Issue: Struggling to repay your loan

Subissue: Can't get other flexible options for repaying your loan

Consumer Complaint: When I called to get my payments lowered I was told I needed to do a forebearance/deferment several times. I have spent through all of them and now do not have anymore for an emergency. I had asked them several times about PAYE or REPAYE like I have with my Federal Loans and they said they do not offer it. I explained that the payment they offered was too high per month. The only option I was offered was a reduced interest rate.

Consumer Complaint: Two loans 1- subsidised 1- unsubsidised Navient consolidated loans without my permission - verbal or written Since XX/XX/2010 all payments paying interest only!!! Four years of first double payments, then single payments paying consolidated loans without my permission. Contacted Navient many times. No resolution. I see online that thousands of complaints filed and several lawsuits class action underway. This is a nightmare!

Issue: Problem with a credit reporting company's investigation into an existing problem

Subissue: Their investigation did not fix an error on your report

Consumer Complaint: I had an account with Navient ( at the time it was called Sallie Mae ). The account was opened XXXX, XXXX. I defaulted in XXXX, XXXX. The date of first delinquency is XX/XX/XXXX. Navient began issuing, and the credit reporting companies began publishing, negative consumer reports reflecting this fact. The FCRA allows for the publishing of consumer reports for 7 years. After 7 years, the consumer reports must be removed and no new consumer reports regarding the account may be published. In this case, consumer repeated was required to cease XX/XX/XXXX. Despite being informed of this requirement and being asked to stop, Navient has continued to issue illegal consumer reports on a monthly basis, most recently in XX/XX/XXXX. I submitted complaints regarding these illegal consumer reports to XXXX, XXXX, and XXXX. XXXX performed an investigation and resolved the issue and removed the illegal consumer reports. XXXX and XXXX failed to resolve the issue. When I contacted XXXX and XXXX, phone representatives admitted that there had been no legitimate investigation. The phone representatives admitted that their entire investigation had consisted of asking Navient if the information was correct and then accepting their answer without any analysis. The XXXX phone representative even admitted that he had not, and that he could not, view the documentation that I provided with my complaint. When speaking with XXXX and XXXX regarding their failure to properly investigate the complaint or remove the illegal consumer reports, the phone representatives refused to correct the error and instead said that the only recourse was submitting another complaint in the hopes that the next person to perform the investigation would actually do it. There have now been three mock investigations performed by XXXX and XXXX. To date, both credit reporting companies have refused to properly investigate the complaint or remove the illegal consumer reports. Every time I contact them, I am recited lines from the same script by phone representatives that do not understand the complaint. This process has been exceptionally frustrating.

Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: Hello, I have 14 different student loans that are showing 90 days late on XXXX, XXXX. This information is not correct. My student loans have always been deferred, forebearance or on an income based repayment plan. I have made all required payments, on time. I have submitted all necessary paper work, when they ask, however they ask for it. But they still have not updated my credit reports to show accurately. I believe this is some sort of agent error. Of which they are commonly known for ( example : I filed for a deferment recently, and it was DENIED because according to them, I have loans disbursed before XXXX, which is impossible because I was only XXXX years old in XXXX. *this issue has been handled. Just using it as an example of THEIR error ).

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: I had/have a student loan with Navient as the holder. I filed for bankruptcy in 2009 and tried to get them to help me lower my monthly payments at that time and multiple times after that only to be told my only option was to go into forbearance. Well a loan that was around {$15000.00} has now progressed into a loan that is over {$28000.00}. I begged to get the monthly payment lowered until I could pay more but was told it was not possible. I was willling to make payments but they instead just put me off every time and I accrued a ton of interest that ruined me. This is unacceptable for any company to benefit from someone else 's downfall. Please help me fix or make them accountable for their actions.

Issue: Threatened to contact someone or share information improperly

Subissue: Contacted your employer

Consumer Complaint: XX/XX/XXXX I was told to go to HR at the company I work for. When I got there I was told that this company called XXXX XXXX XXXX had mailed some forms to them about garnishing my pay. They wanted to take 15 % of my income. This is a lot and it is going to cause a financial hardship on me and my wife. Plus 15 years ago Sallie Mae after months of communicating back and forth with them about my loan. See I went to college because I wanted to work on a XXXX XXXX, so I had to major in XXXX XXXX XXXX. I went to sign up for classes and met a financial aid person and she helped me sign up for a loan. I told her that I had a XXXX XXXX and she told me that was ok because in 2 years I would be working on a XXXX XXXX. I signed up for my classes. I XXXX 3 of my classes and got a XXXX on another one. So I had to take those classes all over again. I talked to financial aid and asked what I should do and she told me not to worry about it everything was going to be alright and she suggested that I just take other courses and then go back and repeat the XXXX courses last. I wanted to get math out of the way so I took it again and XXXX again. So once again I went to see the financial aid lady and she said for me not to worry about it. I got 2 XXXX and 2 XXXX. Coming back from spring break I went to see the financial aid lady and asked her what I should do she said for me not to worry about it she would go and talk to my math teacher to see what we could do. She told me just to think about working on a XXXX XXXX. I went to math class that day and after class the math teacher asked if he could see me after class. After class I went to see him and he introduced me to someone who was going to tutor me. I met with my tutor and I told her I am really trying but that I can't remember anything and that I didn't understand anything. She worked real hard. The big test came and the math teacher said I would need a A on the test to pass the course. I got a XXXX. My tutor asked me how I was doing in my other classes and I should her my grades and she asked me why I was still in school. I told her that the financial aid lady told me that I would be working on a XXXX XXXX like I wanted to. I told my tutor that I went and talked to the financial aid lady about dropping out and she just kept telling me that I would be working on a XXXX XXXX when I leave college. My tutor asked me what I wanted to really do and I said I am just getting all XXXX and XXXX and I should probably drop out. I decided I was going to go and talk to the financial aid lady again but this time I asked my tutor if she would go with me. We went to the financial lady 's office and I told her that I wanted to drop out of school and she asked me why I told her I was getting all XXXX and XXXX and she told me that I had a dream of working on a XXXX XXXX and we will make sure it happens. While we were talking my tutor was reading my loan papers. The financial aid lady got me to sign the loan papers so I held my breath and signed them. I started to date my tutor and we ended up getting married and I did drop out of school. I went to work and my new wife continued her college and she graduated. She went to work in a XXXX XXXX. Her older brother invited us to go and live in XXXX and he could get me a job where he works. So we moved to XXXX, to make a long story short me and my wife ended up XXXX. I called Sallie Mae and got a forbearance. My wife started getting really sick and all the drs in XXXX said it was in her head. We ended up going back to XXXX. Time went on and I got another forbearance and then another forbearance and now my wife is being rushed into XXXX. She was in the XXXX XXXX for 9 and a half hours. She almost died. My wife was really sick it wasn't all in her head. She was XXXX XXXX for almost a year after that XXXX. During the time my wife was recuperating she reread my loan papers and on the back of the loan papers it said if a student doesn't keep up a XXXX GPA they would not qualify for any loans. My GPA was always way below a XXXX. My wife told me I should of never gotten those loans and that Sallie Mae was irresponsible in giving you those loans. My wife knew other financial aid people and come to find out the lady that was getting me to stay in college was making commission on the loans. I started calling Sallie Mae and a months of talking to them and they talked to others. Sallie Mae said I fell threw the cracks and I shouldn't of been getting loans and because everyone XXXX me a young impressionable man they were going to write off my loan. I never thought anymore about it, until I showed up for work and HR showed me the forms. I never even heard from anyone. I tried to call the college to get any paper work I could and XXXX College closed.

Issue: Dealing with your lender or servicer

Subissue: Problem with customer service

Consumer Complaint: On XXXX XXXX, XXXX I applied for loan consolidation through studentloans.gov. Navient was my servicer at the time so they processed the consolidation. I selected all existing loans on studentloans.gov for consolidation. I didn't leave one out. I wanted everything consolidated. On XXXX XXXX I called Navient and spoke to XXXX to cancel the consolidation process due to error in selecting intended servicer. I had selected XXXX XXXX by mistake. I wanted XXXX to service my loans after consolidation. XXXX told me I had a loan summary letter produced on XXXX XXXX informing me of the details of the consolidation. I had 10 days from date of letter produced to make any changes. I was well within the 10 days. XXXX submitted a request to the back office to cancel the consolidation, and informed me I should get a letter in the mail once it has been canceled. I never got that letter. Instead I got a welcome letter from XXXX XXXX dated XX/XX/XXXX. They had processed the consolidation and completely ignored my request to cancel. The consolidation didn't include all the loans as I had originally applied for. 2 separate loans were later consolidated on XX/XX/XXXX. I don't know why this occured, outside of the original consolidation process, nor was I notified of it taking place until it was finalized. I had called 2 days earlier and spoke with XXXX to have the consolidation canceled and yet the isolated loans still were processed. I then tried to file a complaint within their site, but to no avail. I called on XX/XX/XXXX and spoke to XXXX, a consolidation loan specialist from Navient. She could not resolve my situation despite confirming my request made weeks earlier on XX/XX/XXXX. XXXX informed me she would submit another request to higher ups. I also called XXXX XXXX to cancel the consolidation but they could not help me. They told me to call Navient. All Navient has done is spin me in loops. Give me the phone number to XXXX who would in turn have me call Navient to cancel the consolidation. I can never get anyone from Navient with authority to cancel or resolve my situation on the phone. All they have been able to do is submit requests to higher ups or back office, whom I never get any response from, ever. They have me wait and wait, for nothing.

Issue: Communication tactics

Subissue: Frequent or repeated calls

Consumer Complaint: We have been receiving repeated robocalls from XXXX XXXX XXXX, starting at XXXX XXXX daily. Sometimes we get calls two or three times in a day. I did an online search of the company and found that it is a debt collection agency that uses illegal tactics. Further, WE DO NOT HAVE ANY OUTSTANDING DEBTS, UNPAID TICKETS OR OWE ANY OTHER MONEY, so this horrible company is calling our number in error. Other victims have tried calling the company, only to be placed on permahold or face verbal abuse. This company needs to be stopped. We have had this phone number for years, so if the calls are targeting someone who used to have the number, then XXXX XXXX XXXX records are way out of date.

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: I received a letter from a collection agency, XXXX XXXX XXXX XXXX XXXX to collect on a school loan for the United States Department of Education. This is the information I received : Reference No. XXXX Principal Bal. {$20000.00} Interest {$46000.00} Collection Chrg {$11000.00} Total due : {$78000.00} I've attached a copy of this letter to this correspondence. I'm a bit in a panic state about this. I'm XXXX years old, on a pension and social security. A little history : I went to the University XXXX XXXX XXXX back in XXXX and graduated in XXXX. My only recollection is that my dad took out a loan for my college education. In the XXXX plus years since my graduation, I've never received a bill from the Department of Education regarding this loan. My understanding is that my dad took out this Federal Loan on my behalf. I'm almost 100 % sure I was not on the loan at all. My parents were always going to pay for my education. It's been over 40 years and I can't say for sure, but I don't recall ever receiving information about this loan until now. My name is currently XXXX XXXX. The letter came under the name of XXXX XXXX XXXX XXXX which was a previous married name that I haven't used in 29 years. My maiden name at the time I went to XXXX was XXXX XXXX XXXX. I'm very afraid of contacting this collection agency directly since I've read their collection efforts are ruthless. I'm not sure where they got my name and my mailing address since I just acquired this mailing address about 6 months ago. I've worked very hard to obtain a XXXX credit score and I'm so afraid they will report this debt as a defaulted loan after XXXX years. If it is discovered that I, in fact, was the primary borrower, I will do whatever is necessary to resolve this without the interference of a collection agency. At this time I feel helpless because I have no idea about the details of this loan. I would be forever grateful if you could advise me as to the next steps I should take to resolve this matter. Thank you in advance for your assistance. Please contact me as soon as possible as I feel very uncomfortable about this whole situation and I don't want my credit ruined. Thank you again. Issue: Struggling to repay your loan

Subissue: Problem lowering your monthly payments

Consumer Complaint: I have been deferring my payments with forbearance for a couple of years now. I haven't been able to afford the payments asked of me by Navient and STILL can't. When I tried to extend the forbearance in XXXX they told me I wasn't able to anymore. When I told them I can't afford the payment they're asking of me which is {$580.00} a month they told me they would give me a one-time " courtesy '' deferment which they then dinged me on my credit report for. I applied for income driven repayment plan through XXXX as advised by Navient and on XX/XX/XXXX I received a response saying my payments have been lowered {$440.00} a month beginning on XX/XX/XXXX. I STILL CAN NOT AFFORD THIS. Navient refuses to work with me to get me to a more affordable repayment plan. They're only considering my income and not my monthly expenses including rent, car payment, medical bills, credit card debt and living expenses. I am at a loss at what to do here. I can't afford this and the company has no sympathy in working with me to come to a solution I can afford.
