Yet XXXX is reporting this information.. The reporting of excluded information pursuant to 15USC 1681 a ( d ) ( 2 ) ( A ) ( i ) on a consumer report is a clear violation of Metro2 compliance. Provide me with the Metro2 compliance disclosure on reporting transactions to a consumer reporting agency. I need the transactions reporting as late, collection/charge-off status and any other derogatory information deleted from my consumer reports effective immediately. Before you think to reply that this account has been " validated ', let 's be clear that I am not asking you to validate or verify anything. So please do not respond by telling me that as a tactic to waste my valuable time. Some of the negative accounts have been placed in Collection/Charge-Off Status WITHOUT mailing me a copy of IRS form 1099-C Cancellation of Debt. Consumer Complaint: I am writing to file a complaint against XXXX, XXXX, Equifax for violating the Fair Credit Reporting Act ( FCRA ). I believe that inaccurate information is being reported on my credit report and I am requesting that this information be removed in accordance with the FCRA laws. I have recently reviewed my credit report from XXXX, XXXX, Equifax and have discovered that there are several late payments listed that I believe to be inaccurate. The account is : XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX agreed to change the payment due date over the phone and never did so, resulting in an error.They agreed to remove the late payment. XXXX XXXX also needs to be removed as this reporting is unlawful. According to Section 609 of the FCRA, I am entitled to receive a notice of my rights when I request a copy of my credit report. This notice must include information about my right to dispute errors in my credit report and to request a credit score. Furthermore, Section 611 of the FCRA requires CRAs to investigate consumer disputes and to correct or delete inaccurate or incomplete information in their credit reports. Section 615 of the FCRA requires CRAs to follow reasonable procedures to ensure the maximum possible accuracy of the information in credit reports. I have disputed these late payments with XXXX, XXXX, and Equifax but to date, no action has been taken to correct the inaccuracies on my credit report. XXXX and the CRA 's have illegally altered the information several times, even adding more late payments. I believe that XXXX, XXXX, and Equifax have failed to comply with their obligations under the FCRA, specifically under the following sections of the FCRA : 623 ( a ) ( 1 ), which requires CRAs to maintain reasonable procedures to ensure the maximum possible accuracy of the information in their credit reports. 623 ( a ) ( 2 ), which requires furnishers of credit information to provide complete and accurate information to CRAs. 623 ( b ), which requires CRAs to reinvestigate consumer disputes if the consumer provides new information. 623 ( c ), which requires CRAs to delete information that is outdated, incorrect, or can not be verified. I demand that XXXX, XXXX, and Equifax take immediate action to remove the inaccurate late payments from my credit report and to comply with their obligations under the FCRA. If XXXX, XXXX, and Equifax fail to comply with this demand, I will have no choice but to consider my legal options, which may include filing a lawsuit to seek damages, statutory damages, and attorney 's fees for FCRA violations. As the XXXX bureaus have not done a lawful job of investigating, I need these accounts removed. This unauthorized reporting has caused great pain in my life.
