Issue: Cont'd attempts collect debt not owed
Subissue: Debt is not mine
Consumer Complaint: Over the course of the past year, I have received numerous calls from ERC ( a debt collection agency ) about an unpaid XXXX phone bill in the amount of {$480.00}. This debt was incurred by someone living in a different area of XXXX, Fl. Inspite of my denial of being the responsible party, my stating my address ( at which I have lived for the past 30 yrs ), and providing the last 4 digits of my SSN, they persisted in calling. AT NO TIME did I receive any written notice of debt. While checking my credit score I noticed that my XXXX credit score had dramatically fallen. Upon further investigation, I discovered that ERC had filed a collection notice with XXXX. I disputed this action with XXXX and the XXXX ( XXXX ). XXXX backed ERC. The XXXX investigated and found in my favor. ERC sent a letter to the XXXX basically saying oops its not our fault. To this date I have not heard a peep from ERC

Subissue: Debt resulted from identity theft
Consumer Complaint: XXXX XXXX was the original owner of this collection which showed up on my credit report 2 months ago as being opened in 2011. This is not my account. I filed a police report and provided XXXX and XXXX XXXX a copy. XXXX XXXX removed it from my XXXX account a week ago, sold the collection to Enhance Recovery and as of 2 days ago, started reporting under XXXX. I am assuming as soon as they remove it from XXXX, they will report it to XXXX. They are playing games knowing this was an identity theft and a police report has been provided.

Subissue: Not given enough info to verify debt
Consumer Complaint: I am unaware when this debt occured. I contacted the company several time and even settled the debt with the XXXX party vendor whow stated it would clear from my account in 30-90days. It has been over a year. After numerous attempts of contacting the company, all I can think is that this is a scam or fraud. I have paid and have requested for it to be removed several times. I would like disclosure of verification of debt still owed.

Consumer Complaint: I am wanting to make sure that this debt is being reported accurately on my credit report. On XXXX/XXXX/16, I sent a 2nd request for validation of debt via traceable mail. The letter was received on XXXX/XXXX/16. On XXXX/XXXX/16 a dispute letter was sent to XXXX to challenge the validity of the debt and make sure it was reporting 100 % accurate. On XXXX/XXXX/16 Enhanced Recovery Corp responded to the XXXX dispute with a statement " Verifying '' the account and it 's correct and accurate reporting. The Fair Debt Collection Practices Act clearly states that collection agencies MUST cease all collection activities until they provide validation of debt, once a consumer request is received. By them verifying the debt with Equifax without validating the debt, they violated the FDCPA. Furthermore, Enhanced Recovery Corp failed to report the item as " in dispute '' with XXXX..which is another violation of the FDCPA.
