Consumer Complaint: According to the Fair Credit Reporting 602. Congressional findings and statement of purpose [ 15 U.S.C. 1681 ] ( a ) Accuracy and fairness of credit reporting. The Congress makes the following findings : ( 1 ) The banking system is dependent upon fair and accurate credit reporting. Inaccurate credit reports directly impair the efficiency of the banking system, and unfair credit reporting methods undermine the public confidence which is essential to the continued functioning of the banking system. ( 2 ) An elaborate mechanism has been developed for investigating and evaluating the credit worthiness, credit standing, credit capacity, character, and general reputation of consumers. ( 3 ) Consumer reporting agencies have assumed a vital role in assembling and evaluating consumer credit and other information on consumers. ( 4 ) There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumer 's right to privacy. ( b ) Reasonable procedures. It is the purpose of this title to require that consumer reporting agencies adopt reasonable procedures for meeting the needs of commerce for consumer credit, personnel, insurance, and other information in a manner which is fair and equitable to the consumer, with regard to the confidentiality, accuracy, relevancy, and proper utilization of such information in accordance with the requirements of this title. XXXX, Equifax and XXXX are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information is not shared. It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. 15 USC 6801 ( a ) Privacy obligation policy It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' You may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. I was never informed of my right to exercise my nondisclosure option. 15 USC 1681C ( a ) ( 5 ) Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information. Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681a - Definitions ; rules of construction The term consumer reporting agency means any person which, for monetary fees, dues, or on a cooperative nonprofit basis, regularly engages in whole or in part in the practice of assembling or evaluating consumer credit information or other information on consumers for the purpose of furnishing consumer reports to third parties, and which uses any means or facility of interstate commerce for the purpose of preparing or furnishing consumer reports. The term consumer means an individual. The term consumer report means any written, oral, or other communication of any information by a consumer reporting agency bearing on a consumers credit worthiness, credit standing, credit capacity, character, general reputation, personal characteristics, or mode of living ( 2 ) Exclusions ( A ) ( i ) report containing information solely as to transactions or experiences between the consumer and the person making the report ; Reporting Transaction history is illegal Remove all transaction history from my consumers report immediately. Additionally remove : ( 1 ) All other names you have from my consumer report that are not XXXX XXXX. ( XXXX ) All addresses that are not XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX They are non-mailable addresses. ( XXXX ) All phone numbers that are not XXXX. I can not receive calls on them. ( XXXX ) All comments from the personal statement section. ( XXXX ) All employers in the Employer section. That information is not accurate I am going to attach a copy of my most recent consumer report detailing the accounts you are reporting with transactions. I expect you to mail me an updated copy of my consumer report with this matter rectified. 15 U.S. Code 1681e - Compliance procedures ( a ) Identity and purposes of credit users Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. These procedures shall require that prospective users of the information identify themselves, certify the purposes for which the information is sought, and certify that the information will be used for no other purpose. Every consumer reporting agency shall make a reasonable effort to verify the identity of a new prospective user and the uses certified by such prospective user prior to furnishing such user a consumer report. No consumer reporting agency may furnish a consumer report to any person if it has reasonable grounds for believing that the consumer report will not be used for a purpose listed in section 1681b of this title. ( b ) Accuracy of report Whenever a consumer reporting agency prepares a consumer report it shall follow reasonable procedures to assure maximum possible accuracy of the information concerning the individual about whom the report relates. By violating section 1681b for permissible purpose and 1681c for information contained in consumer reports you are also violating compliance procedures under this title. Remove those Inquiries from my consumer report!! 15 U.S. Code 1681n - Civil liability for willful noncompliance ( a ) In general Any person who willfully fails to comply with any requirement imposed under this subchapter with respect to any consumer is liable to that consumer in an amount equal to the sum of any actual damages sustained by the consumer as a result of the failure or damages of not less than {$100.00} and not more than {$1000.00} ; or in the case of liability of a natural person for obtaining a consumer report under false pretenses or knowingly without a permissible purpose, actual damages sustained by the consumer as a result of the failure or {$1000.00}, whichever is greater ;

Consumer Complaint: I sent a letter regarding inaccurate and unknown things on my credit report. To this day over 30 days later I have not received a response yet. I feel like I'm being taken advantage of and being ignored of my disputes. Section 611 ( a ), it is plainly stated that a failure to investigate these items within 30 days gives a reason to immediately remove those items from my credit report it has been over 30 days so they should be deleted promptly. I demand these accounts be deleted immediately or I will file for litigation due to the stress you caused me. My information was also impacted by the Equifax, XXXX and XXXX data breach and may have got into the hands of the wrong person.

Consumer Complaint: I have reached out to Equifax for over 3 years now attempting to have my credit file Opened. I have been denied loans because the creditors are unable to access my credit file. Each time I call I am told that if I send a copy of my drivers license and social security number this issue will be resolved. On my recent call to Equifax I was told that they had the incorrect date of birth on file and that was the reason it was locked.I sent a copy of my drivers license and social and the issues still remains. When I login to the Equifax website there is no report to view but the account says that my credit file is not locked. I have been contacting Equifax for years to have this resolved and no one seems to be able to fix the issue.
