Consumer Complaint: Please see the attached letter regarding the account that is not mine due to identity theft. I have filed all of the necessary forms including the ftc online form and affidavit. This is all equivalent to a police report as well. This is my second request to you to remove these fraudulent accounts from all three of the credit bureaus before I take legal action. Send the validation of these accounts as well with your response back to this complaint. I want the account name, account balance, past due amount, date of last activity verified and provided to me as well.

( a ) Time to make payments A creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose, unless the creditor has adopted reasonable procedures designed to ensure that each periodic statement including the information required by section 1637 ( b ) of this title is mailed or delivered to the consumer not later than 21 days before the payment due date. ( b ) Grace period If an open end consumer credit plan provides a time period within which an obligor may repay any portion of the credit extended without incurring an additional finance charge, such additional finance charge may not be imposed with respect to such portion of the credit extended for the billing cycle of which such period is a part, unless a statement which includes the amount upon which the finance charge for the period is based was mailed or delivered to the consumer not later than 21 days before the date specified in the statement by which payment must be made in order to avoid imposition of that finance charge. Issue: Problem with a lender or other company charging your account

Consumer Complaint: Deep flaw in banking system, someone should take action to fix it. My checking account in XXXX XXXX ending with XXXX, was compromised and fraudulently some one withdrawn approx {$6000.00}. flaws in banking 1. if someone get your account number & checking number can initiate direct electronic withdrawal?? why there is no two step verification, if someone trying to do so at fist time?? why there is no confirmation process when large amount withdrawal is initiated 2. Errony, when I noticed some unauthorized is trying to link my checking account, i immediately informed bank to stop this merchant to make any transaction, but they failed!! link happed on XX/XX/XXXX and withdrawal done on XX/XX/XXXX. Why bank is not accountable for its carelessness, in spite of being reported promptly, they let fraud happed?? who is bearing cost of such flaws in system?? taxpayers?? 3. Response from bank on next day XX/XX/XXXX - They take 3 days to block any merchant,, BUT can allow withdrawal in one day???? - this is totally unreliable, system 4. no 24x7 customer care- if someone want to complain about fraud- it can happen any time of the day 5. it was hard to explain agent - how to look for signs of fraud - being IT guy I know these, but unfortunately, they were not. 6. Bank have no clue who has withdrawn money, which account number, location of merchant?? how it is possible?? if so it very dangerous to keep money in any of XXXX XXXX?? 7. they just have a name of merchant - XXXX XXXX XXXX XXXX which I can see online 8. since when XXXX started steeling money directly from accounts - I have to relation with XXXX, why this type of common sense alert is not in banking system??? 9. I have yet not received any money back- bank says may take up to 10 days -- - why do i suffer on bank failure?? who will be responsible if I dafault on credit card payment, or any other due??? Looking forward for clarification on above points, and let me know if there safe bank exist

Issue: Struggling to pay your bill

Consumer Complaint: I filed a complaint with Capital One, but they were hesitant about assisting me because the Consumer finance account was in both my husband and I name, but when submitted, it only showed my husband name. When I spoke to a representative from Capital One and advised of the issues that were going on with my account, how Capital One closed my account and continues to charge me, they labeled one of my accounts fraud ( which it is not ), how I have loss income and they are refusing to work with me. I enrolled in a debt management plan and seems that Capital One is not willing to work with consumers that have financial hardships. The debt management plan is XXXX XXXX XXXX. Well, today XX/XX/16, I received a packet from Capital One advising they credited the account of fees, which I think they should have. How does a credit card company close your account and continue to charge you past due fees when you dont pay on time. The purpose of enrolling in a debt management plan is because I have a decrease in my finances. Capital One does not want to work with outside debt management financial institutions because they want to continue to gain the BILLIONS of dollars in interest they gain from consumers who can't afford it. They should not the interest rates are extremely high and they should offer some help. As I waited for someone to contact me back, AGAIN I keep getting past due fees. How is this fair to the consumer? When an account is closed, the account is closed and there should be no more fees added. Capital One continues to purposely add fees to closed accounts which should be against the law and is not fair to the consumers. And by the way, I have gain {$39.00} ( PAST DUE FEES ) ON CLOSED ACCOUNTS, 3x 's while waiting for Capital One to call me. I wonder how many African Americans does Capital One do this to, closing a customer account, continuing to add fees to a closed account, and refusing to work with the customer on debt management. I am beginning to think this issue only affects a certain type of group. I have heard others of my ethnic group advise that they have gone through this same issue with Capital One. Sounds like this is UNFAIR PRACTICES AND TREATMENTS toward a specific ethnic group. I need to speak to someone in the corporate office AGAIN immediately. Accounts are ending XXXX, XXXX, and XXXX

Consumer Complaint: I received a promotion offer in the mail from Capital One credit card. It states " 0 % INTRO APR ON PURCHASES AND BALANCE TRANSFERS UNTIL XX/XX/2024, with XXXX XXXX XXXX % variable APR after that. There is a 3 % fee for amounts transferred until XX/XX/2024. '' I applied using the reservation code and access code provided on the promotional offer. I was accepted and given a {$10000.00} credit limit. I tried to transfer the amount from a higher balance card and was told that there were no offers for transfers at this time. I spoke with customer service and they confirmed that there were no offers for balance transfers although I reminded them that this is exactly what their promotional offer stated. I immediately closed my account and had to be on the phone with customer service for over 30 minutes in order to receive confirmation that the account was closed. This is false advertisement!!!

Consumer Complaint: I sent a payment the week before XXXX XXXX. Capital One did not credit the payment until after the holiday that XXXX and I incurred late fees and interest was charged shortly thereafter. Based on incorrectly applied late fees compounded into my balance. When I called Capital One to suggest this had to have been an error because my payment processed by the early morning of the XXXX after XXXX 's XXXX. Well before any mail would have come to the Capital One payment address. It would be virtually impossible for them to cash a check that's not physical there. I explained several to the agent I sas speaking with. I was callously condescended and essentially called a liar on the recorded line. When the agent got frustrated that my story was true he suggested we do a three way call with my bank. I gave him the number and he got them on the line. He introduced himself and commandeered the situation like a police officer interrogating a suspect. The bank representative corroborated my story by answering his specific questions and he eventually relented and agreed to rescind the late fees. He also told me they wouldn't report my payment as being late. Later that week I purchased a vehicle with loan money from a XXXX program for my small business, and primary means of income. I was purchasing the insurance as was required and received a letter from the insurance company today letting me know my payment was rejected by my credit card company. I thought that had to be a mistake because I cleared up the situation and then for good measure sent just shy of {$5.00} to cover any interest that's still left compounded from erroneously applied late charge that would render my XXXX charge late. I checked my account and sure enough, in an expectedly retaliatory fashion, Capital One had continued to block the card and report the payment as late to credit bureaus even after they admitted fault and rescinded the late fee. I have been driving uninsured for almost a week. When I called Capital One to rectify the situation, the agent just kept repeating what my outstanding balance was completely disregarding my explanation and the observable clues that Capital One is in the wrong. I work way too hard to be the subject of deliberate malice towards a client actually keeping up with payments.

Consumer Complaint: On XX/XX/2023 I mad an autopay of {$25.00} then on the same day I made a payment to satisfy the entire statement balance. By the terms of the credit agreement I should not have been charged a finance charge but on XX/XX/2023 I was charged {$39.00} in interest. I spoke to XXXX on XX/XX/2023 to ask about a credit since I had paid in full, I was told that I made the payment after the XXXX eastern time cut off, I was late by about 8 minutes apparently. I spoke to XXXX a supervisor when XXXX could not assist. XXXX said that it was a valid charge and it would not be fair to provide a courtesy rebate.
