Consumer Complaint: Sometime between XX/XX/2023 and XX/XX/2023, an unknown person applied for a credit card with CAPITAL ONE BANK USA in my name. I did not authorize this application. CAPITAL ONE BANK USA made a hard inquiry from credit reporting agencies which lowered my credit scores and I received an alert through a third party app, XXXX XXXX. I called CAPITAL ONE BANK USA to report unauthorized inquiry and/or fraud and to ask them to cancel the card and remove the inquiry. CAPITAL ONE 's customer service would not have a conversation about the issue unless I gave them my CAPITAL ONE account number. I explained repeatedly that I do not have a CAPITAL ONE account number and that the transaction was not authorized. They told me to contact the credit reporting agencies. I did contact the credit reporting agencies and they all told me that I need to contact CAPITAL ONE to make sure they remove the inquiry and cancel the credit card. When I told the reporting agencies that CAPITAL ONE would not talk to me unless I had a CAPITAL ONE account number, the reporting agencies told me to file a complaint with FTC. FTC forwarded me to CFPB, so I am filing the complaint here.

Consumer Complaint: Dear Consumer Financial Protection Bureau, I am writing to file a complaint against Capital One N.A. regarding the closure of my accounts ending in XXXX ( Savor One credit card ) and XXXX ( Walmart credit card ). I believe that the bank 's decision to close my accounts was unreasonable and unjustified, as it was based on the assumption that the account activity was not consistent with personal, family, or household purposes. I assure you that both of my accounts were solely used for family and household purchases, ranging from groceries and streaming services to restaurants. In their letter dated XX/XX/2022, Capital One cited their concerns about my account usage as the reason for closing my accounts. However, I admit that there was an incident involving a fraudulent transaction due to my mistake of using a sketchy website ( s ), which led to my card being compromised. The bank conducted an investigation, and the resolution was in my favor, indicating that it was not considered first-party fraud. If Capital One believed that the fraudulent activity was indeed first-party, I should have been provided with the evidence they found and given an opportunity to defend myself. I would have submitted my hospitalization records from XX/XX/XXXX to XX/XX/XXXX, which show that I was recovering from a XXXX during that time, proving that I was not involved in any fraudulent activity. In light of the above, I respectfully request that the Consumer Financial Protection Bureau investigate this matter and assist in having my accounts with Capital One N.A. reinstated. I also request that all evidence used in the decision to close my accounts be included in the result letter, as I believe that I am entitled to transparency and a fair assessment of my accounts, considering the circumstances and the lack of evidence supporting their claim. I have attached copies of relevant correspondence and documentation to support my complaint, including the letter from Capital One, and transaction history demonstrating the account usage for personal, family, and household purposes. I sent them a letter regarding the inaccuracies in my report such as date of last activity, date opened, date reported, payment status etc. They took more than 30 days to complete the investigation and they claimed that they did a thorough investigation. However when I checked my report, I did not see any changes made at all. The inaccurate information are still reporting. My rights has been violated numerous times. 15 U.S.C 1681 section 602 A. Consumer Complaint: In accordance with the Fair Credit Reporting Act, Capital One : Account # XXXX, has violated my consumer rights. Last year XX/XX/2022, I filed a complaint with CFPB under complaint # XXXX, stating that Capital One has been misusing my information and reporting to the credit reporting agencies information that they were not allowed. They case was closed and nothing was done. I have filed an identity theft report on this matter as well under Report # XXXX. 15 U.S. Code 1681 A- states that I have a right to privacy. 15 US Code 1681b subsection ( a ), also states a consumer reporting agency can't furnish an account without my written instructions. Under 15 US Code 1666B- a creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose. Violation of TILA 15 US Code 1666 ( b ) Billing Error Violation of 15 US Code 1681 - Congressional findings and statement of purpose. If you are unable to provide me with a copy of the verifiable proof, that I was given an option to opt out and not forced to only opt in, in order to receive extension of credit, then you must update and/or remove the information. 15 US Code 6802 - Obligations with respect to disclosures of personal information. ( b ) Opt out ( 1 ) In general, a financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless ( A ) such financial institution clearly and conspicuously discloses to the consumer, in writing or in electronic form or other form permitted by the regulations prescribed under section 6804 of this title, that such information may be disclosed to such third party ; ( B ) the consumer is given the opportunity, before the time that such information is initially disclosed, to direct that such information not be disclosed to such third party ; and ( C ) the consumer is given an explanation of how the consumer can exercise that nondisclosure option. I was never given the opportunity to agree or rescind that my information be reported to a credit reporting agency ; nor was I given the opportunity to deny. I have the right to privacy and what goes on my credit report. I have also filed an identity theft report with the FTC as well. Additionally, failure to respond satisfactorily with the null and void of this account will result in the above actions taken against your company in small claim state proceedings ; I will also be seeking monetary relief of ( {$1000.00} ) per violation for 1 ) Defamation of Character 2 ) Negligence infliction of Emotional Distress and 3 ) Violations of 15 U.S. Code 1666 ( b ) and 15 U.S. Code 1681.

Consumer Complaint: I Opened Capital One CD on XX/XX/2023 with {$600000.00} deposit. I am already a Capital One customer. I have a credit card with a {$35000.00} credit limit. Capital One did not fund the CD until 14 days after I transferred the funds. Customer service informed me that there was a " hold '' on the electronic transfer. I need to log in to my account in order to add 3 beneficiaries to qualify for FDIC insurance. Without the beneficiaries added, only {$250000.00} is insured. Capital One will not let me access my CD online- the site says I must call XXXX which answers with " Capital One Customer Protection Resolution Team '' Calling that number I learned that Capital One requires me to send them photos of my ID using a smart phone. ( This was NOT a requirement when I opened the account, so I feel like I am being blackmailed, while having my funds at risk. ) I do not own a smart phone and had to borrow one to complete their verification requirement. Capital One received the photos fine ( the rep on the phone confirmed receipt ) but I was told that the " computer '' could not read them. I was also told that I could not access my account until I " verified my identity ''. I can only try to upload my photo twice per link sent to me, then I get locked out for " too many attempts '' and have to call back to get a new URL to try again. I tired uploading my ID 5 or 6 times, with both my Driver License and my US Passport, to no avail. When inquiring about how else I could verify my identity, I was literally told to drive from Florida to XXXX, Maryland to show my ID to a bank representative! Reps also told me they could not update my beneficiaries for my because not even THEY could access my account until I was approved by " risk management '' I am so upset with this situation now, that I want to close all of my Capital One accounts. I communicated my desire to close my accounts and was told that I can not close my account, or get my money back, until I successful upload my ID. I have 2-3 hours of recorded calls as well as screen shots of the web site. Multiple reps admitted to me that others have had the same problem that I was having.

Consumer Complaint: Capital One issued an annual fee of {$59.00} to my account on a credit card that I rarely use for emergencies only. The account is usually setup to auto deduct for any balances since I've had it for almost 15 years. This year the deduction did not happen, nor did I get notification via phone or email that my payment was over 30 days late from XX/XX/2023 to XX/XX/2023. When I finally received notice on XX/XX/2023, I paid the annual fee plus a late fee that all totaled around {$120.00}. Today, I noticed that Capital One reported to all 3 credit bureaus which caused my credit score to drop by almost 50 points. I am in the middle of refinancing my families primary residence and this has caused a tremendous issue all on account of a miss in accounting and lack of proper notification from Capital One. I have had this card for 15 years and have never had an issue with payments or excessive balances.

Consumer Complaint: I am a victim of identity theft in which it has resulted in multiple accounts of different varieties has been opened in my name. I have been reporting this information to XXXX, XXXX, XXXX on numerous occasions. They each have failed to investigate this matter properly. I sent in a 609 letter requested that all items be removed and yet these items still remain on my credit report. All items have been reported to the FTC as well. I have sent in my ID SSN and also letters requesting to remove incorrect information off my correct. My rights are being violating by XXXX, XXXX, XXXX and Im in the process of seeking litigations. There are multiple inquires wrong names and address and fraudulent accounts located on the credit reports. I was also told that there is another account from another person with a similar name who's information was merged with my account.
