Consumer Complaint: XXXX continues to email and call about a debt they CAN NOT collect. This is causing me so much stress. The Department of Education transferred the loan to XXXX to service therefore they are NOT the original holder in due course and can not collect. 3-203. TRANSFER OF INSTRUMENT ; RIGHTS ACQUIRED BY TRANSFER. Primary tabs ( a ) An instrument is transferred when it is delivered by a person other than its issuer for the purpose of giving to the person receiving delivery the right to enforce the instrument. ( b ) Transfer of an instrument, whether or not the transfer is a negotiation, vests in the transferee any right of the transferor to enforce the instrument, including any right as a holder in due course, but the transferee can not acquire rights of a holder in due course by a transfer, directly or indirectly, from a holder in due course if the transferee engaged in fraud or illegality affecting the instrument. ( c ) Unless otherwise agreed, if an instrument is transferred for value and the transferee does not become a holder because of lack of indorsement by the transferor, the transferee has a specifically enforceable right to the unqualified indorsement of the transferor, but negotiation of the instrument does not occur until the indorsement is made. Consumer Complaint: On XX/XX/2023, I received an email from my bank notifying me that my credit score has changed. When I checked I saw that my student loan servicer Nelnet raised my credit limit from {$2700.00} to {$7300.00}. I was never applied for any credit through Nelnet let alone asked for a credit limit raise. I tried sending them an email from their contact page on the same day and waited five business days for a response. I checked my inbox and spam but did not see anything from them. I also searched my Nelnet account and could not find anything about a line of credit nor anything about Nelnet offering credit. Today, XX/XX/2023, I tried calling their number ( XXXX ) XXXX a few times and each time, it never connects. I sent a second email form today but I don't believe they will respond.

Consumer Complaint: On XX/XX/, I contacted Federal Student Aid and logged a complaint that my student loan has been forgiven through borrower defense however it is still showing a full balance on my credit report. Additionally, my account was never transferred from Federal Loan Servicing to Nelnet and I wanted to know about the finalization of my loan being forgiven and if applicable, any refunds that I am to receive. On XX/XX/2023, I received a reply from a representative of Nelnet, XXXX XXXX, that my request is being reviewed. I was informed to allow up to 30 days for it to be reviewed and if I have not received notification of review after 20 business days that I may check the status by replying to the e-mail. On XX/XX/2023, I have not received any updates from Nelnet in regards to my account and contacted XXXX via the e-mail originally sent to me as requested to inquire about my credit report, refunds, and account. On XX/XX/2023, I reached out again after not receiving a reply from Nelnet. I informed Nelnet that I have passed the 30 day period within the guidelines of Reg V for the fair credit reporting act and would like to at least know an update on my credit report since I believe Nelnet has violated Reg V guidelines. I am still waiting for a reply from Nelnet and therefore reaching out to CFPB for help.

Consumer Complaint: I have contacted the Servicer multiple times in an attempt to correct my credit reporting information. I even had a conversation with the loan guarantor along with a member from the escalations team of the servicer. The guarantor explained to the servicer that the loan should have been granted coverage under the CARES Act based on the updated information shared in XXXX of XXXX ( Link below ) XXXX XXXX XXXXXXXX To which the servicers said they ( Nelnet representatives ) have nothing that states that information and they ( Nelnet Servicer ) didn't make any error on placing the loan in default. Given the guarantor is going to following the XXXX XXXX XXXX guidelines provided for the Department of Education, the request was to correct the credit reporting as it is negatively affecting borrowers until it gets corrected with the XXXX XXXX XXXX. I am sure there are other borrowers who will have a similar impact and this should be investigated.

Family Educational Rights and Privacy Act ( FERPA ) The Family Educational Rights and Privacy Act ( FERPA ) is a federal law enacted in 1974 that protects the privacy of student education records. FERPA applies to any public or private elementary, secondary, or post-secondary school. 20 USC 1232g ( b ) According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' XXXX and XXXX are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states '' It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information.is a financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates.the financial institution and the Consumer reporting agencies XXXX and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, XXXXwhether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option.they Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX and XXXX are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services. Consumer Complaint: I was alerted that Nelnet was now collecting debt that they had attributed to me. They gave me an account number, and sent a list of alleged debts, about 10 various accounts. I did not recognize the individual accounts and numbers owed, and was confused by what they were sending me, why I owed it, who I owed it to, as of when, etc. I reached out twice via email requesting Debt Validation, promissory notes, etc. Anything to validate these numbers, and ensure it's debt I actually owe. They did not answer or reference my request, yet continued to send me correspondence. Clearly my request was being ignored. I then called on the phone, and the representative at Nelnet told me, verbatim, " We do not have any Promissory Notes, or Debt Validation records of any kind. We can not provide you with a Debt Validation Letter. '' This raised considerable alarm. Am I expected to pay any number they come up with? With no documentation of any kind?
