I didnt open this account my identity and information was taken over and have caused me emotional distress and problems of this company dont remove this from my credit report and from under my name I will look into legal ramifications. Further, I certify that I am permitted by FEDERAL and STATE LAW to file this dispute. I also understand that knowing and willful misstatements or omissions of material facts constitutes a FEDERAL CRIMINAL VIOLATION punishable under 18 USC 1001. Additionally, these misstatements are punishable as perjury under 18 usc 1621. This collection found within my credit report are not related to any transaction that I made. I am alleging that a person or company -without my authorization- used my personal identifying information to apply for goods, services or money and was successful in creating some accounts. The Summons Was Sent XX/XX/2023 Regarding A Card with XXXX XXXX XXXX XXXX. I Honestly Don't Know Of Any Debt With Them And Never Recieved Coorespondence Before I Moved. I Also Never Recieved Proof Of Ownership Of The Debt.They Filed The Lawsuit With Superior Court Of New Jersey Law Division ( Civil Glassboro ). They Have Sued Me In The Pass In My Twenties For An Very Old Debt And Had My Pay Docked .They Are Known For Filling Up Court Rooms With Residences Of XXXX XXXX XXXX XXXX And XXXX XXXX Who Don't Know Their Rights And Getting Money From Ppl Who Don't Have It. I Even Answered The Summoms XX/XX/2023 To Require Proof And They Just Answered Back With Interrogation Documentation. I'm A Single Mom Now Going To Court To Defend Herself Because I Can't Afford Legal Representation Because Of These Preditory Tatics And It's Really Troubling For Me.

Consumer Complaint: I have been monitoring my credit report closely in attempts to better my financial situation. I noticed a NEW account that states it was Opened in XX/XX/2023. The company XXXX XXXX is reporting an old account that to the best of my knowledge was closed as I attempted to make payments on this account over a year ago and the website ( XXXX ) stated my account was closed. I do not recall receiving any information regarding this account since then. I assumed the account was closed. They have recently added this as a collection with no notice. I have attempted to dispute this with the credit reporting agencies. I believe they are trying to RE-age this debt. Also I believe the total amount is incorrect.

Under 15 USC 1681 section 602 states I have the right to privacy. 15 USC 1681 section 604A section 2 it also states a consumer reporting agency can not furnish an account without my written instruction, under 15 USC 1666B a creditor may not treat a payment on credit card account under an open and consuming credit plan as late for any purpose.

Consumer Complaint: Comenity is purposely misleading and lying to the consumer about Terms of closing a account, the obligations, and create gaps to ensure that the consumer will have to pay more even after account is closed. It small amounts that they charge. But over the total consumer population size. It drastically most likely brings more money in. In XXXX. I paid the full amount to close the account out. Comenity said there was nothing left to do. XXXX I got an email from Comenity XXXX XXXX that I owed a late fee. Already this contradicts what they said to me in XXXX XXXX I called the rep after seeing this email. The rep said she was waving the fee and nothing further needed to be done. ( But when I called in XXXX there was not record of this ) Now in XXXX i get another email This time the amount has gone up. They also charged me interest fee. on top of this XXXX dollar fee plus late fee on top of this late fee. I mean when an account is closed it is closed. And they have lied on multiple steps. Researching on the web this has been a thing the XXXX XXXX has done to many other consumers. Also if you pay the amount due by the date and time, which they say they honor. It is nor processed. They will apply the orginal amount and top the interest amount of that. It is really seriously evil credit card tactics. And definitively need to be investigated. It is really petty theft that in turn is completely taking advantage of consumer

Consumer Complaint: On XX/XX/XXXX, we used a AAA Comenity Bank Visa card to pay for a large medical bill, which was approved. On XX/XX/XXXX, I logged into our account online and changed the automatic payment amount from " Statement Balance '' to " Minimum '' to allow us to move money from other accounts to pay the balance at a later date. When initially setting up the automatic payments, there was a warning that setting it up could take 1 to 2 billing cycles, but there was no clear warning about making changes once autopay was setup. On XX/XX/XXXX, AAA Comenity Bank withdrew the full statement balance of {$12000.00} from our bank account instead of the minimum payment I had requested, overdrawing our accounts on XX/XX/XXXXXXXX XXXX XXXX XXXXXXXX couldn't stop the transfer and Comenity Bank couldn't either. The representative from Comenity suggested having the bank refuse payment, which would return the funds to our account but incur a {$28.00} fee. I was told that a second attempt to withdraw the funds would happen that same day but our bank would not process the payment. The Comenity Bank representative instructed me to contact them on XX/XX/XXXX to make a partial payment instead after the funds were returned. On XX/XX/XXXX, I terminated ALL automatic payments for Comenity Bank and received confirmation via email. On XX/XX/XXXX, Comenity Bank withdrew {$12000.00} from our bank again in spite of our telephone conversations and my online activity to prevent it. This time, there were fund necessary to cover the transfer, but those funds were earmarked for other payments. On XX/XX/XXXX, I contacted Comenity Bank to have the transfer cancelled as I withdrew my consent and was told that because of the amount, returning the funds would take 5 days electronically. I asked to speak with a supervisor who told me that she would NOT return the payment unless I had the bank fax Comenity Bank confirmation of the payment on their letterhead even though they showed the funds already in their accounts. They then said that the returned payment would take 21 days.

Consumer Complaint: On XX/XX/XXXX a rep from XXXX XXXX called me because I was XXXX pmts behind. After speaking to the rep we came to an agreement that I needed to pay XXXX dollars to help the account. I made a {$47.00} pmt on XX/XX/XXXX while speaking to her and set up a pmt to come out on XX/XX/XXXX in the amount of {$45.00}. The rep then advised that because of my pmts when the on on XX/XX/XXXX cleared I would get {$160.00} in late fee credits applied to the account. Today XX/XX/XXXX I call because I did not see the {$160.00} credited to my account. I was then advised that in order to get the {$160.00} credited to my account I would need to make pmt arrangements for the balance of the card. I made the arrangements of {$20.00} for XX/XX/XXXX and then {$86.00} on XX/XX/XXXX. The rep then proceeded to tell me that I would not be credited the {$160.00} until the pmt in XXXX cleared. The rep then said that she had already given me a XXXX XXXX {$82.00} on the day I made the $ XXXX on XX/XX/XXXX. I told her that everything she said was contradictory because she first told me that I would not be able to get the credit until after the pmts posted... so how did she give me a credit the same XXXX XXXX. Please someone look into this. It is my second time feeling XXXX over by them. I am trying to make my pmts but they make me not want to because they keep lying to me.
