Consumer Complaint: My name is XXXX XXXX and I am writing to you to submit a complaint against XXXX XXXX XXXX XXXX. On 2021, I took a loan of {$4200.00} from Comenity/ XXXX XXXX XXXX XXXX which I had been paying every month. I have paid over {$1500.00} so far but my balance never goes down. My balance is still {$3700.00} (! ) After a year of monthly payments. I usually call them the month before my payment is due, on the XXXX of every month, to schedule the payment through my debit card to avoid being late. But they purposely wait until the XXXX of every month to collect the timely scheduled payment so to also collect late charges. Consumer Complaint: I tried Making a purchase on my consumer card through Commenity Bank ( XXXX ) purchase did not go through and they still took the money off of the card. The Purchase did not go through on the end of XXXX but the card company states that I made the purchase. Every time I call, I am transferred to a different person and am told different information. I have been hung up on 4 times. Every time I talk to XXXX, I am told to talk to bank, and bank tells me to talk to XXXX. I have gotten no where. I am just trying ti get this resolved because I do not want my credit score to go down or owe {$3200.00} for a purchase I did not make.

I submitted a notarized fraud claim and disputed this with all three credit bureaus and the debt buyer removed all of the accounts from my credit report. In addition, all of these accounts were opened within 30 days of each other which further points to identity theft. This is as long as your account was already current. This applies to agreements made between XX/XX/XXXX and 120 days after XX/XX/XXXX or 120 days after the COVID-19 national emergency ends. ****In XX/XX/XXXX XXXX/COMENITY/XXXX is reporting a late payment to my credit report however I had follow all steps of making a valid payment arrangement via the cares act with this company during the XXXX XXXX XXXX however the company is still reporting inaccurately to all 3 of the national credit agencies I was current before and after that time also. you are current on payments and make special arrangements, creditors must report the account as current. Late and missed payments CAN NOT be reported if you have already made arrangements.

On average 10 calls per day with no voicemails, my accounts are NOT over due and hold a collective balance of under {$1000.00} that is current. This is unacceptable, I will be paying my accounts off and closing my account and never doing business with Comenity or any of the subsidiaries.

Consumer Complaint: I have sent letters to this debt collector and they are attempting to collect on a debt not authorized by an original agreement. They have not produced any agreement that shows that I owe a debt yet they are continuing to collect on a debt, fees, interest, and costs not authorized by an an original agreement. They have also threatened me with legal action that they can not actually take and I feel very harassed. Additionally, they have failed reported inaccurate information to my credit report including, but not limited to failing to update the credit bureaus to state consumer disputes. I am requesting that your office please investigate this matter I am a XXXX citizen and this is causing me a lot of anxiety spending all of these countless hours trying to fix the mistakes of this company tying to collect on a debt that a contract does not even exist for.
