Issue: Dealing with your lender or servicer

Subissue: Problem with customer service

Consumer Complaint: My Chapter XXXX ( originally a Chapter XXXX but later converted ) was discharged on XX/XX/2018 ( see attached Bankruptcy Court Order of Discharge ). I am still unable to view my student loan accounts online through Nelnet 's website. I keep getting a message saying because of the status of my account to call their customer service number. I have and they keep telling me their bankruptcy department is not going to do anything about it. If CFPB is unable to resolve this issue, I will file formal to the US Department of Education through my Congressman 's Office.

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: I have been trying for almost 2 months to get information from my student loan servicer about the terms and conditions of my student loans. they have at various points said they would send it then didn't, said it doesn't exist, said they have it but can not send it to me, said they have it but are not obligated to share it. I would like a copy of the full terms and conditions of my loan agreement. I've never had an issue with any other lenders I worked with on any type of loan to get a copy of the full terms and conditions of a loan. I've never seen a contract that was enforceable with only one or two pages of a multi-page contract but that is what XXXX keeps saying is the case. I am asking for what I have been asking for during this entire issue, a copy of the full terms and conditions of my loans.

Issue: Attempts to collect debt not owed

Subissue: Debt was result of identity theft

Consumer Complaint: Nelnet Loan Services is continue to report false information on my credit report. Nelnet is not original creditor. I never sign contract with Nelnet. Nelnet can not prove that it my debt. Nelnet claim that I owe {$23000.00}. Where is the original promissory note that I sign for {$23000.00}. What the name and address of original creditor? Who the person who approve this promissory note? When was first payment made on this account? When was last payment for this account? It seem like Nelnet try to use false deceptive, or misleading representation in connection with the debt collection. I feel that it not right to try discriminate on me because I am XXXX male. I am requesting that Consumer Financial Protection Bureau does investigation on Nelnet trying take advantage of minority. I will like someone from Consumer Financial Protection Bureau to meeting next month XX/XX/2019 in XXXX with Nelnet Loan Services, myself and document expect to look at promise note.

Issue: Dealing with your lender or servicer

Subissue: Problem with customer service

Consumer Complaint: Nelnet ( XXXX ) continues to call my mobile phone from an autodialer, despite my repeated requests to be removed from the autodialer. I have informed them that they are calling a mobile phone, and that I want to be removed from the autodialer, and to not call during my working hours ( XXXX PST ). They continue to have me on an autodialer, calling during my working hours, and lied to me today saying despite my request to not be autodialed, that they had the right to continue to do so. They have called at least 6 times since my initial request.. about once per week. When I reminded them of the TCPA regulations, they told me those weren't real, and if my account was delinquent, they can autodial me. I informed them that they may only HAND DIAL my mobile phone number once I inform them they are calling a mobile and request to be removed, they must comply. The man continued to argue that I was incorrect. I used to XXXX XXXX XXXX XXXX, I am quite well versed on TCPA regulations.

Issue: Struggling to repay your loan

Subissue: Can't get other flexible options for repaying your loan

Consumer Complaint: I became XXXX in 2013. I have not worked in the field that I went to this school for. I am currently waiting on my XXXX which will take another 7 months before I know anything. I am working with an attorney and also some of the schools cost for XXXX XXXX was unfairly charged. The cost of the online course that I took was over {$30000.00}. It is a total rip off and I was unaware of the total cost. The way they had everything set up was unethical. I have been fighting to get these student loans for this online course off of my credit for years and they just keep deferring it and charging more interest to the loans. I didnt even know that I had many different loans. I was never informed of this and thought that I had one loan out for the entire course which normally cost around $ 6-8,000 and not over {$30000.00}. This is insane.

Issue: Struggling to repay your loan

Subissue: Can't temporarily delay making payments

Consumer Complaint: I currently called XXXX on XX/XX/18 and XX/XX/18, to try and get a forbearance for my loans because I became unemployed and they are absolutely no help. They told me that I only get 2 month increments on my loan for a forbearance and then I have to pay for 9 months in order to get another forbearance. They do not assist their customers in their time of need. I have always paid and just can not make a payment while receiving unemployment, paying rent, food and utilities. I am a single mother with a XXXX year old. Someone needs to look into their lending practices because they are horrible.

Issue: Incorrect information on your report

Subissue: Account information incorrect

Consumer Complaint: XXXX and Department of Education/Nelnet and Nelnet Loan Services is reporting accounts that are not mine. I have disputed with them before but they produce no evidence to show me that these indeed are my accounts. They are speculating and putting " updated, '' and " remains. '' None of which show me how exactly they verified any of the inaccurate accounts on my file. The reports they send back provide no evidence of verification. It just says the exact same thing from the previous credit report.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: For years I have been trying to get NELNET to apply additional payments. Recently I resorted to sending the additional payment in seperately and denoting on the check that the payment is to go towards the principal. They continue to refuse to post the payment towards the principal.

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: After sending the last complaint Nelnet has unlocked my account so that I can view it. It stated that I was in forbearance. That status has now been changed to repayment. Today I spoke with someone in Nelnet 's customer service department. She isn't sure why I was given incorrect information concerning my Public Service Loan Forgiveness. I asked why my loans were placed in forbearance and she indicated that happens automatically when I am in bankruptcy. I was never given this information prior to today. She said that I am in a graduated plan, which is still the wrong plan. But the payment with this plan has never changed. The payment is supposed to increase every couple of years. She suggested that I consolidate my loans, which I thought I already did, and begin the income driven repayment plan again. I have currently been making approximately the same payment since XX/XX/2003. Something can't be right with this. I'm not sure how to proceed from this point. I honestly get different information from everyone I speak to and no one cares. The girl last week at Nelnet told me my payment would be around {$800.00}. a month on the income based plan, today the representative said she couldn't possible know that. So who do I trust and how do I correct this situation?

Issue: Attempts to collect debt not owed

Subissue: Debt was result of identity theft

Consumer Complaint: According to the Fair Credit Reporting Act, you are required by federal law to verify - through the physical verification of the original signed consumer contract - any and all accounts you post on a credit report. Otherwise, anyone paying for your reporting services could fax, mail or email in a fraudulent account. I demand to see the Verifiable Proof ( an original Consumer Contract with my Signature on it ) you have on file of the accounts listed below. Your failure to positively verify these accounts has hurt my ability to obtain credit. Under the FCRA, unverified accounts must be removed and if you are unable to provide me a copy of verifiable proof, you must remove the accounts.
