Consumer Complaint: I regret to inform you that I can not accept your decision to dismiss my identity theft claim by attributing it to an error or a misrepresentation of material fact. It raises serious concerns as to how and why you possess the authority to determine what constitutes a material fact. It's worth noting that your role does not grant you the powers of a judge or jury, nor any inherent right to make such determinations. I was the victim & Im not sure why the CRA is not complying with the law. The other bureaus have followed suit. Im very confused why this one seems to ignore my requests According to the guidelines set forth by the Federal Trade Commission ( FTC ), when an FTC identity theft report has been filed with a law enforcement agency ( which the FTC itself is ), the protocol is to adhere to the law and investigate accordingly. XXXX XXXX XXXX XXXX XXXX FRAUD, PLEASE DELETE!!!! XXXX XXXX XXXX FRAUD, PLEASE DELETE!!!! I am willing to grant you one final opportunity to process my request concerning my identity theft. Failure to do so will compel me to seek legal recourse through the judicial system. In such a scenario, you will be held accountable for the damage caused to my reputation, credit, and the emotional distress I have endured throughout this ordeal. It is highly likely that what constitutes a material fact will become abundantly clear during legal proceedings, and you may be required to compensate me for your negligence. I have identified XXXX instances where XXXX are willfully, inaccurately, and unlawfully reporting that the following accounts are negative without furnishing XXXX proof of verification of these alleged debts nor that XXXX followed all laws and regulations under the FCRA to report them therefore you must REMOVE XXXX negative accounts and adverse remarks as they are causing unjust harm. Consumer Complaint: I, XXXX XXXX XXXX, am writing to address concerns regarding potential violations of the Fair Credit Reporting Act ( FCRA ) and associated regulations. As stipulated in 15 USC 1681 section 602a, consumer reporting agencies such as Experian are duty-bound to uphold their responsibilities with fairness, impartiality, and a commitment to consumer privacy. Similarly, financial institutions, including XXXX XXXX XXXX, are mandated by 15 USC 6801 to respect consumer privacy. In accordance with 15 USC 1681 section 604a section 2, I wish to underscore that the furnishing of consumer reports is contingent upon written instructions from the consumer. To date, neither Experian nor XXXX XXXX XXXX has obtained my explicit written consent to furnish my information. By invoking my rights under 15 USC 6802 ( b ) ( c ), I am officially opting out of and revoking any and all authorizations, whether verbal, nonverbal, written, implied, or otherwise, that may have been previously granted to Experian and XXXX XXXX XXXX. It is noteworthy that XXXX XXXX XXXX failed to apprise me of my right to exercise the nondisclosure option, as mandated by 15 USC 6802. Furthermore, 15 USC 1681 ( c ) ( a ) ( 5 ) explicitly prohibits consumer reporting agencies from including adverse information in a consumer report without proper authorization. The reported account is deemed adverse and has been shared without my explicit permission, thereby constituting a violation of 15 USC 1681s-2 ( A ) ( 1 ) ( a ). Under 15 USC 1681E, consumer reporting agencies are required to maintain reasonable procedures to prevent violations. It has come to my attention that Experian may not be adhering to these prescribed standards. In accordance with 12 CFR 1016.7, I am formally exercising my right to opt out of adverse reporting services. I respectfully request your immediate attention and resolution of these matters.
