Consumer Complaint: Dear CFPB, I'm writing to update you on my ongoing credit report dispute with Equifax, XXXX XXXX XXXXXXXX regarding inaccurate information. Unfortunately, despite filing my initial dispute last XX/XX/2023 and exceeding the 30-day timeframe outlined in the FCRA, I have not received any response or update from the bureau ( s ). The continued presence of this inaccurate information continues to cause me significant harm and hurting my credit credibility I urge the CFPB to take immediate action and : 1. Investigate the bureau ( s ) ' non-compliance with the FCRA. 2. Demand a prompt and thorough investigation of my disputed information. 3. Hold the bureau ( s ) accountable for the delay and any harm caused. 4. Ensure the immediate removal of the inaccurate information from my credit report if verified. However, these assertions directly conflict with the undeniable inaccuracies in critical details such as open dates, dates of last activity, and other pivotal elements. Under 15 U.S.C. 1681i ( 5 ), these agencies are unequivocally mandated to rectify inaccurately reported accounts. Moreover, under 15 U.S.C. 1681s-2 ( A ) ( 1 ), any entity is explicitly prohibited from furnishing inaccurate information to consumer reporting agencies when knowledge or reasonable cause exists of such inaccuracies. The ramifications of these inaccuracies extend beyond mere data errors. They significantly impact crucial credit ratios, such as the length of credit history, debt-to-credit utilization, and misrepresented balances, consequently impeding my ability to secure credit. These inaccuracies are an infringement of my rights and impair my capability to obtain fair access to credit opportunities due to misrepresented and flawed data. Additionally, it is crucial to note that while other bureaus could not verify these accounts, they inexplicably remain on the reports of these agencies. This incongruity is perplexing, as all bureaus are expected to follow similar verification processes. The persistence of these inaccuracies across multiple reporting agencies underscores a systemic issue that requires urgent attention. I implore the Consumer Financial Protection Bureau ( CFPB ) to investigate this matter promptly and take decisive action against the entities responsible for their failure to adhere to federal regulations to safeguard consumer rights. Rectifying these inaccuracies is essential to restore the integrity of the consumer reporting system and ensure fair access to credit for individuals. Consumer Complaint: I am writing to formally contest the accuracy of information contained in my consumer report, as provided by your agency. Upon careful review, I discovered that undisclosed personal information about me has been shared with a non-affiliated third party without my explicit written consent. This apparent violation raises concerns regarding my privacy rights and appears to be in contravention of the regulations outlined in 15 U.S. Code 6802 - Obligations with Respect to Disclosures of Personal Information. As per my understanding of the Fair Credit Reporting Act ( FCRA ), I possess the right to be informed about and control the disclosure of my personal information. The disclosure to a non-affiliated third party raises red flags, as I was never given the opportunity to exercise my right to opt-out, as mandated by law. Upon closer examination of the report, it has come to my attention that specific accounts are being reported without my explicit written consent. It is imperative to clarify that my dispute is not with the creditor but with your reporting agency for disseminating and reporting information without proper authorization. I refer to 15 USC 1681b - Permissible Purpose, which explicitly requires a consumer 's written consent for the reporting of personal information. As of now, I have not granted such written consent, and I kindly request documentation to substantiate my consent, demonstrating compliance with this legal requirement. Failure to furnish evidence of my consent could be construed as a violation of my rights under the FCRA. Additionally, I have filed a report with the Federal Trade Commission ( FTC ) concerning this matter, and the reference number for my complaint is XXXX.
