Consumer Complaint: I filed a complaint against two mortgage companies, Aurora Lending Services and Nationstar Mortgage Company ( XXXX ). The former filed foreclosure on me, even though I was current on payments and provided proof ( cashier 's checks ) that I had responded as the modification contract required. Still they filed foreclosure.

I lost {$57000.00} in down payment money ( See complaint:XXXX ), years of paying a mortgage with a 10 % plus interest rate, and I have been fighting this matter since XXXX. In XXXX, I surrendered the property in a chapter XXXX that was approved and confirmed by the court. Years later, I discover that Nationstar filed a foreclosure on me in XXXX which is preventing me from securing a mortgage today.

Nationstar responded to my complaint with CFPB by sending a message to a former attorney we had retained in XXXX. One problem with their response is that the attorney does not represent us. Another problem is the attorney has been debarred and has lost his license. for mortgage-related client misrepresentations.

Please intercede and ensure that all responses are sent to me, not to the previous attorney.

Consumer Complaint: XXXX We have tried to fix this issue with Nationstar Mortgage. They sent me a response with the wrong recorded paperwork from the State of California and XXXX XXXX XXXX. I have attached the correct paperwork to this file. We were told when the State of California and CFPB fixed the issue with the fraud that if we were to experience another hard-ship we could apply for another modification in the future. We have submitted a request and Nationstar Mortgage referred us to the new loan department as they could not do another modification.

Consumer Complaint: A Defectively filed Notice of Default was filed and a CFPB Complaint filed XX/XX/XXXX as Complaint No. XXXX. This NOD was reversed due to being wrongly filed and defective as had been stated in the prior complaint. However Nationstar hired a " new '' firm as their Attorney Foreclosure Firm - Yes reversing the prior NOD and then filing a " new '' Defective Notice of Default by being in too big a hurry to pay attention and thereby utilizing a twice used California Declaration that is mandatory requirement under CA Civil Codes. I 'll attach the Civil Codes for Review as Nationstar is by passing the application of the laws.

During the prior 30 days from the NOD recorded by XXXX XXXX XXXX acting as a Sub of Trustee/recorded a 'NOD on XX/XX/XXXX ' with a FALSE Affidavit/Not reliable and since was wrong the first round in XX/XX/XXXX ' is still not reliable nor accurate. This affidavit was filed claiming efforts made 30 days " prior '' to the date it was signed and was to relate to the NOD being recorded. Obviously a Declaration from XX/XX/XXXX for an event of Pre-Foreclosure Steps in XX/XX/XXXX' are not true nor reliable as required under the laws. In fact the NOD pre-30 Days I was in a Forced into Ch XXXX from faulty acts being made caused a Bankruptcy stay in place and for the entire year from XX/XX/XXXX ' - Through XX/XX/XXXX this would be exempted from any possible attempts to make contact given the BK. Rather than follow the outlines of the laws by-passed and just attempted to reuse the prior faulty Defective Declaration knowing it was not true nor possible to be true.

Each detail since has ever more " odd '' and strange outcomes : On top of this a " Request for each Demand Letter '' that would correlate and Each Demand Letter from any hired firms. A Blank Letter arrived with a page one letter claiming here are the attached items as requested yet all pages are blank. 8 Pages Blank as to show some type of pre- 30 Day Letter of a Demand prior to recording a NOD. No documents provided. This makes no sense and is very odd.

Then on top of this Nationstar apparently failed to inform of my mailing address - to the " new '' Trustee and this caused the 5 Day Letter required after recording a NOD to have been sent to ONLY the Wrong Address ; Missing the 5 Days of any such Debt Validation. This appears may have been intentional since the same firm and Nationstar knew my address as I was " in '' the bankruptcy having " same '' address just 3 Days prior.

Additionally the Foreclosure Attorney firm named XXXX XXXX aka XXXX had my address as they were involved in the BK details and 3 Days earlier had my information and then claimed did not have it and that for some reason Nationstar failed to " give '' the correct mailing address. This defective Notice also caused XXXX XXXX AS TRUSTEE to file and PUBLISH wrong details of a debt claimed as owed/false accounting/and File a Status on their own Web site referencing an Auction Company named XXXX this firm is now publishing NON PUBLIC INFORMATION. PRIVATE INFORMATION TO THE PUBLIC ON MY NAME, PERSONAL DETAILS AND MY ENTIRE LOAN ACCOUNT. ( The letter attached explains this further - & both entities have been informed of this very illegal collection practice and have failed to respond ) allowing a continued publishing of my personal NON PUBLIC INFORMATION to be on a pubic website.

This XX/XX/XXXX- Notice of Default is filed inaccurately, defectively and is outside of CA laws, and outside of Dodd Frank Regulations ; the Publishing of Personal Information and a Claim of a Debt by XXXX is being instructed to 3rd parties thereby Violating Fair Debt Collection Practices and " Slandering my Reputation '' And Slandering Title as well as causing Private Confidential information to the Public as this violates the FDCPA AND VIOLATES CA. ROSENTHAL Debt Collection Act. Personal information is to be kept confidential.

This is causing great stress and over 20K views from other sites picking up the Auction details. This was informed to Nationstar to STOP PUBLISHING MY PERSONAL INFORMATION AND TO REVERSE THE NOD.

Both parties are ignoring the laws. XXXX XXXX XXXX says they are a Debt collector - acting for another ( another 3rd party - XXXX XXXX as Trustee of a Trust ) -- and the Debt was under Dispute however XXXX continued to make efforts to collect on a debt claimed as owed and instructed a 3rd party named XXXX to publish private NON Public Information. XXXX states they ONLY do as instructed by Nationstar however Nationstar knows this was " in dispute '' as still open dispute ongoing concerns that were raised and not answered previously. Nationstar continues to just disregard homeowner 's concerns. Stating they would look into the facts however never responds knowing this was a heightened and very wrong to publish NON Public information. Now further sends a new RMA yet never responds to the RMA that is provided and or all the documents provided. Each communication is ignored unless I bring to the Regulators Attentions. Then still typically are answered with non-answers. Or by passing the details raised.

Each communication is met with incompetent staff that seems any issues are out of their league or scope of comprehension. The internal staff keeps changing my One Pointed assigned person back and forth and back and forth. No Customer Escalation Teams are available when they state to contact them. Each attempt to reach out only results in new frustrations. No return calls or no responses to my concerns raised. Each time a new person at Customer Service says they will put notes and have the Escalation Team look into and also have the one person call back and no calls ever come. No Escalation Team answers. In the hurry to foreclose regardless of all concerns in regards to my unconscionable predatory loan by XXXX and many promised outcomes from each regulatory lawsuit that was to assist only results in ever new increased balances that have no relation to the agreements made. This has caused extreme harassment and unfair business practices. I feel my money was stolen and I can not even use my home from now it is damaged so badly after Nationstar ordered persons to break in and cause massive damages. This has been non stop. I deserve better treatment and respect than what is shown. My privacy should be protected and not part of a scheme to cause further embarrassment and harassment.

This is a pattern which interferes with my entire life as I am strung along waiting for them to make good on the Regulators Agreements pertaining to the USDOJ - and CA AG and the NMS agreements pertaining to my XX/XX/XXXX ' XXXX Origination loans.

The note was accelerated however since no understanding is found at any level - even the Attorney firms hired, state they are NOT Attorney 's they Do not check the laws and are not required to. This is causing a multitude of mistakes and entire laws to be disregarded in every sense. This is a Defective NOD filed and again, instructed to send to the Attorney firm ( per Nationstar ) then sent a letter and exhibits by email and back up as certified mail otherwise Nationstar says they never received. Then attorney firm states they are not " really '' the attorney firm - only acting as a Trustee that does not require to follow any laws. As if they are exempt from any and all laws. This pattern is horrendously abusive. The Trustee 's are not acting as unbiased parties as they are hired to only benefit the Servicer 's requests and do not look at the laws.

However all facts and details provided are ignored, and this is extremely frustrating as no accountability is found. The Attorney firm is advertising to be an expert in the Foreclosure process. However this appears to be a game that by passes all laws. To be hired for your expertise in one arena then claim you are not what you said.

Nationstar keeps referencing that the Attorney 's will review all applicable laws. The same attorney 's that state NO they do n't have to follow any laws and Do not have to review laws either. That all responsibility is that of the Servicer. However the Servicer appears to be flying blind. This makes no reasonable Business practice found.

The NOTICE OF DEFAULT WAS FILED DEFECTIVELY. THE DECLARATION IS NOT VALID NOR TRUTHFUL, OR RELIABLE. IT is obvious that it was used twice and is non compliant to the applicable laws.

To Publish personal information is a violation of the FDCPA. This is a request to Reverse the defective NOD and Stop publishing my personal information. Stop publishing my Full Loan Account Number ; Stop publishing my name ; stop publishing fake accounting figures claimed as owed. And stop acting on faulty defective Declarations that are signed under perjury. This has been burdensome.

And stop sending blank documents to suffice as if " real '' items are existing when no documents are found.

Your Immediate Attention to these concerns are appreciated. AND stop saying you 've answered a complaint when no answers came/and no details were yet raised.

This is a TOPIC that has NOT been Answered. The NOD is defectively filed as to rush with new trustee to hurry up to file a NOD regardless of events, timing and or any laws being followed caused this defective filing of a false affidavit twice used and having no reliability.

To instruct a 3rd party to record, publish and claim a debt is owed. To fail the CA strict requirements ; and to ignore the topic raised as if it 's not necessary to answer to the homeowner. To cause horrendously outrageous collection attempts that include the details raised in the Letter Dated : XX/XX/XXXX that was sent by Email to the Attorney firm/and Trustee who stated they will review letter and send to Nationstar.

See attached items. Both Versions of the twice used Declaration from XX/XX/XXXX' and again used in XX/XX/XXXX ' rather than taking the steps under the applicable laws. See attached Letter to both Nationstar 's cover letter of Two pages, and Six Pages to all parties : XXXX : XXXX XXXX and Nationstar. To correct by rescission. And stop publishing my personal loan information to public sites.

Consumer Complaint: Nationstar mortgage acquired my loan in XX/XX/XXXX. They refused to honor the modification that I was in, did I was behind, and were foreclosing, giving me no options to save the home, and not accepting payments. I finally just listed the home for sale the middle of XX/XX/XXXX and found a buyer quickly. My principle balance is {$60000.00}. Nationstar came back with a payoff on XX/XX/XXXX of over {$100000.00}. I called on XX/XX/XXXX to find out why and was told This amount includes a modification fee of {$12000.00} and over {$5000.00} of lender paid expenses. Over {$12000.00} of interest and almost {$10000.00} in escrow fees. I requested an itemized list of charges, which will take a week to repair, and asked to speak with a manager about having the modification fees removed since they never have me a mod. The representative said that I was right they saw no modification on my file and that he would send a note but refused to let me speak to a manager about the issue and said that he had no authority to remove it, that would have to be decided by management. I again asked to speak to someone in management, and was told that it was n't possible. I need at least the {$12000.00} removed, and by my calculations I was over charged for escrow by {$4900.00}, and there are probably more fraudulent charges on there as well that I need investigated, or I will make nothing from the sale of my house, and me and my children will be homeless in ten days when the sale closes.

Consumer Complaint: I have had this issue with Nationstar mortgage for a while now. They held funds in suspense not completing full payments during a time of XX/XX/XXXX-XX/XX/XXXX. 3 months later, Nationstar finally admitted fault for their inability to apply funds and corrected the payment history. I requested a verification of mortgage, bu the VOM was not corrected. Lacking a correction for the VOM, it stated that I was 30 days past due for multiple months. I have been trying to refinance for 9 months and this error on Nationstar Mortgage is inhibiting my ability to. When Nationstar went back into the payment log they held up 2 months worth of payments, which put me ahead in my payment schedule. It does not make sense that they still have not repaired my VOM on their clear mistake ... After countless attempts to correct this, Nationstar has drug their feet around on this issue.

Consumer Complaint: Please consider this correspondence to be formal notice that our mutual client is hereby submitting a complaint regarding the denial of loan modification because your company failed to evaluate this borrower for all loss mitigation options available in violation of Regulation X, 12 C.F.R. 1024.41 ( c ) ( 1 ) ( i ). The lender failed to provide the required notice of additional required documents within five ( 5 ) business days in violation of Regulation X, 12 C.F.R. 1024.41 ( b ) ( 2 ) ( B ). Therefore this client 's application was entitled to be treated as facially complete pursuant to Regulation X, 12 C.F.R. 1024.41 ( c ) ( iv ). Consumer Complaint: On XXXX XXXX 2013 XXXX XXXX signed a Declaration of Mortgage Servicer Pursuant to Civil Code 2923.55 ( c ) The mortgage servicer has contacted the borrower pursuant to California Civil Code 2923.55 ( b ) ( 2 ) to " assess the borrowers financial situation and explore options for the borrower to avoid foreclosure '' Thirty days, or more, have passed since the initial contact was made. THIS IS A DELIBERATE LIE ON BEHALF OF XXXX XXXX XXXX XXXX committed Perjury by false affidavit. Criminal law 2641 and should be charged accordingly.

My HOBR were violated and then ignored. This act was deliberate and contiguous to the methodical deceptive and unjust behavior. I never received a NOD nor was one posted on my property. I never even knew that it was filed until I learned about the auction date that was set.

Consumer Complaint: I closed on XX/XX/XXXX on a Condo in XXXX, VA. XXXX XXXX ( XXXX ) was the lender and XXXX XXXX was the settlement company ( XXXX ). Ive had three additional lenders ( XXXX XXXX XXXX ( XXXX ), XXXX XXXX XXXX ( XXXX ), and Nationstar ( XXXX ) ) between XX/XX/XXXX and XX/XX/XXXX. I called on XX/XX/XXXX to find out why my mortgage was an additional {$200.00} for XXXX. I was told by Nationstar ( current servicer ) that my escrow is negative {$1600.00}. I asked how could that happen when I havent had the loan for a year. I spoke to XXXX in Escrow and she did not have an answer as to why the increase happened. When I asked what was transferred from XXXX, they didnt have those records. I told her I wanted to pay the amount Ive been paying until they get this straighten out. I was told if I didnt pay the full amount my loan would be considered late. So I paid the full amount to prevent that from happening.

She also told me there is an issue with my Master Condo Policy and HO6 ( Hazards insurance ). She transferred me to XXXX in the insurance department. XXXX did not know what was going on with my insurance. She stated I had Traveler as an insurer. I informed her it was XXXX and has always been. She said they didnt have my Master Condo Policy on file. I told her all of that should have come over from the previous lender. A lot of confusion talking to XXXX ; she understood there was an issue, but didnt have any answers. She asked me to have the Master Condo policy faxed to XXXX by the management office, which I did. The office gave me proof it was faxed, but when I called back they said they didnt have it. They also wanted me to have XXXX fax the HO6 to the same number. When I talked to XXXX, they said they had Nationstar as the lender and would send the policy again. To add to this insurance issue, XXXX said there wasnt a line item for the HO6 and I had to pay it XX/XX/XXXX. XXXX said my payment is due in XXXX, not XXXX. The HO6 has always been in my escrow. Two months was collected at closing, it was always covered in my escrow.

I called XXXX on XX/XX/XXXX to see if they could help figure this out. I spoke to Agent XXXX. All I got was a blame game and know answers. I called XXXX on XX/XX/XXXX. They said they didnt have anything to do with funds collected and to call XXXX XXXX. I called XXXX XXXX on XX/XX/XXXX. XXXX XXXX ( XXXX processor ) said I should call the person that did the loan, XXXX XXXX ( XXXX ). When I talked to her she understood it was a mess and said she would help. I explained I paid fees to them and XXXX to make sure things needed was done correctly at closing. Now my escrow is messed up and nobody seems to be of any help. She thought too much was paid for property tax. She told me she would have an answer when I returned from vacation on XX/XX/XXXX. When I reached out to her on XXXX XXXX, she said she could not find anything out.

I called the city about the taxes and they had not been over paid. Not only that, payment forXX/XX/XXXX XX/XX/XXXXfrom the previous owner did not get paid. Because they didnt get paid, I had to pay them, but I didnt know the funds came out of my escrow.

There was some confusion on the XXXX taxes. In XXXX I received a notice from the city stating taxes due XX/XX/XXXXnever was paid. There were late fees and penalties. The blame game again between XXXX and Nationstar. Finally Nationstar paid them and sent me a letter saying they were sorry they were late and I would not be accessed the fees.

In addition to this needing to be figure out, I feel I should not have to pay the extra money in XXXX. I hope you can help me.
