Consumer Complaint: ive tried to contact the original company that did the modification and they are no longer in business to see why they added XXXX to my loan balance instead of putting that amount at the end of the loan. homeward/american home mort serv did the modification and they paper work show XXXX was being deferred to the end of the loan but that amount was added. ive called phh several times trying to understand why the amount was added and they keep giving me someone from another country and i dont understand them. they were showing XXXX different balances on my credit report and finally they fixed my cbr to show one mortgage. i dont understand how the balance keeps increasing and not decreasing. if im reaching out to the wrong agency can you please direct me to the correct agency to assist me. this is my second email asking for help to fix this loan. im not able to do a refi because of the loan amount. ive been in this home for 17 yrs and balance is increasing and i make my payment on time. ive been on the foreberance plan twice and they are adding that amount to the end of my loan so why wasnt the modification amount added to the end of the loan. im enclosing my original deed to show when i purchased the home and its not the month and year phh has on file ..the countXXXX i live is showing XX/XX/2006 so something is clearly not correct with this loan.

Consumer Complaint: My XXXX settled discharged mortgage is illegally in the hands of PHH and or XXXX Mortgage XXXX. I requested a complete transaction history, itemized pay-off. I also requested information all the many years there was no communication from this mortgage servicer. I want to see their records to see if it matches my records. I want to see the history for any discharges, charge/write-offs from previous servicers. I believe this company is following illegal processes. They seem to be disguised under several different names such as ( XXXX XXXX ) XXXX, PHH and XXXX. They all seem to be one in the same. I have also been advised to reach out to the Attorney General to have him/her investigate the practices of this company. They are illegally attempting to collect on a mortgage debt that has already been settled with another servicer. I believe these illegal practices and needs to be investigated.

Consumer Complaint: I'm a first-time home buyer this year. I discovered PHH Mortgage used my escrow account to pay someone else 's property taxes for XXXX, instead of mine. I contacted PHH on XXXX. The customer service agent said she would submit an inquiry to their tax department. I never heard anything. I called back a week later on XX/XX/XXXX, and no one knew what I was talking about, it was as if I'd never called them. I asked to speak to an escalation manager named XXXX. She assured me she'd get the correction process in motion. Didn't hear anything back. I called her extension on XX/XX/XXXX and also XX/XX/XXXX, but her mail box was full. On XX/XX/XXXX I asked to speak to a different escalation manager named XXXX. I explained everything yet again, from the beginning. He promised I would hear from him on XX/XX/XXXX, which I never did. On XX/XX/XXXX, I called my contact at XXXX XXXX XXXX, I had given to PHH, to see had they heard from PHH? Nothing! The tax office had still never been contacted by PHH. This is gross financial negligence of my escrow account. They have given my money to someone else, a stranger, in error, and have no sense of urgency about correcting it. My taxes were due in XXXX, yet are left unpaid! PHH has known about this now for 13 business days and done nothing!

PHH Mortgage wrote me a letter XXXX XXXX to me and said the same thing. PHH Mortgage sent a piece of paper to Oregon Forclosure XXXX XXXX and it stated that XXXX XXXX still owes it. Consumer Complaint: I purchased my home in XX/XX/XXXX. XXXX Mortgage purchased my loan in XX/XX/XXXX. I contacted PHH immediately to advise that my ESCROW account was incorrect. The prior mortgage company sent PHH a check for my escrow. After several calls to PHH, I was notified in XX/XX/XXXX that after their analysis I had a surplus of a little more than {$2300.00} and they were issuing me a refund check. The notification also indicated my new payment to include the escrow. Fast forward to XX/XX/XXXX, I received my tax statement and notified PHH that there wasnt enough money in my escrow to cover the taxes and requested they research what happened when they acquired my load. I was informed that PHH would ensure my taxes were paid. However, I still needed to understand what happened that my escrow was off over {$4500.00}. On XX/XX/XXXX, I checked my account and discovered a notice uploaded to my documents stating that my taxes had been paid and that my escrow account is short {$4400.00} of which I am responsible for paying back over the next 36 months. My new payment amount will increase {$460.00} due to PHHs error. On XX/XX/XXXX, I finally received the documents I had been requested to determine where the error occurred. The tax certificate PHH received clearly shows that my taxes should have been for {$6500.00} and not the {$2800.00} they projected for my escrow. I have called the escalation team multiple times and spoken to agents that a rude, try to speak over me and only tell me information I already know. When I asked to speak with a supervisor, I was advised that someone would call me back in two business days. Once, again I am asked to wait for a call, when no one has been able to assist me in weeks. No one attempted to contact me to discuss or explain what happened and what options I had to resolve this issue. I need help trying to resolve this issue as I now have an increased mortgage payment of almost {$500.00}.

Consumer Complaint: I initially took out a mortgage on XX/XX/XXXX with Fremont Mortgage In California. It was then transferred to Litton Loan Service where I had a loan modification. It was then transferred to Ocwen Loan Services XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Fl XXXX ; XXXX or XXXX in XX/XX/XXXX. I took out another loan modification with Ocwen in XX/XX/XXXX. The agreement showed that once the total of {$58000.00} would be removed three ( 3 ) in XXXX ; XXXX & XXXX as long as I made my payments on time which I did & was never late. Fremont Mortgage initially had two ( 2 ) loans on the property through Litton Loan Service LLC then Ocwen XXXX. It was paid off while with Ocwen. Ocwen failed to apply my payments for two months & held it in a suspense account. After writing letters to Ocwen & filing several complaints, Ocwen corrected the account & applied the three deferments to the account. After Ocwen got in trouble with the government, the mortgage portion of their business was transferred to PHH Mortgage XXXX XXXX XXXX, XXXX NJ XXXX ; XXXX AN XXXX who failed to maintain accurate records with the correct Principal balance & Original Amount. ( Amount on record is {$310000.00} in XXXX XXXXthe original amount & not the amount of the loan modification with Ocwen Loan Servicing LLC in XXXX resulting in overcharges ) and then transferred the inaccurate record to XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX PA XXXX ; NewRez.com ; XXXX. It showed that my mortgage was {$310000.00} instead of the Loan Modification amount of {$220000.00}. It shows the wrong principal bal. In XXXX the balance was {$64000.00}. Im mot getting credit for my payments. The records are showing a Negative Amortization. In addition, I charged {$20.00} late fee & I have until the 16th of the month before being accessed late fees. Consumer Complaint: On XX/XX/2021, XXXX XXXX XXXXXXXX, caused to file a foreclosure action alleging a breach of contract under the terms of the loan modification. Under Florida law, a loan modification is a novation to the original loan contract ... .see Florida case law XXXX XXXX XXXX XXXX XXXXXXXX XXXX XXXX When a debtor engages in a loan modification, the loan amount increases therefore the lender must pay the imposed intangible & stamps pursuant to Florida statute 201.08 ( 1 ) ( b ), 199.282 ( 4 ). For further clarity see Florida caselaw XXXXXXXX XXXX XXXXXXXX. A lender or financial institution does not have any enforceability in this state until the taxes imposed by the state are paid in full. You caused to file a foreclosure action yet you do not have any enforceability therefore you must dismiss the action. The loan modification agreement can not be recorded because it was not notarized. XXXX County recorder office will not record an instrument that is not original nor notarized. A closer look at the loan modification agreement reveals it does not reflect the property legal description. See Florida Caselaw Fed. XXXX XXXX v XXXX XXXX, judgment can't ever be entered until the legal description has been corrected. The loan modification must be amended to included the legal description. In the event the issue can not be resolve the courts have no choice than to dismiss the case. The fact that you have failed to record the instrument and pay the taxes imposed by the state warrants an investigation into your organization as the matter may be construed as tax evasion. What is tax evasion? " The illegal nonpayment of tax ''. " An illegal attempt to defeat the imposition of taxes by individuals, corporations, trust, and others. This matter is being investigated by the Florida Department of Revenue and the Department of Treasury. There are millions in loan modifications where financial institutions are collecting payment yet have not paid a dime to the State.
