Consumer Complaint: I discovered a credit card issued by Capital One was opened fraudulently in my name, using an address that I have never lived at. I called Capital One in XX/XX/2023 when I first learned of the card and asked them to close it immediately - there was a {$0.00} balance at that time. I was on a recorded line, so they should be able to verify that I asked to close this card. It turns out that Capital One opened a fraud investigation, but did not close the card. Since that time and after several phone calls with Capital One, Capital One mailed me a letter of their investigation dated XX/XX/2023, saying that they found I am responsible for this account because " activity on the account indicates you opened and interacted with this account. '' Charges now totaled {$390.00}. I called and explained that I have never owned/or lived at the property address used to open the card in my name. Capital One said I need to prove that to have my case reconsidered. Key Dates : XX/XX/2023- I discovered a card for Capital One was opened fraudulently in my name XX/XX/2023- I called Capital One and asked to have the card closed immediately, as it had a {$0.00} balance - they did not close the card XX/XX/2023 - filed a police report XX/XX/2023 - filed a report on the Federal Trade Commission 's XXXXdentitytheft.gov website XX/XX/2023 - first letter sent to all three credit bureaus - XXXX, XXXX, XXXX XX/XX/2023 - received a letter from Capital One saying they are investigating my fraudulent claim XX/XX/2023 - mailed Capital One copies of the police report and the report filed with the Federal Trade Commission 's identitytheft.gov website XX/XX/2023 - talked with Capital One again who said the investigation was ongoing and it could take 60-90 days XX/XX/2023 - second letter sent to credit bureaus XX/XX/2023 - received a letter from Capital One saying I'm responsible for the fraudulent charges XX/XX/2023 - talked with the Capital One fraud department who said they will not reopen my case unless I can produce new evidence that the account was opened fraudulently XX/XX/2023 - mailed the property owners of the location where the credit application was used to open the card with Capital One asking them to sign/notarize a letter I had drafted saying I have never lived/rented their property XX/XX/2023 - filed a complaint with the Consumer Financial Protection Bureau

Consumer Complaint: Capital One has violated 15 U.S. Code 6801 - Protection of nonpublic personal information by not protecting against unauthorized access to or use of such records or information which resulted in an inconvenience to to me. That violates 6801 ( b ) 3 and USC 6801 ( b ) 1 because they didnt insure the security and confidentiality of my records and information ; They also violated 15 USC 6802 by reporting late payments to my credit report that also caused adverse actions which is yet, another violation. They violated 15 U.S. Code $ 1666d - Treatment of credit balances as well.

Consumer Complaint: XXXX 's card was sold from XXXX to XXXX 's, and I wasn't able to get online access and had no paper bill sent. XXXX 's took {$150.00} from a previously scheduled autopay with my old bank ( XXXX ) which I had no ability to change once it went over to XXXX 's on XX/XX/23. This auto payment which I never authorized with them overdrafted my account and cost me a {$18.00} fee. I called them and they were able to set up online access as of today XX/XX/23, and the initial rep said they can help me reverse the unauthorized payment and take instead the minimum due, but when I was transferred the lady said they couldn't do that.

Consumer Complaint: I purchase a service that later on I realized was a scam. I contacted the merchant and he denied giving me a credit stating that there was no return after 72 hours. I received this announcement after 72 hours. The merchant sent me a link for a XXXX call which I could not connect. After this I requested the credit card, Capital One, They requested me to fax a letter to them explaining the matter. After that they sent me a 2 page questionnaire, which I filled out, including my emails back and forwards to connect with the merchant. The Capital One replied that they could not remove the charge because I did not had a contract with the merchant, a contract that I never received, and a document requesting me return on something I never received. Later on, searching the web I found the merchant on the list of scams. XXXX XXXX. I learned my lesson. Please help me to remove this charge. Thank you XXXX regards, XXXX XXXX
