Consumer Complaint: I informed my mortgage or loan servicer PHH that I was the successor in interest due to divorce. I requested to assume the loan on more than 1 occassion. I just sent a letter again to them that I request the same thing once again. The letter was faxed to their escalation 's department/ research dept on XX/XX/XXXX. I am attempting to avoid foreclosure by requesting " successor in interest to assume the loan once again due to divorce ''. The former spouse states via email and in open state courts he wants nothing but to be released from the loan. So with his requests this substantiates my successor in interest to the mortgage to remove him from the loan. PHH already has the divorce decree. Divorce happened in XXXX. The co borrower has not paid on the mortgage since XXXX. Once assumption is approved I can then modify the loan in which to bring my loan current. I will attach the " successor in interest rules and laws '', as well as caselaw that states that once a party claims he or she is successor in interest to a mortgagee due to divorce and the home is located in Georgia, that all one of the party 's has to do is to inform the mortgage company that they are assuming the loan and to remove the other party from the loan. Again my former spouses emails states he wants nothing to do with the loan. He wants his name removed from the loan.

Consumer Complaint: Good Afternoon, I changed my flood insurance. The mortgage company ( PHH Mortgage ) paid on my new policy and my old policy even though the old policy was cancelled and did not request any money. The mortgage company shared they were trying to be proactive in making this unsolicited payment for {$3000.00}. The old flood insurance company confirmed they had not received a check and, even if they did they would send it back to the mortgage company as they no longer have an active account with me. The mortgage company is advising the check will be refunded to me from the cancelled insurance broker and i need to supplement the escrow account by {$3000.00}. I do not understand why this uncashed check can not be cancelled and the funds returned to my escrow account. At this time I've lost {$3000.00} and have been asked to pay an additional {$3000.00}. I feel discriminated against as a single woman / mother where i am being victimized into paying twice by this company. All guidance and help in addressing this issue is very appreciated. I recently learned about the lawsuit filed against OCWEN mortgage company and some of those reasons align with the reason we lost our home to foreclosure. OCWEN was misleading and dishonest about our interest rate, deceitful about foreclosure alternatives and improperly denied us loan modifications, charging unauthorized fees for default-related services all of which resulted in foreclosure. We were not treated fairly or given proper information. They put no effort into helping us keep our home, therefore we felt forced to choose foreclosure.

Consumer Complaint: I am trying to pay off my second mortgage. Though my payments were construed as a 30 year mortgage, I actually signed a 15 year mortgage for {$33000.00} at 13.5 %. After 15 years of paying XXXX my payments were refused by PHH Mortgage servicing and I was offered a loan modification agreement. I agreed to the loan modification and made the payments. In the last 6 months I have sent the company over {$30000.00} in attempt to pay it off. Held in a suspense account is {$28000.00} since XX/XX/2022. In XXXX I received documentation that stated pay off amount XXXX. On XX/XX/2022 held in suspense was {$28000.00}. I wired the remaining balance of {$1900.00} on XX/XX/XXXX in excess of the difference of {$1900.00}. On XX/XX/XXXX PHH reversed the amount back to my bank account and stated they will only take certified bank checks, though the payoff statement indicated wire was preferred. I mailed {$2000.00} which takes more than a week PHH recieved on XX/XX/XXXX and which was applied in a divided 6 payments rather than to the suspense account amount for pay off. They continue to charge interest though they will not apply {$28000.00}. This is predatory by definition.

Consumer Complaint: On XX/XX/2022 I received the attached notice from PHH MORTGAGE SERVICES regarding a supposed error the company made in adjusting my rate on an existing reverse mortgage I have with the company. The letter states that I was notified of a change in the rate on my XXXX Statement but the company in doing a review of my account they realized that the increase had NOT be applied back in XX/XX/2022 when it was supposed to have been done. They now state that they will retroactively apply the rate increase from XXXX balances. I find it odd that since I had filed a previous complaint with the company back in XXXX that they would just happen to be reviewing my account. But I am also wondering can the company make changes to my interest rate RETROACTIVELY and then adjust it on the current statement moving forward? I would also like a description of how they arrived at the new interest rate. I have attached the notice they sent me as further explanation of this issue.

Consumer Complaint: My mortgage company failed to pay my tax bill on time and now there is a hefty late fee. My mortgage has an escrow account for my homeowners insurance and my taxes. I called to notify them several times last year. Called the town to notify them. They have failed to pay the late fee they incurred. My mortgage payments are auto drafted. Zero reason for any late payments. That fee has now carried over into my XXXX taxes due XX/XX/XXXX. I will not pay ANY late fees because they didnt submit payment in time. Now theyre trying to raise my mortgage payment to offset the late fees. This is insane. My escrow balance to date is {$880.00} my spring taxes are only {$470.00}. The delinquent tax is {$100.00} plus a penalty is {$10.00} Carried over from last year. So how is it monthly I contribute {$370.00} into my escrow account that covers my homeowners insurance and my taxes for the year. My homeowners policy is {$2600.00} for the year or {$210.00}. My property taxes are {$940.00} Total yearly liability of {$3500.00}. Now if my total liability is {$3500.00} and PPH is taking out $ XXXX {$4400.00} how in the heck do I owe anything? That would be because they made my tax payment late. I called and nothing was resolved. I have since called again this morning. Of which they wanted to send me to voicemail again. I said no I want a supervisor. Which now leads me to waiting again to see if they fix their mistake without trying to charge me for their mess up.

Consumer Complaint: My mortgage was transfered from XXXX to PHH Mortgage in XX/XX/2022. I received my first stmt on XX/XX/XXXX with an additional charge of {$30.00} for a " pay off '' quote fee. Well, i never requested a pay off quote and i never consented to being charge a payoff quote to transfer my mortgage to another servicer. I contacted PHH customer care about this charge and was told i had to pay it as part of the mortgage transfer. This is STUPIDLY INSANE!! Why would i be responsible for the cost of PHH business operations??? My monthly payment with XXXX was {$3800.00} and that contractual amount MUST be the same with this crazy PHH Mortgage servicing company. I will not pay any charges and any negative reporting on my credit will be met with swift litigation on this absurdity of a company.
