Consumer Complaint: I was denied credit from this company, but my objective when applying for credit was to have a credit application drawn up so I may extend my credit to this company. under 12 CFR 1002.7 it states a creditor shall not refuse to grant an individual account to a credit worthy applicant on any prohibited bases. Also 12 CFR 1002 regulation " B '' ( equal credit opportunity act ) is there to promote availability to credit worthy applicants, so they would be in violation. 12 CFR 1002.4 ( D ) states a creditor that provides in writing any disclosures or information required by this part must provide the disclosures in a clear and conspicuous manner. On XX/XX/year>, I applied on an application to B.O.A but their application was not one for use by a natural person, consumer, and original creditor. The federal law for consumer rights protections does not define what a loan is, so I did not want to use that terminology when applying but there were no other accessible forms. I was denied use of my social security card as my credit card when under 15 usc 1602 ( I ) it states any card used to get money, property, labor or services on credit. On my adverse action letter from them it puts that I have major derogatory or delinquencies on my file, but some of those are from closed accounts and debts that were not validated or verified.

Consumer Complaint: After depositing a check to my business account on XXXX, Bank of America informed me that they were terminating the banking relationship. After some investigating, it was determined that I needed to send over another document on my companies dealings. Documents were taken to a branch, and sent to Bank of America 's corporate office. From there representatives have informed me several times that my funds totaling XXXX would be sent. The representatives asked me to call back on the XXXX of XXXX. I rang them and was informed that funds would be sent on the XXXX of XX/XX/2024. The XXXX came and went, spoke to another representative who stayed the account would close out on the XXXX and to call again on that date. The XXXX arrives with me going into a banking center local to me, and having a banking mngr call on my behalf. We were then informed that I needed to wait until the XXXX. On the XXXX I call, only to be told that I should call on the XXXX '', i I formed the rep that it was indeed the XXXX she told me to go to a branch and have a rep there call and confirm my identity. The following day I returned to the same branch I'd previously visited had the same rep ( XXXX ) call, we were informed the check would depart that day for delivery to my home. I called the bank again on the XXXX of XXXX for confirmation of the check having been sent. Only to be told that the account was still open and that it could take an indeterminate amount of time to close. I asked for a supervisor. The supervisor informed me that she was escalating the matter and to call back in XXXX. Which starts on Monday the XXXX of XX/XX/2024. I've asked for the return of funds to be given in branch, im told it has to be mailed. Which makes no sense to me. XXXX important. I'm tired of having to chase my funds. The internet is littered with horror stories of how banks are closing accounts for reasons unknown and clients are not getting their hard earned monies returned them. However the ones who turn to the CFPB seem to get their monies returned. Hence the reason for my complaint.

I have the right to make sure my private information isnt shared which is backed by 15 USC 6801 which states It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. The Fair Credit Reporting Act 15 USC 1681 section 602 a states There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness impartiality, and a respect for the consumers right to privacy XXXX Bank of America and XXXX is a financial institution by definition under that title. 15USC 1681 section 604 a section 2 states that In general subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. XXXX, Bank of America and XXXX, XXXX, XXXX and XXXX do not have my consent to report my information, any and all consents whether verbal, non-verbal, written, implied or otherwise is revoked. XXXX Bank of America XXXX and XXXX this account is reported as a charge off, according to 15 USC 1681 and the Privacy Act of 1974 recognize charge offs as certificate of indebtedness, that is considered income and income is not reported on credit reports and must be removed. XXXX, Bank of America XXXX and XXXX did not inform me of my right to exercise my nondisclosure option. 15 USC 1681C ( a ) ( 5 ) says Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information, any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years This account is an adverse item they are reporting again without my permission which is against the law. Remove all hard inquiries. According to 15 USC 1681b They need your written consent to add anything to your consumer report if you did not give the authorization that is a violation of the Fair Credit Reporting Act. 15 USC 1681s-2 ( A ) ( 1 ) A States A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title.

Consumer Complaint: I have had to go into bank of America 3 times to verify and they still froze my account and canceled my card. I had to wait 7 days for the new card and I was able to use it 1 time then they froze it again. Even though I responded to the text message verified it was me and received a text message saying my card was good to go again it still won't work. They are going to make me come in and verify again and probably order a new card. There is no reason for this I'm not doing anything suspicious. They just want to keep my money from me. I'm homeless and had a place to rent set up. They canceled my card and I lost the place. Someone else rented it and I'm still on the streets freezing, wet and hungry.
