Issue: Problem with a company's investigation into an existing problem
Subissue: Their investigation did not fix an error on your report
Consumer Complaint: On XX/XX/ I FILED CFPB COMPLAINT AGAINST XXXX ON XXXX XXXX AND XXXX XXXX XXXX AND CITED In XXXX XXXX I called XXXX XXXX XXXX ( A collection company ) requesting validation of the alleged debt on my credit report by producing the original contract with a wet ink signature. Additionally I sent letters to XXXX, Equifax, and XXXX requesting validation of the alleged debt. In response, XXXX XXXX XXXX sent a letter dated XXXX XXXX XXXX wherein they confirmed an outstanding balance, however they have failed to validate the debt by producing proof of the original contract with wet ink signature. The credit reporting agencies mentioned notified me the debt was " verified '' but failed to outline investigation procedures as requested or produce proof of the original contract. XX/XX/ I mailed Equifax, XXXX, and XXXX demanding the unverified items be removed from my credit report immediately. They have yet to do so and claim XXXX XXXX has continued to verify the debt. Additionally, I am still receiving mailed statements from XXXX XXXX services despite the fact that I have yet to be sent proof of the original contract for this alleged debt. This company is in direct violation of 15 U.S.C. 1692 ( c ), U.S.C 1692 f ( 1 ), AND U.S.C. 1692 ( g ).

Consumer Complaint: Ive noticed that several deviations from mandatory reporting standards therefore the data in my report can not be accurate and complete! With that said, I deny your allegations and I challenge you to provide proof that you have the right to report this incomplete negative information on my credit report. Per 15 U.S.C 1681e Whenever a consumer reporting agency prepares a consumer report it shall follow reasonable procedures to assure maximum possible accuracy of the information concerning the individual about whom the report relates. According to 12 CFR Part 1022 ( Regulation V ) requires furnishers to : Furnish information concerning accounts or other relationships with a consumer that has integrity. Furnish information about accounts or other relationships with a consumer that is accurate. C - Conduct reasonable investigations of consumer disputes According to XXXX, in order to make a lawful report, you must follow the Metro 2 compliance standards. Also as stated in the XXXX Any Deviation From These Standards Jeopardizes The Integrity of The Data. This means that any mistakes in reporting claims can make the information less accurate and it affects the accuracy of any federally regulated reports. Therefore, I am invoking my rights to challenge these inaccurate and non-compliant items. Neglecting my demand will only prove that you DO NOT care about my rights as a consumer. Its NOT FAIR for you to report information that isnt confirmed to be ethical and meets the standards of certified reporting. Again, I am challenging these claims and asking for proof of the proper reporting standards. You are violating my rights! I have listed the concerns about your reporting in this document. It's not complete and does not meet my standards according to law, you must certify all aspects of required FCRA/ Metro 2 compliance which is done truthfully, correctly ( in a timely manner ), completely AND accurately as well - or else I would have to escalate these issues to the CFPB , FTC and my Attorney General.

Consumer Complaint: 15 USC 1681 a ( d ) ( 2 ) ( A ) ( i ) clearly states that transactions between the consumer and the Person/Corporation making the report is NOT included on the consumer reports. Yet XXXX, XXXX XXXX Equifax is reporting this information. The reporting of excluded information pursuant to 15 USC 1681 a ( d ) ( 2 ) ( A ) ( i ) on a consumer report is a clear violation of Metro2 compliance. Provide me with the Metro2 compliance disclosure on reporting transactions to a consumer reporting agency. I need the transactions reporting as late, collection/charge-off status and any other derogatory information deleted from my consumer reports effective immediately. Before you think to reply that this account has been validated, lets be clear that I am not asking you to validate or verify anything. So please do not respond by telling me that as a tactic to waste my valuable time. Some of the negative accounts have been placed in Collection/Charge-Off Status WITHOUT mailing me a copy of IRS form 1099-C Cancellation of Debt. XXXX, XXXX, Equifax and the creditors reporting collections/Charge-Offs, late payments/other derogatory information in my consumer report are in violation of 26 USC ss 6050P Returns Relating to the Cancellation of Indebtedness By Certain Entities. If this derogatory account information is not deleted from my consumer reports within 30 days, I will be forced to officially file IRS form 3949A : Information Referral AND IRS form 211. Application For Award Original Information Overview with the Internal Revenue Service against ALL entities involved.

Upon the first notification last year I began noticing accounts, loans and different inquiries on my credit reports that were not mine I also noticed charges to my accounts that were not made by me. I reached out to these companies and credit bureaus making them aware that all my personal data, personal information including address and social security number and banking information was taken within the span of several years from several different branches one from a medical company where my information was stolen and another from my mortgage company XXXX XXXX. I told them I did not know who used my personal information without my permission to open an account and make purchases with these accounts the debts are not mine. I have enclosed proof of my identity and a copy of my FTC Identity Theft Report to these companies several times I also have a police report now. In accordance with the Fair Debt Collection Practices Act, I am asking you to stop collection proceedings against me and stop communicating with me about this debt, except as the Fair Credit Reporting Act allows. I also ask that you notify [ the business where the account was opened ] and tell them the debt is the result of identity theft. Delete : Account : XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Delete all non-account inquiries as I did not authorize these inquiries and they were done without my authorization. Also I provided proof of documents that I feel are important especially if the companies like XXXX are saying they verified me by information but they also said they verified another person via information yet this person does not reside with me nor have I ever heard of this name but they mailed out a letter to my house with this person 's name on it saying they verified them, they need to remove all accounts from my credit report asap.
