Issue: Managing an account
Subissue: Problem accessing account
Consumer Complaint: Back in XX/XX/XXXX I made a complaint to Capital One Bank about possible fraud on my account so they recommended I open a new one and leave the old account alone so I opened a new account. The old account remained opened but it was locked. When I tried calling again they asked for all my identity information including full social security number, birthdate and even had me upload my ID. They did not give me access to my account because they believed I was a female and not a male and could not believe my name was XXXX being a man. I wanted to close it but was unable. They said in order to do this I had to go into the branch and prove who I was. Mind you, I opened the account when I lived in XXXX back in XXXX and I now live 6 hours away in XXXX, New York. There are no capital one branches in XXXX, New York. I decided not to fight and I left it alone. Fast forward to today Tuesday XX/XX/XXXX. I accidentally transferred {$50.00} my last {$50.00} into. The locked account. I decided to call them immediately and try to access the account so I can move that money into my newer checking account. I needed the money to get my wifes XXXX for XXXX as she is XXXX. I explained the situation all over again gave my Social Security number, my ID and all my identifying information. The man on the phone denied me. I asked for the manager of him. The manager was a female, she looked at my history and didnt understand why they wouldnt let me in the account if I had given my Social Security number, and upload my ID for verification and felt with humiliation and wasted time. She admitted to me that they thought that XXXX was supposed to be a female because my name even tho I sent in a clear picture of my ID clearly display im a male. I feel like because of my ethnic name. I was humiliated throughout this process and not given access to my account on several occasions. It took me three phone calls of humiliation and each call was over 30 minutes. I feel like I was treated very poorly and wish for something to be done in my favor. All interactions took place on their recorded lines so transcripts are available from all interactions. Sincerely, XXXX XXXX

Consumer Complaint: I received an email from BJ 's Comenity about an amount due, about {$81.00}. But I never used the credit card. When I called the company, Comenity, the IVR said I didn't have a balance. But when I asked to speak to a CSR, I was told I had an {$8000.00} balance. When I asked to speak to the fraud unit, " Asset Protection, '' I briefly spoke to someone, but the call was disconnected. I called back several times, on different days, but I was on hold for nearly an hour and no one ever answered. I reached out to XXXX, and the FTC. To date, I still keep getting billing notices from Comenity, now XXXX XXXX has taken over Comenity 's accounts. I acted promply and have been trying to let the card company know this is an identity theft matter. I had received an email around that same time, asking for some kind of payments. I believe I contacted the FTC and sent a copy of the email.

Issue: Problem when making payments
Subissue: Problem during payment process
Consumer Complaint: I made a payment to pay off the balance of my credit card for my capital one credit card on XX/XX/12, this payment has since posted to my credit card account and they have deducted that amount from my current balance, and my bank as well has posted the payment as sent and amount deducted from the active balance. To the day Capital One still has my payment on hold until at least 7 days from the date I paid it with the claim of ensuring the payment is received, even though they have acknowledged receipt of payment by posting the payment to my account and deducting that amount from my balance, and sending me an email they have received the payment and it has been posted. Their claim is contradictory.

Consumer Complaint: Capital One approved me for a credit card and I paid for an entire 12 months 1 year never missing a single payment, nor was I late. Then I had a payment set up for that 13th month and my bank account at the time sent me a new debit card with a new card number. In the interim capital one try taking out their payment and since it wouldnt process because it was canceled due to me needing a new debit card, they immediately said I was being fraudulent didnt email didnt message didnt call didnt ask and just completely close my account, causing my credit to be bad After a year of being loyal and paying every XXXX on time they didnt notify me and then they expected me to pay all the fees on it every single month so every month there forward they charge the fee of me not paying on time {$35.00} and then every month there after I just dont feel like they should be able to abandon me in my loan or ask questions not care And just close it whenever they feel the need when I did nothing wrong Then, because what had happened I was continuing to inquire of funds, and there was no way I was paying it I shouldve been sent a bill from the day with how much I owe Old. They should not be able to close my account not let me use it, but then keep it open for them to charge fees for months. I disputed it a bunch of times and nothings happening so it looks like Im going to take him to court, but they cant close peoples accounts, but keep it open for their own purposes is greedy is wrong.
