I am writing to you regarding some substantial concerns I have uncovered during my thorough examination of the operations of Navient. As a conscientious consumer and advocate for ethical business practices, I believe it is crucial to bring these matters to your attention for immediate investigation and resolution. 1. Opting Out Violation ( 15 USC 6802-6805 ) : Upon reviewing the legal framework provided by 15 USC 6802-6805 , which empowers consumers to opt out of financial information sharing with institutions, I have observed potential instances where Navient might not be fully adhering to these statutory provisions. This has raised concerns about the protection of consumer privacy rights. It is my earnest request that your team conducts a comprehensive review and takes necessary steps to rectify any non-compliance issues promptly. 2. Credit Report Accuracy Infringement ( 15 USC 1681 ) : In the course of scrutinizing my credit report obtained from XXXX XXXX XXXX XXXX XXXX I have uncover discrepancies that may be in violation of 15 USC 1681. This crucial federal law mandates the accuracy and fairness of credit reporting, placing a responsibility on entities like Navient to conduct thorough investigations and promptly rectify any inaccuracies. Ensuring compliance with this law is vital for maintaining consumer trust and confidence. 3. CFPB Complaints Negligence : My investigation has brought to light a potential neglect in addressing and resolving complaints submitted to the Consumer Financial Protection Bureau ( CFPB ). Failure to actively engage with and resolve these complaints is a direct violation of CFPB regulations. I urge Navient to conduct an in-depth internal review, recognizing and rectifying any shortcomings in addressing outstanding complaints. This proactive approach is not only essential for regulatory compliance but also crucial for upholding the reputation of your organization. 4. Privacy Act of 1974 Non-Compliance ( 5 U.S.C. 552a ) : Preliminary findings suggest a potential non-compliance with the Privacy Act of 1974 ( 5 U.S.C. 552a ). This federal legislation mandates precise management of personal information by government entities. Any deviation from its stipulations requires immediate attention. I strongly recommend that Navient initiates an immediate internal audit to ensure strict adherence to the Privacy Act. Proactive steps in this regard will not only align the organization with legal mandates but also enhance overall data protection measures. 5. General Redress and Compensation ( 15 U.S.C. 1681n ) : The collective impact of these infringements has resulted in both quantifiable and intangible harm. In accordance with 15 U.S.C. 1681n, I formally demand Navient to provide due compensation for the distress and material losses borne as a direct consequence of these transgressions. This includes but is not limited to the time and effort expended in rectifying inaccuracies, emotional distress, and any financial repercussions suffered. To facilitate a fair and swift resolution, I kindly request a comprehensive response addressing each of the highlighted concerns within [ 30 days ]. Consumer Complaint: I'm asking for lower payment options and I give them all of my payment options and I still can't afford the " so called lowest payment that they '' can give me is {$120.00}, when previously it was {$60.00}. It has done nothing but get higher and higher. I'm a single mother I do not qualify for welfare. I have rent, car note, groceries to buy. They aren't giving me any other options while they destroy my credit.

Consumer Complaint: My ex wife and I were offered a consolidation loan for our Federal Student Loans shortly after we were married in approximately 1998. We have been divorced for 5 years I we are unable to separate our loan because when we consolidatednit was not explained to us that our loan was being purchased by a private loan company yet guaranteed by the Federal Government but no longer a Federal student loan. I am a XXXX and should be afforded the privilege of loan forgiveness for my portion of loan but at the least allowed to separate the loan between my ex and I. I feel we are victims are predatory lending and were taken advantage of during a difficult time financially. And now to be saddled with a loan with my ex and it's responsibility in my new marriage is a strain on my marriage. So many opportunities are available to direct serviced loans and not me because I was purchased like a commodity which to me translated into modern day indentured servitude.

Consumer Complaint: XX/XX/2023 my certified letter responding to the debt within the 30 days time frame went unanswered. In this letter I requested proof of debt, itemized breakdown, any attempts previously made to collect the debt. I also requested that all correspondence be done by mail or email. XX/XX/2023 I called and asked if my letter was received. They said it had not been although it was signed for. I verbally requested items outlined above. XX/XX/XXXX a second call was made in which I was transferred to management and they attempted to get me to talk about the letter. I stated again all correspondence will be done by mail and asked for the items outlined above. XX/XX/XXXX I called again to request the items outlined above. I do not have high hopes I will receive anything.

Consumer Complaint: Payments were made by me, the co-signer, for 12 years. This amounted to {$40.00}, XXXX which exceeds the original loan amount by {$9700.00}. The original borrower has made no attempt to pay. I have made numerous attempts to get Navient to get the borrower to sign the release of co-signer form. This has not happened. I am now being harassed by Navient in the form of daily phone calls, emails, and USPS mail. I know that the State of California is one of many who have taken action against Navient for unfair loan practices.

Consumer Complaint: 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' Navient, the financial institution and the Consumer reporting agencies XXXX, XXXX, and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Per the FCRA, as a federally protected consumer, I am now opting out of any and all authorization that I, the consumer, may have given you that was written, unwritten, verbal, or nonverbal per 15 USC 6802. Any and all consent to XXXX, XXXX, XXXX, and Navient whether it be verbal, non-verbal, written, implied or otherwise is revoked. According to 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services.
