Issue: Incorrect information on your report

Subissue: Account information incorrect

Consumer Complaint: Discover Financial Services is reporting each month that I am at 98 % of my credit limit, yet they charged off this account in XX/XX/2016. Discover sent me a tax statement that they sent to the Federal Government that states this amount is no longer on my account, yet they continue to report this to all three credit agencies every month. This has resulted in an incorrect reporting of my account to Discover. I do not have an open account with a balance at 98 % of my limit with Discover, they closed the account in 2016, and charged off the amount, receiving a credit on their Corporate taxes in the full amount they claim I still owe them each month. Discover is incorrectly reporting the status of this account, and it should be immediately changed. My credit report reflects again this month that my balance in 98 % of my limit. How can I be at 98 % of my credit limit when there is not longer an account open? How can Discover claim an amount that they charged off and received credit for by the Internal Revenue Service of the United States? I want Discover to change this notification to my credit report that states the amount was charged off in XX/XX/2016, and that there is no longer a balance owed on this account.

Issue: Attempts to collect debt not owed

Subissue: Debt was paid

Consumer Complaint: Discover Credit Services has submitted a legal tax document to the Federal Government that states a debt they allege I owe, was " Cancelled. '' In spite of this notification to IRS, Discover continued to try and collect this debt from me. Every month Discover Credit Services notifies all three of the Credit Agencies that I am at 98 % of my credit limit. Incorrectly reporting this status, while telling a Federal Agency that they cancelled the debt. This is a violation of Federal Statute. I have enclosed the Statement that Discover sent to The Department of the Treasury, Internal Revenue Service.

Issue: Took or threatened to take negative or legal action

Subissue: Sued you without properly notifying you of lawsuit

Consumer Complaint: Filed a previous complaint XX/XX/2020 for Discovercard sending a postdated threat of legal action/lawsuit if I did not pay by the postdated date stating in the threatening letter sent to me. I did go on to make payment arrangements with them on the premise that I was told in a recorded conversation that if I had difficulty making this monthly payment that they would work with me. When in fact I did need them to work with me because I was trying to get back into the workforce to be able to meet the payments, I was yelled at by a Discover debt recovery representative, and also threatened. I have now learned they have a lawsuit pending against myself tbrough XXXX XXXX XXXX. I was not served for the pending lawsuit, or informed or sent a summons to this date of today. Discover gave me a phone number to call XXXX XXXX XXXX that is not a working number, and just answers and hangs up, leaving no way to reach XXXX XXXX XXXX. to try to resolve the matter.

Issue: Problem with a purchase shown on your statement

Subissue: Credit card company isn't resolving a dispute about a purchase on your statement

Consumer Complaint: A merchant, XXXX issued a credit of {$34.00} to my Discover card XXXX on XX/XX/21. I received an email confirmation from XXXX of this transaction on XX/XX/21. XXXX XXXX is a closed account, so Discover has to transfer the credit to my current account, but is unwilling to do it. I made two formal complaints with CFPB XX/XX/21 and XX/XX/21 regarding this issue. Discover 's response to the first complaint was that they didn't have a record of my having card XXXX, so they couldn't return my money. Discover 's response to the second complaint is that they do have a record of card XXXX, but there is no credit of {$34.00}. I have confirmed with XXXX on two different occasions, XX/XX/21 and XX/XX/21 that the credit was issued to Discover card XXXX since XX/XX/21, so it does not make sense that Discover does not have the credit. Discover 's policy is that they transfer credit from closed accounts to current account within 72 hours. This has not been my experience with Discover. They have never transferred credit from a closed account to a new account within 72 hours. I have always had to call in to initiate the transfer process after waiting for a month without any action from them. If I didn't call, I would not have received the credit. Discover continues with this deceptive practice to avoid crediting consumer 's account. My credit has been with Discover for two months and it still has not been transferred. I called the merchant twice regarding this matter, each time they confirmed the credit was issued to card XXXX on XX/XX/21. This leads me to question Discover 's conclusion that they don't have the credit in their system. In addition, I wonder if Discover ever called XXXX during their investigation.

Issue: Fraud or scam

Subissue:

Consumer Complaint: I requested an international wire transfer with my bank, Discover card, on the following dates, XX/XX/XXXX for XXXX and XX/XX/XXXX for XXXX. On XX/XX/XXXX, I found out I was scammed so I called Discover card that I was scammed with those amount. I asked the lady on the phone is there anything we can do to reverse or cancel the transaction. She apologized there is nothing that the bank can do since the money had been wired out. On XX/XX/XXXX, I found out from another bank that all bank does swift recall meaning the sender bank can reach out to the recipient bank and put a freeze on the amount that was transferred. So I called back to Discover card and requested a swift recall on those amount since it was a scam. I am upset because the swift recall could have been done a lot sooner and the lady on the phone was not genuinely concern that I had been scam. This delay the dates on the recall by 3 business days and this allow the recipient to withdrawn the money from the account. I am also upset that the lady was not aware of such recall exists and that the transaction can be freeze instead I was told there is nothing that the bank can do. The lady who helped me was not knowledgeable about the recall and she was clearly incompetent at her job especially such a large amount of money XXXX total was involved.

I was set to go on a trip in XXXX of XXXX, they initially re-scheduled my trip to XX/XX/XXXX. During the Pandemic, the company of XXXX XXXX XXXX filed for Insolvency. I was informed to reach out to the Credit Card to file a dispute. Which I did, multiple times. Issue: Trouble using your card

Subissue: Can't use card to make purchases

Consumer Complaint: On XX/XX/XXXX, Discover froze my secured credit card for no reason. They claim something about the IRS. The email they sent me looks like a scam. Not from them. They refuse to let me use my card again without filling out an emailed form which is password protected. They have the password and so far refuse to release it. They stole {$500.00} from me and I want my money back. Their telling me to fill out their password locked info that I can't do or wait three plus months for my deposit back.

Issue: Closing your account

Subissue: Company closed your account

Consumer Complaint: I requested Discover to cease communication of a billing error of nonmailable matter per 39 USC 3001 ( d ) 39 USC 3005 ( a ) ( 3 ) and regarding the sharing of my information with third parties per 15 U.S.C. 1692c ( b ) in accordance to my right of privacy and confidentiality. Discover closed my card account alleging that they received a cease communication notice by me, the consumer, and took it upon themselves to take adverse action to close my account without my consent in violation of Title 15 USC 1692c ( c ) without notifying consumer. The good faith right to Cease communication does not include closing account without consent of the consumer and further appears to be a deliberate violation of 12 CFR 1026.13 ( d ) ( 3 ) Acceleration of debt and restriction of account prohibited. A creditor shall not restrict or " close a consumer 's account solely because the consumer has exercised in good faith rights provided by this section. A creditor may be subject to the forfeiture penalty under 15 U.S.C. 1666 ( e ) for failure to comply with any of the requirements of this section. Discover has not complied with alleged cease communication notice and continues to report consumer credit transactions without my consent to third parties and appears to continue sending nonmailable matter as mail fraud ( see attached USPS mail receipt ). Discover has refused to reinstate account and continues to harass me indirectly via consumer reporting agencies despite their fraudulent act. There is not one law that states a credit or insurance transaction are required to be reported without consumer consent as expressed by congressional findings 15 U.S.C. 1681 ( a ) ( 2 ) An elaborate mechanism has been developed, ( 3 ) Consumer reporting agencies have assumed a vital role. Discover has deprived me of my right to credit illegally without 15 U.S. Code 44 documentary evidence and verification ( sworn statement ) as Constitution for United States of America 4th amendment compliance for seizure for property. I authorize Discover and The Bureau to proceed with this complaint.
