Consumer Complaint: Complaint Regarding Credit Report Inaccuracies Dear CFPB, I am writing to file a complaint regarding inaccurate information on my credit report. I have been actively disputing these inaccuracies with the credit bureaus, but they have failed to adequately investigate my claims or remove the incorrect information. In accordance with the Fair Credit Reporting Act. I attached the PDF file below containing the list of items that have violated my federally protected consumer rights to privacy and confidentiality under 15 USC 1681. Credit Bureau stated everything was complete and accurate. But how is that possible if the open date, date of last activity and much more is incorrect. According to 15 USC 1681i ( 5 ), they are supposed to modify or delete accounts that aren't reporting correctly. 15 U.S.C. 1681s-2 ( A ) ( 1 ) A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. I also believe that the credit bureaus have violated the Fair Credit Reporting Act ( FCRA ) by failing to : 1. Investigate my disputes in a timely and reasonable manner : The credit bureaus have not provided a clear explanation for their decision not to remove the inaccurate information, and I believe their investigation was inadequate. 2. Furnish accurate information to creditors : The inaccurate information on my credit report is harming my ability to obtain credit and other financial services. 3. Follow the FCRA 's dispute resolution procedures : The credit bureaus have failed to comply with the timeframes and procedures outlined in the FCRA. I am requesting that the CFPB investigate my complaint and take the following actions : 1. Order the credit bureaus to remove the inaccurate information from my credit report. 2. Require the credit bureaus to provide me with a copy of my updated credit report reflecting the changes. Consumer Complaint: It is my understanding that the Consumer Reporting Agencies such as EXPERIAN, XXXX and XXXX are obligated by the FCRA to report accurate accounting. According to the Fair Credit Reporting Act 15 USC 1681 section 602 states " There is a need to ensure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy and to adopt reasonable procedures for meeting the needs of commerce for consumer credit, personnel, insurance, and other information in a manner which is fair and equitable to the consumer, with regard to the confidentiality, accuracy, relevancy, and proper utilization of such information in accordance with the FCRA. EXPERIAN, XXXX and XXXX are consumer reporting agencies and I am the consumer. These organizations are in several violations. 15 USC 1681b states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' Furnishers of information to credit agencies, ( ex. financial institutions ) and the Consumer reporting agencies, XXXX, XXXX, and EXPERIAN do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to EXPERIAN, XXXX, XXXX, and Furnishers of information to credit agencies whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' Furnishers of information to credit agencies never informed me of my right to exercise my nondisclosure option. Pursuant to 15 USC 1681a ( 2 ) ( A ) ( i ) states Except as provided in paragraph ( 3 ), the term consumer report does not include ( A ) subject to section 1681s3 of this title, any ( i ) report containing information solely as to transactions or experiences between the consumer and the person making the report ; Reporting utilization or my transaction history is illegal. This is not only a violation of the FCRA but also a violation of the Privacy Act of 1974 ; 5 USC 552a. Furthermore, 15 USC 1681c ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than XXXX years. '' The accounts that are being furnished/reported with adverse items such as late payments, repossessions or other derogatories that are being reported/furnished without my permission are against the law. These clearly are not convictions of crimes. Additionally, 15 USC 1666b, further states that no creditor may treat a payment on an account under an open end consumer credit plan as late for any purpose. So creditors are in violation of 15 USC 1681s-2 by reporting late payments having clear knowledge that this is inaccurate and a wrongdoing on their part. Additionally, the IRS defines canceled debt also known as charge-off as gross or ordinary income. And income can not be reported on a consumer file/report. So there shouldn't be any accounts being reported or furnished on my report nor file as a charge-off 15 USC 1681s2 ( A ) ( 1 ) states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 USC 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. EXPERIAN, XXXX, and XXXX are not maintaining reasonable procedures.

'' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s-2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 168le states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title.
