Consumer Complaint: On XX/XX/year>, I wrote to the below creditors requesting an investigation into items that I believed were inaccurate, and falsely reported. To this date I have not received a response for the requested information. I have received your computer-generated letter stating that you have ceased investigation of my credit reports because, in your opinion, you believe that I have used a third-party credit repair agency. Not only do I believe this to be a stall tactic on their part to grant an additional 30 days to comply with my original request, but I believe it to be a blatant violation of 15 U.S. Code 1681i - Procedure in case of disputed accuracy. XXXX has responded by sending me a billing statement. I have attached a copy of my government issued ID as well as mail showing proof of address. So, there shouldnt be no confusion or stall tactics on your end. You were advised by me by certified mail that I questioned the accuracy of a few items on my credit reports. That request was written by me and mailed by me- not a third-party agency. It appears obvious to me that you are abusing your power under the FCRA to escape a complete investigation. In response to notices sent to me from your company and more importantly, due to your erroneous reporting to the Credit Bureaus, the highly negative impact on my personal credit report. Please be advised that this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 ( b ) that your claim is disputed and validation is requested. This is NOT a request for verification or proof of my mailing address and or a billing statement, but a request for VALIDATION made pursuant to the above-named Title and Section. I respectfully request that your offices provide me with competent evidence that I have any legal obligation to pay you regarding the following : Please provide me with : 1. What the money you say I owe is for. 2. A detailed explanation of how you calculated what you say I owe. 3. Copies of any and all papers that prove I agreed to pay what you say I owe. 4. A verification or copy of any judgment, if applicable. 5. The identity, name, and address of the original creditor. 6. Proof that the Statute of Limitations has not expired on this account. 7. Proof that you are licensed to collect in my state. 8. Your license numbers and Registered Agent or Agent of Service. At this time, I will also inform you that if your offices have reported invalidated information to any of the XXXX major Credit Bureaus ( Experian, XXXX or XXXX ) this action might constitute fraud under both Federal and State Laws. Due to this fact, if any negative mark is found on any of my credit reports by your company or the company that you represent, I will not hesitate to bring legal action against you for the following : 1. Violation of the Fair Credit Reporting Act 2. Violation of the Fair Debt Collection Practices Act 3. Defamation of Character If your offices can provide proper documentation as requested in the following Declaration, I will require at least 30 days to investigate this information and during such time all collection activity must cease and desist. Also, during this validation period, if any action is taken which could be considered detrimental to any of my credit reports, I will consult with my legal counsel for suit. This includes listing any information with a credit reporting repository that could be inaccurate or invalidated or verifying an account as accurate, when in fact there is no provided proof that it is accurate.

I ADVISED OF THE VIOLATION TO MY PRIVACY 15 USC 1681 AND THAT I NEVER GAVE EXPERIAN ANY VERBAL OR WRITTEN CONSENT TO REPORT ANYTHING ON MY CONSUMER REPORT. I DO NOT HAVE TO CONTRACT WITH ANY THIRD PARTY COMPANY. I REQUESTED IF THERE WERE ANY CONTRACT BETWEEN ME AND EXPERIAN TO PRODUCE IT IN 30 DAYS AND THEY HAVE NOT. I REQUESTED IF THEY COULD NOT PROVIDE SUCH CONTRACT ALL RECORDS I DEMANDED BE REMOVED, THEY WERE NOT. 12 USC 1028A AGGRAVATED IDENTITY THEFT. WHOEVER DURING AND IN RELATION TO ANY FELONY VIOLATION ENUMERATED IN SUBSECTION ( C ) KNOWINGLY TRANSFERS, POSSESSES OR USES WITHOUT LAWFUL AUTHORITY, A MEANS OF IDENTIFICATION OF ANOTHER PERSON SHALL, IN ADDITION TO THE PUNISHMENT PROVIDED FOR SUCH FELONY, BE SENTENCED TO A TERM OF IMPRISONMENT OF TWO YEARS. 15 USA 1681 PERMISSIBLE PURPOSES OF CONSUMER REPORTS- ANY CONSUMER CONSUMER REPORTING AGENCY MAY FURNISH A CONSUMER REPORT UNDER THE FOLLOWING CIRCUMSTANCES AND NO OTHER ( WITH WRITTEN INSTRUCTIONS TO THE CONSUMER TO WHOM IT RELATES ). I GAVE NO SUCH PERMISSION! Consumer Complaint: After carefully reviewing my credit report, I found several violations of the Fair Credit Reporting Act. 15 U.S. Code 1681a - Definitions ; rules of construction section ( 2 ) Exclusions Except as provided in paragraph ( 3 ), the term consumer report does not include ( I ) report containing information solely as to transactions or experiences between the consumer and the person making the report. Late payments are considered to be a transaction. 15 U.S. Code 1666b - Timing of payments section ( b ) Grace period If an open end consumer credit plan provides a time period within which an obligor may repay any portion of the credit extended without incurring an additional finance charge, such additional finance charge may not be imposed with respect to such portion of the credit extended for the billing cycle of which such period is a part, unless a statement which includes the amount upon which the finance charge for the period is based was mailed or delivered to the consumer not later than 21 days before the date specified in the statement by which payment must be made in order to avoid imposition of that finance charge. 15 U.S. Code 6802 - Obligations with respect to disclosures of personal information ( b ) 1 ( b ) Opt out the consumer is given the opportunity, before the time that such information is initially disclosed, to direct that such information is not disclosed to such third party ( C ) the consumer is given an explanation of how the consumer can exercise that nondisclosure option. I was not given the option to opt out of having late payments post to my report. I currently show late payments of the following accounts : XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX I have made serval attempts to try to get this matter resolved. Further violation of my rights will result in legal actions. I also have a right to privacy.
