Issue: Communication tactics
Subissue: Frequent or repeated calls
Consumer Complaint: We are receiving repeating calls for an entity calling themselves " Municipal Services '' requesting us to call XXXX. They identify themselves as a debt collection company. They give absolutely no information as to the nature of this alleged debt. Because I have never received a letter of demand for payment and the lack of information, the generic pre-recorded nature of the call I am sure this is some kind of scam.

Issue: Dealing with your lender or servicer
Subissue: Trouble with how payments are being handled
Consumer Complaint: On XX/XX/2018 I logged into my account, looked at the ready to pay off this loan amount for online repayment, and chose the specify for each loan option and chose this loan to pay off the full balance of {$12000.00}. I went onto the account about a week later and noticed they distributed the payments between two loans and did not pay off the full balance of the one loan I specified. They applied {$3600.00} to this loan leaving me with almost a {$9000.00} on this consolidated subsidized loan and applied the remainder to the larger loan. This made it so my payments didnt decrease, I still have balances on both loans with a 6.25 % interest rate. The point of me paying it off was to decrease my debt and start to make a dent in my over {$80000.00} in student loan debt. When I called to complain they told me it was the department of education that redistributed the loan and that I couldnt do anything about it. I am never going to get these loans paid off if I cant take one loan at a time to pay off. These loans show two separate pay off amounts, I make two separate payments each month on them that get applied just fine. I wasnt behind on any of the payments and had made the payment for that month to the other loan already. They used my money how they wanted even though I specified where the money was to go and they had the option online to specify where the money is to go. Also, the full repayment amount for each loan is not showing as one lump sum, it is showing for each loan by itself. And although it let me specify which loan I paid at the time of each payment ( even standard monthly payments ), when you look at all the payments it doesnt specify which loan was chosen in the pending and past payment history. It is deceitful and completely unethical.

Consumer Complaint: In XXXX of 2018 Navient debited my account for my monthly installment 2 days before the payment due date. I had more than enough money in my account to cover the payment but for some arbitrary reason then 'reversed the payment ' without any notification that there was a problem on their end. Then I receive a message AFTER the payment due date saying that I've missed payment. I call in only to told there is nothing I can do about the incurred interest due to a missed payment even though I didn't miss a payment. I know it sounds petty to worry about the incurred interest but when you have almost 90,000 in student loans and the interest rate is nearly 7 %, I need to worry about every single penny of my balance.

Consumer Complaint: After receiving a letter threatening to garnish my wages over a {$3500.00} loan that's halfway paid off from the Department of Education, I submitted the documents they requested showing that would cause a hardship under two different categories via certified mail and it was delivered. Last week I received another letter requesting the same documents plus additional ones be sent to a collection company in New York within 15 days of the DATE OF THE LETTER. I live in California it took me almost a week just to get the letter and one of the requested documents would take at least 10 days to get from XXXX. On top of that they're requesting a letter of termination from my previous employer that I was never given and can't ask for now. In fact I don't know a single person who has ever received a " letter of termination '' from a job. I can't afford to have my wages garnished, they've already taken and continue to take my tax refunds yearly this is just extreme.

Consumer Complaint: I graduated from the University of Illinois in 2011. In total I borrowed {$20000.00} in private student loans with Navient. Since 2011, I have paid a total of about {$16000.00} but my principal balance is still {$19000.00}. How can this be legal? How could only {$800.00} be applied to my principle balance? Aside from this, it is ridiculous that Navient refuses to give you any accurate or helpful information about your account. I called to find out how much I have paid so far, and I was told something would have to be mailed out because they dont have access to that information. It seems odd that anyone could give me accurate information about my account if they cant see my payment history. When I inquired about making an additional {$50.00} payment through a round up app ( an app that helps you pay off your student loans by rounding up your purchases to the nearest dollar ), I was told that making additional payments would cause my minimum payment to go up {$200.00} because my rate reduction program would be cancelled. But when I asked how I can get my loans paid off faster I was told to make extra payments. Then I was told that I could make a payment for the entire balance. Navient does not care about their borrowers and has bankrupted my generation. As others have called it, this is financial terrorism.

Consumer Complaint: Years ago I was having trouble making payments, and was advised by Navient to do forebearance. They told me that the interest would be tagged on to my loan. After the forebearance ended, they said 6 months of missed payments were due. My loans are still past due with over {$17000.00} due right now and in default. Not only was it impossible to pay, but the fees just keep piling up and they refused to do anything about it when I called. Get calls about 8-10 times a day, collection letters from them and another collection agency, and can't even start to get out from being underwater. To be honest, the only thing keeping me from having XXXX XXXX is that they would go after my mom if I did. They also call and harrass my sister, and she isn't even on the loans.

Issue: Incorrect information on your report
Subissue: Account information incorrect
Consumer Complaint: Navient has a history of misapplying payments on my student loans. As they've admitted in the past, there were delinquent marks on my credit ( and co-signer ' credit ) for years that they refused to fix, in addition to late fees. I filed a previous complaint against the company, Navient. Navient admitted to issues with the payment processing on their end and stated payments were set up incorrectly. I previously spoke with their office of the consumer advocate ( associate XXXX XXXX XXXX about a year ago with respect to this issue. Since then, I've had to renew my payment plan. I recently received correspondence that my account is being reported over 40 days past due with late fees/credit reporting again. I contacted Navient, and they stated that the payments are again being applied incorrectly on their end. The recorded calls with the company will demonstrate all of this. It's clear at this point that Navient has engaged in negligence, bad debt practices, breach of contact, infliction of emotional distress, and the like. They are unable to competently set up a payment plan and apply payments in correctly, which has resulted in continued harassment for myself and by co-signers. I've attached proof of this non-compliance to this case in addition to a recent past due letter that I've received.
