Consumer Complaint: In response to the the letter I received from Experian that states Pursuant to 611 ( a ) ( 3 ) ( A ) Experian says that they can not honor my request based on limited information. FCRA 611 ( a ) ( 3 ) ( A ) only states how I should provide official documentation in order to verify my identity. The issue is not me proving who I am but your unrefuted proof of a disclosure agreement between me, XXXX XXXX and Experian that has my wet signature on it that would be pursuant to FCRA section 604 ( 2 ) permissible purpose. Please stop giving me the run around and VERIFY that Experian is not committing consumer fraud. The FCRA prohibits ANY agency from furnishing a consumer report which may include credit information without written consent from the consumer in which it relates to. Pursuant to FCRA section 604 ( 2 ) Permissible Purpose ; FCRA 604 ( 2 ) states that a CLEAR and CONSPICUOUS disclosure be made in writing and also authorized with the consumer 's signature before any consumer nonpublic personal information can be disclosed. The term nonpublic personal information means personally identifiable financial information provided by a consumer to a financial institution ; resulting from any transaction with the consumer or any service performed for the consumer ; or otherwise obtained by the financial institution. Such term does not include publicly available information, as such term is defined by the regulations prescribed undersection 6804 of 15 USC 6809. Except as otherwise provided in 15 USC 6802 a financial institution may not, directly or through any affiliate, disclose to a nonaffiliated third party any nonpublic personal information, unless such financial institution provides or has provided to the consumer a notice that complies with section 6803 of 15 USC 6803. The consumer is given the opportunity, before the time that such information is initially disclosed, to direct that such information not be disclosed to such third party ; and the consumer is given an explanation of how the consumer can exercise that nondisclosure option. No such disclosure agreements exist. No where in the FCRA or in Section 611 ( a ) ( 3 ) ( A ) does it mention the that ANY agency can furnish a consumer report without permissible purpose. In closing Experian CAN NOT provide a DISCLOSURE between XXXX XXXX and Experian with my signature that would authorize permissible purpose in pursuant to Section 604 ( 2 ) of the FCRA because no so document exist, which in turn would be federal unlawful in compliance with the Fair Credit Reporting Act and EACH and EVERY consumer report that Experian furnished unlawful. This is consumer fraud. Due to the fact I was sent an email that suggested that Experian is well aware of FCRA regulations and adherent to all federal law, willingly and knowingly published and furnished unlawful consumer reports. 15 USC 1681 ( A ) ( B ) ( b ) explains how each of these FEDERAL VIOLATIONS should be handled according to and including each violation. In pursuant to section 15 USC 1681 ( i ) in the case of liability of a natural person for obtaining a consumer report under false pretenses or knowingly without a permissible purpose, actual damages sustained by the consumer as a result of the failure or {$1000.00}. Any person who obtains a consumer report from a consumer reporting agency under false pretenses or knowingly without a permissible purpose shall be liable to the consumer reporting agency for actual damages sustained by the consumer reporting agency or {$1000.00}, whichever is greater. Compensation is demand for each transaction. I, XXXX XXXX XXXX the natural person in good faith exercise my rights as a federally protected consumer. There never was a clear written disclosure nor authorization from me as the consumer and also as the natural person. Please provide the disclosure with my signature in agreement the would grant permissible purpose. For the damages that have been done to my mental distress and financial as I take my consumer report and my life very seriously I demand that you open all accounts in which adverse actions has taken place, remove and correct all derogatory marks from my consumer report ANY and ALL REPORTS FURNISHED UNLAWFULLY WITHOUT PERMISSIBLE PURPOSE. In pursuant to Section 15 USC 1681 ( A ) ( B ) ( b ) to be compensated accordingly for each inquiry, transaction and report made in regards to this matter and is a direct violation of federal law. Please correct all inaccuracies promptly and in a lawful manner. If my demands for proof of permissible purpose can not be meet please correct your errors, and if Experian continues to infringe on my federal consumer right, I will take this to the fullest extent of the law. Consumer Complaint: According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' XXXX and Experian are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states '' It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' ( Furnisher of information to credit agencies ) is a financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' ( Furnisher of information to credit agencies ) the financial institution and the Consumer reporting agencies XXXX, XXXX and Experian do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, XXXX, Experian, ( Furnisher of information to credit agencies ) whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' ( Furnisher of information to credit agencies ) Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX, XXXX and Experian are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services
