Consumer Complaint: Re : Request for Removal of Unauthorized Inquiries and Account from Credit Report Dear EQUIFAX Consumer Assistance, I hope this letter finds you well. I am writing to bring to your attention a serious matter concerning unauthorized inquiries and the addition of an unauthorized account on my credit report. This breach of privacy has raised significant concerns regarding identity fraud and the violation of my rights under both Texas state laws and federal regulations. It has come to my attention that certain creditors have accessed my non-personal information without my consent. This blatant breach of privacy is not only unethical but may also constitute identity fraud, a matter of utmost concern. I am particularly troubled by the unauthorized addition of an account to my credit report, an action I did not authorize. Even in situations where a permissible purpose exists, it is essential to emphasize that the consent of the consumer is still required. I want to make it unequivocally clear that I did not provide consent for the creditors in question to access my personal information or add an account to my credit report. This violation of my privacy rights is unacceptable, and I demand immediate corrective action. To address this issue effectively, I kindly request the removal of all unauthorized inquiries and the associated account from my credit report. I believe that taking prompt action to rectify this situation is crucial not only for my financial well-being but also for upholding the principles of privacy and consumer protection. In accordance with Texas state laws, I would like to draw your attention to the following codes that pertain to the protection of consumer rights : Texas Finance Code, Title 3, Subtitle B, Chapter 392 Consumer Credit Commissioner Texas Business and Commerce Code, Title 1, Subtitle C, Chapter 35 Fraudulent Transfers Additionally, I urge you to consider the federal laws that support my case : Fair Credit Reporting Act ( FCRA ), 15 U.S.C. 1681 Fair and Accurate Credit Transactions Act ( FACTA ), 15 U.S.C. 1681m I expect that EQUIFAX, as a reputable credit bureau, will take swift and decisive action to rectify this breach of privacy. Your cooperation in this matter is crucial to maintaining the integrity of consumer credit reporting and protecting the rights of individuals. I anticipate a thorough investigation into this matter and request written confirmation of the removal of unauthorized inquiries and the associated account from my credit report within 30 days of receiving this letter. Thank you for your immediate attention to this matter. I trust that EQUIFAX will uphold its commitment to consumer rights and privacy. Sincerely, XXXX XXXX

Consumer Complaint: My credit report is littered with negative items. I have attempted to call and REPEATEDLY write XXXX, Equifax, XXXXXXXX XXXX XXXX and XXXX XXXX requesting that each of these private companies remove the numerus and violations of my privacy, as well as infringement on my rights of liberty and enjoyment for the better part of a year. These derogatory items have negatively and grossly impacted my life, causing me to be denied apartment rentals, denied consumer credit cards and other lines of credit. At no point have I EVER given any secondary or third party reporting agencies written permission to add these unfounded derogatory items to my report. Per the Fair Credit Reporting Act 15 USC 1681 section 602 a, " there is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' Equifax and XXXX are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared which, by the way is backed by 15 USC 6801 which also states that " It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX are all financial institutions by definition under that title. Additionally, 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. 'XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX are the financial institutions and the Consumer reporting agencies, specifically XXXX, Equifax and XXXX DO NOT have my consent to furnish this information and they most certainly do not have my expressed written consent. Any and all consent to XXXX, Equifax and XXXX, ( Furnisher of information to credit agencies ) whether it be verbal, non-verbal, written, implied or otherwise is revoked. Furthermore, according to 15 USC 6802 ( b ) ( c ), " a financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless, the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX at no point was I informed by any of these bureaus ( XXXX, Equifax nor XXXX XXXX of my right to exercise my nondisclosure option. Additionally, per 15 USC 1681c ( a ) ( 5 ), " except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information : Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' These numerous, fraudulent and derogatory accounts on each of these credit bureau, consumer credit reports are clearly adverse items that are reported and once more, the bureaus are reporting them without my permission which is a violation of the law and several of my rights. Furthermore, 15 U.S. Code 1681s2 ( a ) ( 1 ) a states that a person " shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. Also, 15 U.S. Code 1681e states that " every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of, section 1681c of this title and to limit the furnishing of consumer reports for the purposes listed under section 1681b of this title. XXXX, Equifax and XXXX are clearly not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. I am definitely opting out of your reporting services.

Consumer Complaint: I have already sent a letter addressing the inaccuracies and unknown items on my credit report, but unfortunately, I have not received any response even after 30 days. It feels like I'm being taken advantage of and my disputes are being ignored. According to Section 611 ( a ), if these items are not investigated within 30 days, they should be promptly removed from my credit report. Since it has been over 30 days, I expect these accounts to be updated immediately. If not, I will have no choice but to pursue legal action due to the stress this situation has caused me. Additionally, my information was also affected by the Equifax, XXXX, and XXXX data breach, which raises concerns about the security of my personal data.
