I put a freeze on my credit report as soon as I was informed in writing. Yet XXXX is reporting this information.. The reporting of excluded information pursuant to 15USC 1681 a ( d ) ( 2 ) ( A ) ( i ) on a consumer report is a clear violation of Metro2 compliance. Provide me with the Metro2 compliance disclosure on reporting transactions to a consumer reporting agency. I need the transactions reporting as late, collection/charge-off status and any other derogatory information deleted from my consumer reports effective immediately. Before you think to reply that this account has been " validated ', let 's be clear that I am not asking you to validate or verify anything. So please do not respond by telling me that as a tactic to waste my valuable time. Some of the negative accounts have been placed in Collection/Charge-Off Status WITHOUT mailing me a copy of IRS form 1099-C Cancellation of Debt. XXXX and the creditors reporting collections/Charge-Offs, late payments/other derogatory information in my consumer reports are in violation of 26 USC ss 6050P Returns Relating to the Cancellation of Indebtedness By Certain Entities. Furthermore the information regarding the account with XXXX XXXX XXXX does not match up across all 3 credit Bureas for instance XXXX AND EQUIFAX says that this account with XXXX XXXX XXXX is an installment account while XXXX says it is a secured loan this a violation of 15usc 1681b reasonable procedures it is required by all consumer reporting agencies to report information which is fair and equitable to me the consumer in regards to accuracy and confidentiality. Consumer Complaint: I am writing to file a formal complaint against Equifax for violations of my rights under the Fair Credit Reporting Act ( FCRA ) and the Georgia Fair Business Practices Act ( FBPA ). I request your intervention to investigate this matter and take appropriate action to rectify the errors on my credit report and provide compensation for the damages I have suffered. **Reason for Dispute : ** This complaint arises from the inaccurate information on my credit report. **Letters to Credit Agencies : ** I have sent multiple letters to Equifax disputing the errors on my credit report and requesting corrections or deletions. Enclosed are copies of the letters submitted to dispute these inaccuracies. **Response from XXXX XXXX ** Despite my efforts, I have consistently received responses from Equifax stating that they have investigated the dispute and verified the accuracy of the information on my credit report. They have failed to provide any evidence or explanation to support their conclusion, and they have not adhered to the FCRA 's requirement to notify me of the investigation results within 30 days. **Injury and Damages : ** As a result of Equifax willful misconduct, wrongful acts, misleading misrepresentation, and unfair practices, I continue to face mental agony, distress, and economic loss. I believe I am entitled to monetary and compensatory damages. **Violations of Laws : ** Equifax 's actions have violated the FCRA and the FBPA, which mandate the provision of accurate and complete information to consumer reporting agencies and correction or deletion of erroneous or unverifiable information. Additionally, they have failed to comply with federal and state consumer protection laws and regulations, including but not limited to the Federal Trade Commission ( FTC ), Consumer Financial Protection Bureau ( CFPB ), Deceptive Business Practices Act, Consumer Protection Act, and the Fair Debt Collection Practices Act ( FDCPA ). **Obligatory Duty to Comply with Consumer Laws : ** Equifax is obligated to comply with the provisions of federal and state laws, yet they have failed to do so, violating 15 U.S.C . 1692a and other relevant statutes. **Documentary Evidence : ** Despite repeated requests, Equifax has failed to provide documentary evidence, including a certified copy of the alleged loan agreement, all bookkeeping journal entries associated with the alleged loan agreement, and an affidavit in rebuttal. This is a clear violation of 15 U.S.C. 44. **Enclosures : ** -Copies of the last four letters sent to Equifax. -Credit report with highlighted inaccuracies. -Police report confirming identity theft. -Proof of victimization in the Equifax data breach. All of which was sent to Equifax with each round of letters that was sent via certified mail. -IN ADDITION TO EQUIFAX KNOWING THAT I WAS A VICTIM OF THEIR DATA BREACH THEY HAVE MADE NO EFFORT TO ASSURE ACCURACY OF MY CONSUMER PROFILE. THEY HAVE REFUSED TO PROPERLY INVESTIGATE THESE ACCOUNTS. In conclusion, I request your prompt investigation into this matter, correction of the inaccuracies on my credit report, compensation for damages, and appropriate action against Equifax for their persistent violations of consumer protection laws.
