Consumer Complaint: Navy Federal Credit Union, started reporting late payments XXXX. Amount {$6100.00}, " According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumer 's right to privacy. '' XXXX and XXXX are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states '' It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers ' nonpublic personal information. '' ( Furnisher of information to credit agencies ) is a financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' ( Furnisher of information to credit agencies ) the financial institution and the Consumer reporting agencies XXXX and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, XXXX, ( Furnisher of information to credit agencies ) whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' ( Furnisher of information to credit agencies ) Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than XXXX years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s-2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. '' XXXX and XXXX are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that '' A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services. Consumer Complaint: On Tuesday, XX/XX/XXXX at XXXX, I deposited a cashiers check into my checking account at Navy Federal Credit Union inside the Branch office with a bank teller. At the time of deposit, I was informed the funds would be available on Thursday XX/XX/XXXX. At XXXX Wednesday XX/XX/XXXX, I received a message from the bank that my funds were now being held for 5 business days because there was reason to believe my cashiers check from XXXX XXXX XXXX would not be paid due to confidential information. I called the customer service line to try to resolve the issue. I was informed that the reason why my check was placed on an extended hold was because XXXX XXXX XXXX would not verify the check over the phone. On Thursday XX/XX/XXXX, I went into the branch office to speak with a manager to get the hold removed. I explained the cashiers check was my inheritance and paid from a trust account. I had the trust documents as well as the receipt of the cashiers check issued from the XXXX XXXX XXXXXXXX account. The branch manager, even with all of the information given refused to remove the check hold.

So XXXX ( fake ) sent me an email, that said the guy had to send another payment, and I would refund that payment to him. And that I would get my payment of XXXX to my account in an hour. In an hours time, " XXXX '' called me back and sent an email, stating that they guy sent me XXXX accidentally and I needed to refund him another XXXX ( total XXXX ). " XXXX '' said I would receive my original payment of XXXX within an hour, but I have not received it. I called my bank and they can not refund or stop payment and gave me " XXXX '' number, but they are not available to assist nor can help me. I do have emails from these scammers if you need them.

Consumer Complaint: I am the victim of identity theft. Someone opened a checking and savings account with Navy Federal Credit Union using my personal information. I reported the fraudulent account to Navy Federal Credit Union in XXXX. The accounts were frozen, but not closed. I continue to receive monthly statements for both accounts. I have attempted to speak with the Security department regarding this issue multiple times, however there is always a lengthy hold, and I have not been able to get through to them. I have been waiting over XXXX months to have this account closed. On XX/XX/2023, my advocate with XXXX XXXX XXXX faxed a copy of the Federal Trade Commission Identity Theft Fraud affidavit, the Navy Federal Credit Fraud affidavit, a copy of my drivers license, and a Limited Power of Attorney- a legal document authorizing XXXX XXXX XXXX to discuss the fraudulent account on my behalf. My advocate called Navy Federal Credit Union on XX/XX/2023 and was advised the legal document sent to them was not processed or accepted with no reason for denying the document. Per federal guidelines, Navy Federal is required to investigate and close this account within a reasonable amount of time. This has not happened. I am respectfully requesting that this account be closed due to fraud within the next 30 days, and confirmation of that closure sent to me in writing.

In order for any creditor to treat a payment as late you must prove that : The information required under 15 USC 1637 ( b ) of this title was mailed out or delivered 21 Days before the payment due date please provide the proof that this information was mailed out or delivered 21 days before the payment due date. 15 USC 1637 ( b ) is very specific on all required information needed or that must be mailed or delivered to the consumer! You have 10 days to send me all the required information. A creditor can not treat a payment as late without complying with this section of the law! I am requesting under rule 1002 the documents that show proof that the information pursuant to section 15 USC 1666b and 1637 ( b ) of this title was mailed out or delivered 21 days before the payment due date. Do not reply to me stating that you are furnishing accurate information because we both know you are not.
