Issue: Dealing with your lender or servicer
Subissue: Trouble with how payments are being handled
Consumer Complaint: Hello, American Education Services incorrectly reported XXXX of my student loans as defaulted upon, during the pandemic student loan forbearance period. No payments were due during this period, so there was no default assignment warranted. They were then reassigned to a collection agency, XXXX, who advised me of the issue and they've been stuck there since XX/XX/XXXX. I've been told that they are in the process of being assigned to good status, for the last 10 months, but nothing has happened. In addition, this default status is on my credit report, impacting my credit score. I will not be able to qualify for the temporary PSLF waiver until this is rectified, and that due date of XX/XX/XXXX, is rapidly approaching. Appreciate your assistance. XXXX XXXX

Consumer Complaint: My husband and I have been XXXXs for 30 years ( him ) and 20 years ( me as a XXXX XXXX XXXX XXXX ). We were told to consolidate our loans in 2003 under a spousal consolidation loan. We were sent to AES and we have been paying ever since. 20 years later we have barely made a dent paying almost {$500.00} per month and now our children 's loans are due. Now, after submitting all the required paerwork to the PSLF program, we are told by AES, PHEAA, and XXXX that we can not getforgiveness through the PSLF program because they consolidated us back in 2003 into a XXXX joint spousal consolidation loan. According to the new PSLF regulations, we would need to consolidate the loans under XXXX to get forgiveness, which we tried to do. XXXX said they won't do it because it was consolidated back in 2003. The fed govt stopped the practice of getting spouses to consolidate under AES, but we seemed to have been forgotten and are not allowed to join our fellow XXXX in any relief because of what we were told to do by federal loan providers in 2003. According to the experts, the XXXX joint consolidation loans were found to be detrimental and so they stopped offering them, but now the providers have left the couples who were advised to take them out forgotten in the forgiveness program. We feel like we were lead into a trap and can not get out. We have served diligently in XXXX XXXX XXXX XXXX for years and paid w/o missing any months. I am asking if you can help advocate for us to consolidate these loans under XXXX or start the complaint process as I truly believe there are more of us out there who are being treated unfairly.

Consumer Complaint: My loans were transferred to AES in XX/XX/XXXX. I have never been late with AES. My credit reports from XXXX to XX/XX/XXXX have not shown any late payments. Now in XX/XX/XXXX XXXX XXXX days late entries for XXXX loans appear on my credit report for XXXX and XXXX of XXXX. My loans began servicing with AES on XX/XX/XXXX, when I received a welcome email. How can I be 60 days late in the first months with AES? Also, why is this appearing on my credit reports XXXX years later? I have disputed directly with AES and through the three credit reporting agencies. AES states that they feel no adjustment is necessary and my credit reports have not changed. This inaccuracy tanked my credit score. AES should not report inaccurate information about student loans or borrowers.

Consumer Complaint: I've continually had issues with American Education Services who services my private student loan through XXXX Bank. The interest rates are criminal, I've already paid most of the loan back but still owe the entire principal amount. I've been making more than 7 years of payments with little to no progress. I've attempted to get my payment reduced, but because my grandmother cosigned on my loans almost 15 years ago, I can not do anything without my grandmother 's signature. My grandmother is now XXXX, with XXXX, living as a XXXX of the XXXX with no income other than XXXX XXXX and due to my poor credit score, which is likely because of my student loans/debt-to-income ratio, I am not able to apply to have her removed. More recently, I've been a victim of identity theft and had to have my bank account shut down to get new accounts, cards, etc. Because of this, my bank issued a stop payment for my student loan payment with AES. Once I found out, I immediately reapplied the payment, but they charged me a late fee. I petitioned to get the late fee removed, as I have an amazing payment history with them, and explained to them why it was late. I was notified yesterday they denied the request to waive my late fee. To say Im disappointed would be an enormous understatement. The interest on these private loans are astronomical and theyve decided that due to a stop payment issued by my bank due to identity fraud, they need an extra couple bucks. A huge corporation, in addition to my fees and interest, needs to make a continual profit off of a new mom, working hard just to pay back the education I do not use with insanely predatory interest rates. This is criminal.

Consumer Complaint: Pennsylvania Higher Education Assistance Agency ( PHEAA ) aka FedLoan : This federal student loan servicer is one that was one of numerous companies whose egregious acts in servicing student loans has now come to light very publically. I am one of the fanthomable number of borrowers who was victimized by servicers like and especially PHEAA in not properly servicing student loans. Some forbearances, deferments, public servant forgiveness, and/or Income Based Repayment plans were erroneously not properly implemented and/or delayed causing error in repayment history and as such reported to the credit bureaus. FedLoan is responsible for determining borrowers progress towards forgiveness and borrowers reasonably rely on its ability to do so, but FedLoan lacks incentives to carry out this obligation accurately or in some instances at all. PHEAA fails to timely and accurately process income-driven repayment plan paperwork filed during relative periods. PHEAAs errors in calculating payment amounts or verifying recertification or not processing my IDR forced me into costly forbearances. PHEAA even removed me from XXXX plans in which they have successfully enrolled in placing me on forbearances instead. PHEAA steered me to less favorable options rather than income-driven repayment plans and ultimately consolidation, which deprive me of the opportunity to progress towards loan forgiveness, and what I am to understand incentivizing for them. There are numerous other fed student loans that were not delinquent, public reporting, governmental lawsuits, US government actions, and the efforts of the Biden Administration should stand as substantive proof of this. The state of New York sued PHEAA in federal court in XXXX and settled in XX/XX/XXXX. Although this settlement is applicable to NY residents ; the elements of the complaints are universal nationwide. The federal lawsuit starts its intro with : XXXX. In XXXX, Congress created the Public Service Loan Forgiveness ( PSLF ) program, which encourages individuals to work in public service by offering federal student loan forgiveness to borrowers who complete a period of public service. 34 C.F.R. 685.219. PSLF enables graduates to take low-paying jobs in government and at nonprofits serving veterans, the elderly, low-income children, people with XXXX, victims of XXXX XXXXXXXX, and other vulnerable groups. Many teachers, nurses, social workers, firefighters, and members of the armed forces are eligible for PSLF. XXXX. Our society needs more teachers, more emergency management and law enforcement professionals, more public health doctors and nurses, more social workers, more librarians, more public interest lawyers, and more early childhood teachers, XXXX XXXX XXXX, one of the sponsors of the program, explained. Under our bill, we will produce more of them because theyand all the groups I have just mentionedwill be eligible for loan forgiveness. XXXX. PHEAAs failures as the PSLF servicer, however, have undermined the goals of the PSLF program and created financial hardship for many of these dedicated public servants. XXXX. PHEAA, operating under the name FedLoan Servicing ( FedLoan ), services loans held by the U.S. Department of Education originated under the federal Direct Loan program, including those of New Yorkers, and those Federal Family Education Loan Program ( FFEL ) loans owned by the federal government. PHEAA also services privately-owned FFEL loans and private student loans for tens of thousands of borrowers in New York and nationwide. XXXX. FedLoan also has an exclusive contract with the U.S. Department of Education to service the accounts of borrowers seeking PSLF. As new and corrective actions by the Biden Admin. are taking place, it has come to light that I qualified for forgiveness under PSLF years ago or at least prior to PHEAA suspending its servicing of my loan ( XXXX ) in XX/XX/XXXX ; transferring it to XXXX.

Consumer Complaint: On XX/XX/2021 I sent a certified letter stating that accounts : FedLoan were inaccurate and incorrect accounts. The Credit bureaus have investigated and stated account FedLoan can not be verified as being my account. This is grounds for removal. Under section 609 law states I have a right to see what the furnisher ( lender, creditor collector, or court ) sent to the credit reporting agency. Please provide my original promissory notes and all student loans that you service. Please send my original signature that was signed in wet ink ( not electronic ). The law also states that all debt has been paid for within 180 days. These accounts were already paid off. These accounts are not my accounts. See attached letters.

Consumer Complaint: I am currently with FedLoans ( PHEAA ) and submitting for PSLF. I submitted an ECF 3 years ago for my oldest employer and they did not try to apply it until this year. After waiting 3 years, they denied that XXXX XXXX XXXX filled out the paperwork correctly. I worked for XXXX in a variety of jobs over 16 years so they put " see attachment '' and provided an attached document with the required information on letterhead and signed by a HR official. There is no reason that this should be denied. In the meantime, I called multiple times to ask if this would be a problem and was assured that it would not be a problem. I went back to XXXX and asked them to fill out XXXX individual forms to cover what I needed certified for PSLF. PHEAA will not expedite the review even though I have been waiting for 3 years. The years that this employment covers is further complicated as I was with XXXX as my servicer and can not obtain my records from them. Fedloans bought those loans in XXXX but even they do not have the records. This will further delay my PSLF review under the temporary waiver. I graduated in XXXX and have been paying on these loans for more than 20 years. After years of being given bad information by bad actors there is hope for forgiveness under the temporary PSLF waiver. I just want someone to make FedLoan actually review this final ECF and apply the payments ( through DoE review ) so that my more than 120 payments can trigger forgiveness.
