$3000.00} down and an additional monthly payment of {$940.00} for 5mos, and my decision should be made by XX/XX/XXXX. I received the modification on Saturday XX/XX/XXXX. On Monday XX/XX/XXXX I called and spoke with agent ID XXXX @ XXXX to inform the mortage company that I will not be accepting the modification because it would be adding over {$55000.00} to the end of my balloon payment at the end in XXXX. Instead, I decided to get on the repayment plan, and pay the down payment of {$3000.00} and the additional {$940.00} for 5mos. He was not able to set up the payment plan because they have the modification on my file. I called today XX/XX/XXXX and the acct specialist -agent ID XXXX was still unable to set up the payment plan because the modification is still on the account, and said that underwritting has to remove the modification before the payment plan can be set up. I tried to make a {$4000.00} payment today ( XX/XX/XXXX ) via phone and online, and it will not allow me to make any type of payment. I am concern with my home being forclosed upon because of lack of assistance and delay in trying to set up this payment plan. It seems a bit supicious that I can't set up this payment plan which is one of the options available to me according to their acct specialist. I just want to enter into this payment plan and secure my home.

Consumer Complaint: A wire was sent to PHH mortgage company on XXXX to pay the loan balance off in full. The wire amount was for XXXX. I've been calling PHH and emailing them since XXXX trying to find out why the funds have not been applied to the loan balance, and why the loan has not been paid off in full. I'm getting no where with PHH, and their representatives can't even tell me if they received the XXXX. As of XXXX PHH is stating that my mortgage is now 5 days past due. I can't get them to fix this problem, find the wire that was sent to them, and apply it to the loan to be paid off. Please help with this matter as this is now adversely affecting my credit. Thank you.

I have informed Mr.XXXX that I did not want to communicate by email.We have asked for communication by phone and now we are been ghosted. Mr.XXXX got information from us that Ocwen charged us fees each month to pay our mortgage over the phone.I also let them know that the state of Maryland was investigating them for this as it was illegal. Mr.XXXX when he did replay he said that we did pay the fees but it was only twice in 2013. This is incorrect we were charged the fees each month we paid over the phone. I informed MrXXXX that the company that they used for their customer service was not licensed in the state of Maryland we got no response. Ocwen customer service is the only live phone line you can reach. The customer service were the ones that told us your account went to collections and here is their name and phone number and Ocwen has no ownership of the matter anymore. I have sent emails to Ocwen ombudsman in the last few weeks and all I have gotten back are letters we will review and get back to you. Ocwen has never gotten back with us and they will not be Mr.Messingers words. I would like all of the above addressed by Ocwen over the phone. I have reached out to many people at Ocwen and XXXX XXXX XXXX over the last few weeks as I don't feel people are been honest with us. Respectfully, XXXX XXXX

Consumer Complaint: After the transfer of my mortgage loan servicing to PHH Mortgage, I discovered when attempting to schedule my third payment online, that they charge an " up to {$7.00} '' fee for online payments if not enrolled in paperless statements. This fee appeared in the mobile application as an " Included draft fee ''. There is a link in fine print to view the fee schedule, but the new fee was a surprise when I logged in to make a payment. Although PHH Mortgage offers cheaper payment methods, charging up to {$2700.00} over the course of a 30 year loan for electronic payments is ridiculous, particularly when electronic payments are regularly accepted online at no cost for consumer loans and mortgages. Electronic payments are certainly cheaper to process than other payment methods, such as checks ( accepted with no fee ), so an argument that the fee offsets the actual cost incurred by the mortgage loan servicer does not ring true. Fortunately, I was not in a position to need to expeditiously schedule my mortgage payment to avoid a fee, since changing my statement delivery method to avoid the fee takes three business days.

Consumer Complaint: I am XXXX XXXX and Im submitting this complaint myself and there is no third party involved. PHH Mortgage has committed numerous violations pursuant to federal law against me ; below are some of the violations such as 15 USC 1605 : I am being charged an APR, home insurance, I was charged a down payment and had to pay taxes and fees all which should have been included in the finance charge. I was not advised of my right to rescind- 15 USC 1635. They have committed four counts of 18 USC 1028A. 15 USC 1692e they have presented false statements, forms and contracts in an attempt to collect an alleged debt. They have violated 12 USC 1831n ( a ) ( 2 ) ( A ). They have continuously violated 18 USC 1341 by sending statements every month stating that I owe for an alleged debt. PHH mortgage has attempted to make me believe that they loan me credit which they are not able to do and according to 12 USC 1431 they are in fact the borrower not me as they have not loaned me anything also the alleged debt is not my obligation according to 18 USC 8. 15 USC 1602g informs me that I am the original creditor not PHH Mortgage. The alleged debt has been furnished on my credit report which is a violation of 15 USC 1692b ( 2 ).

The have acknowledged this on several occassions.All Correspondence has been Certified and return receipt, PHH received these letters and I sent a backup To The New Jersey Sheriff in XXXX County as witness to that facts over 10 to each one. Every month they send a bill with an attachment stating Failure to pay will result in fees and foreclosure and loss of my home. Original loan started XX/XX/XXXX with GMAC Mortgage sold to Ocwen loan Services around XXXX or XXXX XXXX Sold to PHH Mortgage a of Ocwen XXXXPHH Mortgage. Interest Only 15 years Original amount {$260000.00}, now amount is {$280000.00} Monthly payment {$780.00} now changed to {$2800.00} XXXXAlso sent an Estoppel Letter and a No trespass letter like I mentioned all return receipt requested. Sent to credit bureau a dispute that this company not a part of original contract. They show on it contract is cancelled. Fair Credit 805 ( b ) 2 805 of Code of Civil Procedure for California enacts additional limits and collecting on tim barred debts. The new law 2013 Act California Debt Buying Practices Act.
