Consumer Complaint: I have attempted several times to get this company to comply with ( A ) subject to section 1681s3 of this title, any ( i ) report containing information solely as to transactions or experiences between the consumer and the person making the report ; They are refusing to lawfully comply which is also a violation of The Privacy Act of 1974, as amended, 5 U.S.C. 552a, which establishes a code of fair information practices that governs the collection, maintenance, use, and dissemination of information about individuals that is maintained in systems of records by federal agencies. A system of records is a group of records under the control of an agency from which information is retrieved by the name of the individual or by some identifier assigned to the individual. The Privacy Act requires that agencies give the public notice of their systems of records by publication in the Federal Register. The Privacy Act prohibits the disclosure of a record about an individual from a system of records absent the written consent of the individual unless the disclosure is pursuant to XXXX of XXXX statutory exceptions. They are also in violation of my copyrighted name and are now committing identity theft by me opting out and not having my express written consent and authourization.

Consumer Complaint: This is in reference to a bankruptcy that is reported on my credit report. XX/XX/23 - Sent letter advising that this account is not accurate, and to please remove from my report. Never received a response. XX/XX/23 - Sent a second letter letting them know that this is still showing negatively and inaccurately on my report and requesting for it to be removed. Still no response. XX/XX/23 - Sent a third letter advising that this is still on my report in a negative status, that I have never received any response and once again requesting this be removed from my report. Again, no response. XX/XX/23 - Sent letter requesting method of verification and if not able to provide this, to remove from my report immediately. Again, no response. XX/XX/23 - Sent letter of formal complaint that they are reporting inaccurate and unverifiable information on my report. I was demanding to see their verifiable proof and that if they couldn't provide this - to remove the account immediately from my report. - Once again, no response. XX/XX/23 - Sent last letter advising of the numerous times I have requested this account to be verified including the method of verification and the person with whom they verified it with - or to be removed. I let them know that if this was not done, I would be filing an official complaint with the CFPB - and that is what I am doing today.

This dispute is based on the provisions outlined in the Fair Credit Reporting Act, including 15 U.S. Code 1681a, 15 U.S. Code 1681s-2, and 15 USC 1681a 2 ( A ) ( i ). According to 15 U.S. Code 1681a, the definition of a consumer report excludes reports containing information solely as to transactions or experiences between the consumer and the reporting entity. It is evident that the information in dispute falls under this exclusion. Furthermore, 15 U.S. Code 1681s-2 emphasizes the responsibility of furnishers of information to consumer reporting agencies. The consumer reporting agencies have assumed a vital role and have a responsibility to report consumer information to the best of their ability with maxima accuracy. Please investigate and provide proof with statements showing that these payments were late.
